Abstract

Article 21 paragraph (1) letters b and c and Article 21 paragraph (3) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications provide protection and regulations for well-known brands in Indonesia. According to Article 21 paragraph (1) letter b of the MIG Law, if a brand is conceptually or completely identical to a well-known brand that belongs to another party for products and/or the like, DJHKI must reject the application. According to the explanation of Article 21 paragraph (1) letter b of Law Number 20 of 2016 concerning Geographical Indications, a brand's popularity must be assessed by taking into account the public's general awareness of the brand in the relevant industry as well as its reputation as a well-known brand that has been earned through extensive marketing campaigns, owner investments in multiple countries, and documentation of the brand's registration in multiple countries. If the aforementioned factors are deemed insufficient, the Commercial Court may mandate that an impartial organization carry out a study in order to reach a determination on the level of popularity of the brand that serves as the foundation for the denial. Furthermore, as long as they fulfill specific standards that will be further outlined by government regulation, commodities and/or services that are not of the same kind may also be covered by Article 21 paragraph (1) letter c. Furthermore, paragraph (3) of Article 21 clarifies that a brand cannot be registered based on an application filed by a party acting dishonestly.

Abstract

Perjanjian menimbulkan perikatan atau menciptakan ikatan hukum yang melahirkan adanya pemenuhan tanggung jawab dan hak masing-masing pihak dalam perjanjian. Peristiwa ingkar janji perkawinan sering kali terjadi. Apabila salah satu pihak membatalkan perkawinan secara sepihak tanpa adanya kesepakatan dengan pihak lainnya, maka pihak yang merasa dirugikan dapat mengajukan gugatan ke pengadilan. Peristiwa ingkar janji untuk menikahi pasangan kerap terjadi di indonesia hingga dapat digolongkan dalam perbuatan yang melawan hukum, karena ada unsur-unsur yang dapat digolongkan dalam perbuatan melawan hukum terkandung dalam perjanjian tersebut salah satu pihak melepaskan kewajiban yang seharusnya ia laksanakan kepada pihak lainnya yang merasakan kerugian baik secara materil maupun immateril akan ingkar janji menikahi. Perbuatan melawan hukum adalah perbuatan orang yang melanggar aturan hukum berupa hukum tertulis ataupun hukum tidak tertulis berupa tindakan yang tidak sesuai dengan kepatutan ataupun berlawanan secara nyata dengan norma yang berlaku di masyarakat. Perlindungan hukum yang didapat korban yakni kompensasi nominal berupa ganti rugi yang dibayarkan kepada korban dalam bentuk sejumlah nilai uang sesuai dengan keadilan yang didasarkan pada pertimbangan akibat dari suatu perbuatan melanggar hukum serta kompensasi atau ganti rugi immateriil merupakan ganti rugi yang diberikan pada korban yang didasarkan pada jumlah kerugian yang dialami akibat perbuatan yang melanggar hukum berupa besaran uang yang tidak dapat dikalkulasi secara materil, menurut pertimbangan hakim.

Abstract

This paper aims to be able to find out an overview of the transfer of book copyright to heirs under civil law. IPR (intellectual property rights) is a right that arises because of the intellectual ability possessed by a human being in various fields, which can produce all kinds of things, starting from the process to producing a product or goods that have useful value. The result can be in the form of works in the fields of science, art, literature and also technology as a form of human intellectual creativity expressed through thoughts and ideas, the concept of intellectual property rights will be beneficial to all humans. The birth of book copyright began from an idea that arose from the idea of extorting the results of creativity and technology made by humans that utilize their intellectual intelligence and emotional abilities. Copyright can undergo a partial or total transfer of rights in the event of inheritance, will, waqf, grant, written agreement, or for other reasons as stipulated in the provisions of laws and regulations. The provisions of the regulation in terms of inheritance in the Civil Code consist of 2 ways, namely: the inheritance system "ab intestato" and the inheritance system according to the will "testament". The legal basis used in the implementation of inheritance in book copyright based on inheritance is inheritance law based on the Civil Code which regulates the position of a person's property after he or she dies by transferring the property to the rightful owner. Therefore, the transfer of book copyright that occurs as a result of this inheritance is able to transfer the whole related to exclusive rights where these exclusive rights consist of moral rights and economic rights of the creator.
