Abstract

This research aims to study and critically edit the manuscript I‘lam al-Nashr fī Bayān Aḥkām Qunūt al-Fajr by Al-Ḥabīb Sālim bin Jindan (d. 1969 CE) and to introduce him as a prominent scholar in hadith and history from 20th-century Indonesia. The research methodology includes a comparative analysis of two manuscript copies of this book obtained from the Al-Fakhriyah Library. The study documents the differences between the two manuscripts, conducts takhrij (critical analysis) of Qur'anic verses and hadiths, and provides explanations for uncommon words and terms. Additionally, this study employs a descriptive approach by gathering relevant references from various libraries to validate the information contained in this book. The findings reveal that the critical edition of I‘lam al-Nashr fī Bayān Aḥkām Qunūt al-Fajr has been completed, establishing the authenticity of the book's title and its attribution to Al-Ḥabīb Sālim bin Jindan. This book was composed as a rebuttal to the work of Shaykh Aḥmad Ḥasan al-Hindī, who denied the Sunnah of performing Qunūt during the Fajr prayer. In his book, Al-Ḥabīb Sālim addresses these objections with strong evidence, robust arguments, and a detailed and scholarly writing style.

Abstract

This article aims to find out the age of readiness to marry in early marriage in the review of Islamic law and Indonesian Positive Law against early marriage and legal protection of children's rights in early marriage. The problem is focused on how the readiness age of marriage in early marriage based on Islamic law and positive law, how legal protection of children's rights in early marriage. The theoretical references used are the theory of legal protection and the theory of benefit in Islamic law. Data were collected through literature study and analyzed qualitatively. This study concludes that the readiness of marriage age in Islamic Law can be carried out by prospective brides who have not or have reached puberty if they have fulfilled the conditions and pillars of marriage by paying attention to the benefits. Based on the Compilation of Islamic Law, the minimum age of marriage for men is 19 years and for women is 16 years. Based on Positive Law Marriage Law No. 16 of 2019 in Article 7 Paragraph (1) marriage is permitted if the man and woman reach the age of 19 years. If in certain circumstances married under the age of 19 years can apply for Dispensation to the Court with urgent reasons and supporting evidence. In early marriage, legal protection of children's rights includes age limits, marriage dispensation and protection of children's rights including protection of education and awareness, supervision and protection from violence, physical and mental readiness, agreement and consent in early marriage. With this protection, the rights of children in early marriage can be protected.

Abstract

Radical groups were known to deconstruct the meaning of hadith, especially those related to the themes of the caliphate, jihad, hijrah, faith, and the end of time. They put aside the context of the background of the hadith so that it only clumped up as a text without having a fundamental historical basis. The pattern of understanding applied was also contrary to the principal rules of hadith studies which were well-known among scholars and hadith reviewers. The four radical groups examined in this study were the Ikhwanul Muslimin (IM), Hizb al-Tahrir (HT), Al-Qaeda, and the Islamic State of Iraq and Syria (ISIS). Despite having different characteristics of thought and movement, the four radical-terrorist groups had similarities in terms of exploiting the meaning and function of hadith to legitimize their acts of terror. The findings in this study confirmed the views of scholars who argued that understanding of hadith could be reduced by the interests and problems of power politics that were increasingly complex from time to time.

Abstract

This paper specifically aims to discuss issues surrounding asbāb al-wurūd. Asbāb al-wurūd refers to the reasons or historical contexts that underlie the emergence of a hadith. Understanding asbāb al-wurūd is essential for accurately interpreting hadiths, as historical context can influence the meaning and application of the hadith. The function and relevance of asbāb al-wurūd in hadith studies are to provide a more comprehensive understanding of hadiths, help resolve contradictions between hadiths, and ensure that the interpretation of hadiths aligns with their original context. This research will explore the definition, function, and relevance of asbāb al-wurūd in hadith studies, as well as the importance of this understanding for the interpretation and application of Islamic law.
