Abstract

Notaries have the authority to make authentic deeds and are obliged to provide legal counseling related to deed making. However, there are notaries who provide legal counseling unethically, providing shortcuts without adequate consideration, which can lead to disputes and involve notaries in cases of Sale and Purchase Deeds Containing Nominee Elements. This is contrary to the Basic Agrarian Law (UUPA) and the Notary Position Law (UUJN), which prohibit foreign nationals from owning land titles in Indonesia and require notaries to act honestly and safeguard the interests of all relevant parties. Such actions are considered to violate the law and ethics of the notary profession. The method used is normative juridical research, to identify problems related to the Responsibility of Notaries for Making Statement Deeds Related to Sale and Purchase Deeds Containing Nominee Elements and will be analyzed based on legislation etc. The brief conclusion obtained from the results of this research is that Law Number 2 of 2014 concerning the Position of Notary stipulates that notaries who violate the rules will be subject to administrative sanctions, such as written warnings, temporary dismissal, honorable dismissal, and dishonorable dismissal. In addition, in civil law, notaries who cause losses to other parties due to violations may be subject to sanctions in the form of reimbursement of costs, compensation, and interest according to Article 84 of the Notary Position Law. These violations can cause the deed made by the notary to be degraded, only have evidentiary power under the hand, or be null and void.

Abstract

This study aims to determine and analyze the Notary's responsibility regarding the making of Notarial Power of Attorney to Sell and Deed of Statement indicated as a nominee Deed and legal protection for the parties related to the making of Notarial Power of Attorney to Sell and Deed of Statement containing nominee elements. Using a normative legal research method with a statutory approach and a conceptual approach, this study obtained the result that the Notary's responsibility regarding the making of notarial power of attorney to sell and deed of statement indicated as a nominee deed, namely the notary in carrying out his responsibility as the maker of the deed will be subject to sanctions in accordance with the provisions of the applicable laws. Legal protection that can be carried out by the parties is repressive and preventive legal protection, namely preventive legal protection by making an agreement containing the rights and obligations of the parties, if the agreement is problematic, there are still legal protection efforts that can be taken by both parties, namely repressive legal protection. Studi ini bertujuan untuk mengetahui dan menganalisis terkait tanggung jawab Notaris terkait pembuatan Akta Kuasa Menjual Notariil dan Akta Pernyataan yang terindikasi sebagai Akta nominee Serta perlindungan hukum terhadap para pihak terkait pembuatan Akta Kuasa Menjual Notariil dan Akta Pernyataan yang memuat unsur nominee. Menggunakan metode penelitian hukum normative dengan pendekatan perundang-undangan dan pendekatan konseptuan, penelitian ini memperoleh hasil bahwa Tanggung jawab notaris terkait pembuatan akta kuasa menjual notarial dan akta pernyataan yang terindikasi sebagai akta nominee yaitu notaris dalam melaksanakan tanggung jawabnya sebagai pembuat akta akan dikenakan sanksi sesuai ketentuan undang-undang yang berlaku. Perlindungan hukum yang dapat dilakukan oleh para pihak yaitu perlindungan hukum represif dan preventif yaitu perlindungan hukum preventif dengan membuat perjanjian yang memuat hak dan kewajiban dari para pihak, apabila perjanjian tersebut bermasalah maka masih ada upaya perlindungan hukum yang dapat ditempuh oleh kedua pihak yaitu perlindungan hukum represif.
