Abstract

Artikel ini ditulis dengan tujuan membahas perkembangan konsep hak menguasai negara, sebagai satu-satunya hak kebendaan yang diberikan Konstitusi kepada negara Indonesia. Dalam artikel ini penulis memfokuskan pembahasannya pada hak menguasai negara atas tanah dan pada interpretasi Mahkamah Konstitusi atas hak menguasai negara tersebut. Pembahasan penulis tersebut selanjutnya digunakan untuk menjawab permasalahan bahwa dalam kenyataannya hak menguasai negara atas tanah telah dimaknai secara keliru oleh Pemerintah, menjadi hak memiliki atas tanah. Disamping itu, hak menguasai negara atas tanah semakin tereduksi di Indonesia, digantikan dengan hak privat individual atas tanah. Hal ini mengakibatkan konflik pertanahan yang meluas di antara masyarakat di seluruh Indonesia. Dari pembahasan yang dilakukan penulis terhadap perkembangan konsep hak negara atas tanah dan interpretasi Mahkamah Konstitusi, maka penulis menemukan bahwa berbagai undang-undang sektoral terkait tanah telah menyimpang dari falsafah dan prinsip dasar UUPA. Oleh karena itu, perlu reformasi peraturan perundang-undangan yang mengembalikan UUPA sebagai payung hukum dari segala peraturan perundang-undangan terkait tanah.KEYWORDS: Tanah, Hak Milik, Hak Menguasai Negara, Hak Ulayat, Masyarakat Adat

Abstract

Indonesian Maintenance and Preservation of traditional knowledge and traditional cultural expression or folklore (PTEBT) has forced to be done by government. PTEBT is cultural heritage that gave unreal treasure for Indonesia. This research focused on the problem in what obstacles might appear when Rancangan Undang-Undang PTEBT (PTEBT Constitution Bill) constituted which could reduce its effectiveness to protect Indonesian PTEBT as well as effort of solution that must be done by government to overcome those problems. This research was done by juridical sociological research method. This research has concluded that government planning to give protection through RUU Perlindungan dan Pemanfaatan Kekayaan Intelectual PTEBT (PTEBT Constitution Bill of Intellectual Wealth Protectionand Utilization). Intellectual PTEBT could not prevent the loss of Indonesian PTEBT. Besides, the maintenance and preservation of PTEBT must be done comprehensively that included the protection effort of Intellectual Property Rights (IPR) and non-IPR, law effort, and non-law.Key words : Traditional knowledge, traditional cultural expression, intellectual property rights

Abstract

The purpose of this article is to discuss the authority of the notary in making a certificate of inheritance and legal force for the certificate of inheritance for Indonesian citizens after the enactment of Law Number 24 of 2013 concerning Population Administration. The study uses a normative juridical method with a legislative approach and analytical approach. The legislative approach is used to analyze problems caused by inconsistencies in norms of the relevant laws and regulations in making a certificate of inheritance. The analytical approach is used to analyze the meaning contained in the terms used in legislation regarding the drafting of a certificate of inherit- ance conceptually. Notaries have strong authority in making certificate of inheritance for Indonesian citizens without discriminating between population groups. The certificate of inheritance made by a Notary has perfect legal force.

Abstract

Kewajiban pendaftaran penyelenggara sistem elektronik bagi  seluruh pelaku usaha e-commerce di indonesia menjadi salah satu program pemerintah dalam Peta Jalan Sistem Perdagangan Nasional Berbasis Elektronik (Road Map E-commerce) Tahun 2017-2019. Oleh karena itu, Tujuan penulisan ini untuk menguraikan pentingnya pendaftaran penyelenggara sistem Elektronik bagi pelaku usaha e-commerce di Indonesia. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan, pendekatan konsep dan pendekatan perbandingan. Hasil dari penelitian ini adalah pentingnya pendaftaran penyelenggara sistem elektronik bagi pelaku usaha e-commerce ialah memudahkan konsumen dalam mengidentifikasi pelaku usaha, serta dapat membantu pemerintah dalam program pengenaan pajak bagi pelaku usaha e-commerec.

Abstract

This paper is motivated by the inclusion of problems regarding the Leniency Program in the RUU tentang Larangan Praktek Monopoli dan Persaingan Usaha yang Tidak Sehat. The main cartel characteristic is the high level of confidentiality. Closed information for outsiders, and communication made secretly. Based on fact, KPPU is having trouble to obtain direct evidence. Therefore, to overcome this matter, during this KPPU Decision in cartel case, KPPU uses indirect evidence some of the decisions are canceled District Court and / or Supreme Court, on the one hand there are also strengthened by District Court and / or Supreme Court. Brazil is a country in Latin America that has a successful Leniency Program. Abstract

This article is reviews the application of foreign law by Indonesian courts as governed by the Indonesian Private International Law (PIL). The review is based on Acts and regulations related to PIL, case-laws, and text-books on PIL. The result demonstrates that Indonesian judges often do not implement the principle of iura novit curia in the application of foreign law; ignore foreign elements in their cases; and keep applying Indonesian law even though the rules of Indonesian PIL lead to the foreign law. Therefore, the Bill of Indonesian PIL shall be passed and enacted soon so that there are no more excuses by Indonesian courts not to apply foreign law. Indonesian courts including the Supreme Court, should have a special unit within their system that can provide judges with information on and translation of foreign law. In addition, it is necessary to establish international cooperation regarding exchange of information on foreign law between Indonesia’s Supreme Court and other countries’ Supreme Courts.

Abstract

This research explores the absence of the peoples of customary law in returning Lombok treasures before, during, and after repatriation, while international law and law in Indonesia recognise and respect the right to self-determination and participation of the people of customary law in a cultural sector. This article employed a normative-legal method supported by conceptual and case approaches. A descriptive-prescriptive method was employed, and data were analysed using content analysis. The results show that the government faces the challenge of determining official representatives of tribal peoples. Another challenge came from inadequate infrastructure and budget. The absence of the tribal peoples has led to the failure of achieving the reconciliation of unfair history, blocked access to helping with the research on the origin of the objects of cultural heritage, reinforced the content of agreements and cooperation of repatriation, and reintegrated the missing objects into their cultural context. This gap can be solved with two strategies reinforcing the role and participation of the tribal peoples in the repatriation process, namely by setting up the legal framework for the repatriation of cultural heritage objects and strengthening the involvement and legal standing of the tribal peoples. Through the study of Lombok treasures, this research contributes a valuable lesson and awareness, indicating that the State should recognise the right to participation of the peoples of customary law in an attempt to repatriate other objects of cultural heritage in the time to come.

Abstract

This study aimed to analyze the position of Law Number 24 of 2009 concerning the Flag, Language, State Emblem and National Anthem and Presidential Regulation Number 63 of 2019 concerning the Use of Indonesian Language and the legal consequences of agreements that were not made in Indonesian. The research approach used in this study was a statutory approach and a conceptual approach. Article 31 of the Language Law and Article 26 of Presidential Regulation Number 63 of 2019 required the use of the Indonesian language in every agreement making and were legally compelled. The obligation to use the Indonesian language in every agreement should be carried out. The legal consequences of agreements not made using the Indonesian language were regulated in Law Number 30 of 2004 concerning Notary Positions, which could be resolved on lex specialist derogat lex generalis. The agreement that remained binding has evidentiary power as a private agreement.

Abstract

Merek berperan vital dalam perdagangan modern, tetapi di Indonesia terdapat konflik norma dalam UU No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis antara Pasal 74 Ayat (1) dengan Pasal 35 Ayat (1), bagaimana mungkin merek terdaftar dapat dihapuskan meskipun masih dalam masa perlindungan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan teori serta bahan hukum primer, sekunder, dan tersier yang dianalisis secara deskriptif. Penelitian ini bertujuan menganalisis latar belakang penghapusan merek terdaftar yang tidak digunakan melalui pendekatan teori kesejahteraan sehingga diperoleh pengaturan yang tepat dan terwujud harmonisasi dengan ketentuan yang berkonflik. Hasil penelitian menunjukkan bahwa merek terdaftar yang tidak aktif harus dihapuskan karena berpotensi menyebabkan kerugian bagi berbagai pihak, khususnya dalam jangka panjang untuk perekonomian negara. Bahwa ketidakpastian hukum akibat konflik norma tersebut juga berdampak bagi pemilik merek karena berisiko kehilangan hak atas merek yang tidak aktif digunakan meskipun atas alasan ketidakaktifan yang sah. Oleh karena itu, perlu dilakukan upaya pernyataan penggunaan merek terdaftar oleh Pemilik Merek yang difasilitasi oleh DJKI sebelum jangka waktu 10 (sepuluh) tahun sehingga terdapat harmonisasi di antara ketentuan yang berkonflik. Implementasi solusi ini diharapkan dapat memberikan kepastian hukum, mendorong penggunaan merek secara aktif, dan mendukung pertumbuhan ekonomi yang berkelanjutan.

Abstract

Notaries have the authority to make authentic deeds and are obliged to provide legal counseling related to deed making. However, there are notaries who provide legal counseling unethically, providing shortcuts without adequate consideration, which can lead to disputes and involve notaries in cases of Sale and Purchase Deeds Containing Nominee Elements. This is contrary to the Basic Agrarian Law (UUPA) and the Notary Position Law (UUJN), which prohibit foreign nationals from owning land titles in Indonesia and require notaries to act honestly and safeguard the interests of all relevant parties. Such actions are considered to violate the law and ethics of the notary profession. The method used is normative juridical research, to identify problems related to the Responsibility of Notaries for Making Statement Deeds Related to Sale and Purchase Deeds Containing Nominee Elements and will be analyzed based on legislation etc. The brief conclusion obtained from the results of this research is that Law Number 2 of 2014 concerning the Position of Notary stipulates that notaries who violate the rules will be subject to administrative sanctions, such as written warnings, temporary dismissal, honorable dismissal, and dishonorable dismissal. In addition, in civil law, notaries who cause losses to other parties due to violations may be subject to sanctions in the form of reimbursement of costs, compensation, and interest according to Article 84 of the Notary Position Law. These violations can cause the deed made by the notary to be degraded, only have evidentiary power under the hand, or be null and void.
