Abstract

This study analyzes the impact of implementing a policy of delegating mineral and coal mining business permits in North Halmahera Regency, aimed at improving the efficiency of the permitting process at the local level. The research focuses on how five key factors in George C. Edward III's Policy Implementation Model communication, resources, disposition of implementers, bureaucratic structure, and external environmental factors influence the success of implementing this policy in the region. The results show that effective communication between the central and local governments is crucial to aligning policy processes. However, disrupted or unstructured communication often leads to miscommunication that hinders policy implementation in the field. This study highlights the need for improvements in communication, strengthening of resources, a more efficient bureaucratic structure, and increased community involvement to achieve the desired goals and fairness in the implementation of mining permit policies. These conclusions provide guidance for policymakers to design a more inclusive and responsive framework for local conditions, enabling sustainable mining in North Halmahera.

Abstract

Penelitian ini bertujuan mengkaji dinamika kebijakan izin usaha pertambangan mineral dan batubara di Indonesia melalui telaah perkembangan peraturan perundang-undangan sejak pasca kemerdekaan hingga pasca reformasi. Metode penelitian menggunakan studi literatur dengan pendekatan yuridis-normatif yang dipadukan dengan perspektif kebijakan publik. Hasil penelitian menunjukkan bahwa kebijakan izin usaha pertambangan mengalami perubahan signifikan, dimulai dari Undang-Undang No. 11 Tahun 1967 yang berorientasi pada penanaman modal dan pemberian insentif investasi, kemudian bergeser melalui Undang-Undang Nomor 4 Tahun 2009 dengan penghapusan sistem kontrak karya dan penerapan sistem izin usaha pertambangan serta penguatan aspek perlindungan lingkungan melalui kewajiban izin lingkungan. Selanjutnya, Undang-Undang No. 3 Tahun 2020 menandai resentralisasi kewenangan perizinan ke pemerintah pusat guna meningkatkan efektivitas dan percepatan investasi, namun memunculkan persoalan administratif dan lemahnya pengawasan di daerah. Kondisi ini mendorong diterbitkannya Peraturan Presiden No. 55 Tahun 2022 yang mendelegasikan sebagian kewenangan perizinan kepada pemerintah daerah provinsi melalui mekanisme dekonentrasi, sementara pemerintah kabupaten/kota tidak lagi memiliki kewenangan perizinan maupun pengawasan.

Abstract

This study examines agrarian conflict in Kedamean Village related to the sale of state-owned land by the village government, which has triggered a peasant movement aimed at maintaining access to agricultural land. The state-owned land plays an important role as the economic foundation of a community that depends on the agricultural sector; however, it is threatened by a planned housing development project by PT. Prima Damai Permai, despite the unclear legal status of land ownership. The objective of this study is to analyze the peasant movement organized under AMPTN in defending state-owned land and to identify the strategies employed in responding to village government policies. This research uses a qualitative method with a case study approach, employing observation, interviews, and documentation techniques. The findings show that AMPTN represents a collective peasant movement focused on rejecting the allegedly non-transparent process of selling state-owned land and pushing for legal action against parties involved in the village administration. The movement has also succeeded in building support networks with non-governmental organizations, mass media, and regional legislative institutions such as the Gresik Regency DPRD, as part of its strategy to strengthen bargaining power in the agrarian conflict. In conclusion, the AMPTN movement reflects a form of social resistance by rural communities in maintaining access to agrarian resources that are vital for their livelihood sustainability. Limited financial resources have influenced the movement’s strategy, leading mobilization to rely more on social solidarity and external network support rather than formal legal assistance such as lawyers.
