Abstract

Penelitian ini mengeksplorasi respon istri dari saudara laki-laki ayah terhadap tradisi baiyua dalam baiyo di Muara Kandis Punggasan serta meninjau tradisi ini dari perspektif ‘‘Urf. Baiyo adalah sebuah kegiatan adat yang melibatkan anggota keluarga besar, terutama kaum laki-laki atau mamak, yang diharuskan memberikan sumbangan wajib dalam bentuk materi. Baiyua adalah sumbangan wajib yang diberikan oleh kaum laki-laki atau mamak kepada keluarga besar. Dalam tradisi baiyo, ada sumbangan wajib yang disebut baiyua. Pelaksanaan baiyua sering kali menjadi masalah atau problem bagi istri dari saudara laki-laki ayah karena mereka merasa harus mengeluarkan biaya yang cukup besar. Artikel ini bertujuan untuk mengeksplorasi pelaksanaan baiyua dalam baiyo pada tradisi babako di Muara Kandis, bagaimana respon istri dari saudara laki-laki ayah terhadap baiyua dalam baiyo pada tradisi di Muara Kandis. Tinjauan‘‘Urf menunjukkan bahwa meskipun tradisi ini memiliki nilai sosial, perlu ada penyesuaian agar tidak memberatkan satu pihak secara berlebihan. Hasil penelitian ini menggarisbawahi pentingnya pendekatan yang lebih berkeadilan dalam mempertahankan tradisi budaya, agar dapat diterima dan dijalankan dengan baik oleh seluruh anggota komunitas.

Abstract

The case of persecution of two women in Pasir Putih Kambang, Pesisir Selatan Regency, West Sumatra, reflects a series of incidents that show weaknesses in law enforcement regarding sexual violence and gender discrimination. This incident involved physical and psychological attacks on two cafe patrons by around 300 people for no apparent reason, resulting in trauma and damage to the victims. The authorities' handling of this case highlights the challenges in protecting victims and delivering justice. This research uses a qualitative approach to gain an in-depth understanding of the chronology of the incident, the perception of the relevant community, and the psychological impact of the victims. The case study method was used to analyze this case as a representation of broader problems in the implementation of laws related to sexual violence. The research location in Pasir Putih Kambang was chosen because the incident was interesting for further research, especially related to law enforcement and protection of victims. The research subjects are local communities and related parties who can provide insight into this problem. The aim of this research is to understand the phenomenon of persecution and sexual violence in the context of this case, as well as identifying factors that influence law enforcement and protection of victims. It is hoped that this research can provide more effective policy recommendations in preventing and handling similar cases in the future, in order to create a safer and fairer environment for all individuals.

Abstract

The childfree phenomenon is becoming an increasingly discussed topic in the modern era, including in Indonesia. In a society that culturally and religiously considers children to be a blessing and the main purpose of marriage, the childfree choice raises controversy and debate, especially when examined from the perspective of Islamic family law. This study aims to analyze how the childfree phenomenon is viewed from the perspective of Islamic law and to what extent this decision impacts family resilience. The study is motivated by the increasing number of couples choosing not to have children for reasons such as career, personal freedom, or concerns about social and environmental conditions. The research method used is a qualitative approach with literature review and normative analysis of verses from the Quran, hadith, and opinions of scholars regarding the command to have children and the purpose of marriage in Islam. Additionally, the researcher also uses a sociological approach by referring to theories of family resilience to assess the practical impact of childfree within the structure of Muslim families. Data was obtained from scientific literature, Islamic documents, and in-depth interviews with several Muslim couples who practice the childfree principle. The main findings of this study indicate that although Islam does not explicitly prohibit childfree, there is a strong encouragement in Islamic teachings to have children as a form of continuing the family line, strengthening family bonds, and fulfilling the maqashid al-syari'ah.
