Abstract

This research reviews two issues: Firstly, it describes the imple-mentation of the receivable write-off of State-Owned Bank (BUMN Banks) in Indonesia, and secondly, it describes the relevance of the independence principles of directors and Good Corporate Governance to the implementation of receivables write-off of state-owned banks in Indonesia. This research uses normative and empirical juridical approaches. The normative approach includes research on the independence principles of directors and Good Corporate Governance to the implementation of receivables write-off of the state-owned bank, while empirical research is conducted to determine the process of claim abolishment by state-owned banks in Indonesia. The outcomes of the research indicate that the unresolved legal problem related to the state financial position in the state-owned banks due to conflict of public and private law norms causes the directors of state-owned banks have not dared to do the process of claim abolishment. Therefore, consi-dering that the principle of autonomy of directors and good corporate governance is enforced properly, no one is concerned about the risk of corporate policies related to the process of claim abolishment from a state-owned bank because, in its very essence, it is a Business Judgment Rule in the banking business practice.

Abstract

Peraturan Presiden Nomor 17 Tahun 2019 tentang Pengadaan Barang dan Jasa Pemerintah untuk Percepatan Pembangunan Kesejahteraan di Papua Barat bertujuan untuk meningkatkan partisipasi pelaku usaha lokal, khususnya Orang Asli Papua (OAP), dalam pengadaan barang dan jasa pemerintah. Meskipun peraturan ini memberikan peluang besar untuk mempercepat pembangunan dan kesejahteraan, implementasinya masih menghadapi sejumlah tantangan, seperti keterbatasan kapasitas sumber daya manusia (SDM), infrastruktur yang belum memadai, serta birokrasi yang rumit. Artikel ini mengidentifikasi solusi yang diperlukan untuk meningkatkan efektivitas pelaksanaan Perpres tersebut, termasuk peningkatan kapasitas SDM, perbaikan infrastruktur pendukung, koordinasi yang lebih baik antara pemerintah pusat dan daerah, serta penyederhanaan prosedur pengadaan. Diharapkan, dengan langkah-langkah ini, pelaksanaan Perpres Nomor 17 Tahun 2019 dapat lebih optimal dalam mendorong pembangunan yang inklusif dan meningkatkan kesejahteraan masyarakat Papua Barat.

Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan hak-hak pengguna jasa apabila terjadi delay angkutan udara di Bandara Rendani sangat penting sehingga perlu mengetahui implementasi pengawasan Otoritas Bandara mengenai Delay angkutan udara. Dalam penelitian ini analisis data yang digunakan adalah kualitatif deskriptif yakni teknik pengolahan dan analisis data kualitatif yang pengolahan dan analisis meliputi: reduksi data, penyederhanaan dan penyajian data, verifikasi hasil penelitian dan kesimpulan. Hasil penelitian menunjukan bahwa bentuk perlindungan hukum kepada penumpang akibat delay management oleh maskapai adalah dengan memberikan kompensasi sesuai dengan kategori keterlambatan, mulai dari kategori keterlambatan 1 dengan kompensasi berupa minuman ringan sampai dengan keterlambatan kategori 6 dengan kompensasi wajib mengalihkan ke penerbangan berikutnya atau mengembalikan seluruh biaya tiket. Pengawasan yang dilakukan oleh Kantor Otoritas Bandar Udara IX terkait terhadap delay management hanya sebatas menerima pelaporan keterlambatan oleh maskapai, untuk melihat apakah penanganan sudah sesuai SOP Maskapai dan Peraturan Menteri Perhubungan Nomor 89 Tahun 2015.

Abstract

Advances in information technology have driven a shift from conventional digital-based transactions to electronic agreements (e-contracts). This phenomenon has created new dynamics in contract law practices, particularly in the realm of platform-based e-commerce platforms such as Tokopedia and Shopee. This study aims to analyze the validity and legal risks of e-contracts based on the provisions of the Civil Code and Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE), and to assess the effectiveness of legal protection for consumers and businesses. The method used is normative legal research with a regulatory, conceptual, and case-based approach. Data were qualitatively reviewed through literature and legal documents, and systematically analyzed based on classical contract theory and the principle of contractual justice. The results indicate that, from a formal legal perspective, e-contracts have binding force and guarantee compliance with the requirements for a valid agreement under Article 1320 of the Civil Code and the principles of the ITE Law. However, in practice, various legal issues are encountered, such as breach of contract, exclusion clauses, unequal positions of parties, and difficulties in providing evidence, which are detrimental to consumers. Digital platforms tend to position themselves as neutral parties, even though they play a crucial role in transaction mechanisms. Therefore, stricter regulations regarding platform responsibility, transparency of clauses, and strengthening of the settlement system through Online Dispute Resolution (ODR) mechanisms are needed. This study recommends improving digital legal literacy, reformulating electronic contract regulations, and equitable law enforcement as strategies for balanced legal protection in the digital economy era.

Abstract

The financial relationship between the central and local governments is a mandate of the law. In the implementation of regional autonomy, regional financial management is fully given to local governments. So that local governments are stakeholders in the regional financial legal system. This study aims to determine the rights and obligations of stakeholders in the regional financial legal system. The method in this research is a literature review method with a qualitative approach. So that data is obtained through the results of various sources such as scientific books, research reports, scientific essays, theses and dissertations, regulations, decrees, yearbooks, encyclopedias, and other printed and electronic written sources. The results of the study found that the rights of stakeholders in the regional financial legal system are to plan and compile regional budgets, manage regional finances to meet community needs, and establish regional financial policies. While their obligations are to comply with laws and regulations related to regional financial management, submit financial reports in a transparent and accountable manner, and manage regional finances efficiently and effectively.
