Abstract

This research aims to examine more deeply the authority of local governments in conducting parallel diplomacy. By using a descriptive qualitative approach. The purpose of this research is to find out that Liverpool and Surabaya's cooperation in the creative industry has resulted in useful projects. Educational cooperation, urban cooperation, and port management development are some of the activities that have been implemented in the sister city agreement. The results showed that the application of pacta sunt servanda in the MOU is going well, because it has experienced many significant developments such as developments in the MSME business and the opportunity to introduce Surabaya products to the city of Liverpool. Able to encourage other local governments to carry out international agreements to build and develop a region. This cooperation is very important as an alternative to increasing income and supporting technological backwardness in the region.Keywords: Sister City, Cooperation, Pacta Sunt Servanda, International Agreement.

Abstract

Asset Takeover (AYDA) constitutes a non-performing loan resolution mechanism recognized in banking practice, including in Rural Credit Banks (BPR). Although normatively permitted, its implementation may raise legal concerns, particularly when collateral is taken over without the debtor’s consent and without proper execution of security rights as regulated by law. This study aims to analyze debtor legal protection against unilateral collateral takeover by a BPR, based on Jember District Court Decision Number 128/Pdt.Bth/2023/PN Jmr, and to examine the application of the principles of legal certainty and good faith in the AYDA mechanism. This research employs normative legal methods using statutory and case approaches. The results of the study show that the legal protection for debtors for collateral taken over by BPR without the debtor's consent is based on the Jember District Court Decision Number 128/Pdt.Bth/2023/PN Jmr and analyzes the application of the principle of legal certainty and the principle of good faith in the AYDA mechanism, especially in the obligation of creditors who act honestly and fairly towards the debtor during the collateral takeover process. In addition,, Such practice also fails to reflect the principle of good faith as mandated under Article 1338 paragraph (3) of the Civil Code. The court decision affirms that creditors’ preferential rights are not absolute and must be exercised in accordance with statutory provisions and justice principles. Therefore, AYDA implementation must ensure transparency, proportionality, and adherence to legal certainty and good faith.

Abstract

Sertifikat merupakan bukti kuat atas hak atas tanah yang memberikan kepastian hukum bagi pemegangnya. Namun, dalam praktiknya, sertifikat sering diterbitkan dengan mengandung cacat administratif, sehingga menimbulkan sengketa agraria. Penelitian ini bertujuan untuk menentukan implementasi proses pendaftaran tanah berdasarkan ketentuan hukum dan bagaimana pertimbangan hukum Hakim Pengadilan Administrasi Negara Surabaya dalam memutuskan Perkara Nomor 81/G/2023/PTUN.SBY. Metode penelitian yang digunakan adalah metode yuridis normatif dengan teknik pengumpulan data primer, sekunder, dan tersier. Penelitian ini menunjukkan bahwa Badan Pertanahan Nasional diharapkan dapat memeriksa dengan cermat dan teliti kegiatan pendaftaran tanah untuk menghindari cacat administratif. Serta penerbitan Sertifikat Hak Milik tidak sah secara hukum karena mengandung cacat hukum akibat kelalaian dalam melibatkan semua ahli waris yang berhak dalam proses pendaftaran tanah sistematis yang lengkap.
