Abstract

The crime of culpa in driving is a violation of general criminal law because of negligence from the driver side, where accidents that result in fatalities might have occurred. Drivers who breach the traffic law and allow the death of a person by their negligence may be prosecuted based on the prevailing laws. This research is specifically conducted as a case study of traffic law violation in Gorontalo Regency due to driver negligence. That is all because of negligence due to a lack of awareness of safety on the road. From this very issue, the author conducted research on the application of culpa in driving, based on a case study of traffic violations in Gorontalo Regency which led to a prosecution in conformity with legal policies in force. Methods The method used in this research is a literature review by referring to various literature sources, either in the form of books, journals, papers, news, and others. The results of this study indicate that accidents occur due to a lack of awareness from the driver, which leads to negligence, or culpa in Latin, causing death. This research also underlines the importance of driver responsibility while driving. The fatal incidents teach a lesson of traffic safety and implementation of the law as per the legal policies against the traffic violators, which works like education for the general public in order to drive carefully to attain traffic safety.

Abstract

Human trafficking is one of the most complex forms of human rights violations, transcending national borders, with Southeast Asia being one of the most vulnerable regions to this crime. This study aims to examine the international legal framework governing human trafficking and to explore the challenges faced by Southeast Asian countries in its implementation. Using a qualitative research method with a normative juridical approach, this study analyzes international legal instruments such as the Palermo Protocol and the United Nations Convention against Transnational Organized Crime, as well as regional and national legal documents. Data collection techniques include case law analysis and legal literature review to understand the practical application of these laws. The findings indicate that although most countries in the region have ratified various international instruments, implementation at the national level remains hindered by weak law enforcement, lack of regulatory harmonization, and suboptimal regional coordination. This study recommends strengthening institutional capacity, updating national legislation in accordance with international standards, and enhancing inter-state cooperation to combat human trafficking more effectively.

Abstract

Jurnal ini membahas sengketa tanah antara Yayasan Vihara Amurva Bhumi dan PT Danataru Jaya terkait akses jalan menuju tempat ibadah Vihara. PT Danataru Jaya mengklaim bahwa akses jalan tersebut merupakan bagian dari tanah yang tercantum dalam HGB No. 298/Desa Karet Semanggi yang diterbitkan BPN Jakarta Selatan pada tahun 1998. Pengadilan Negeri Jakarta Selatan mengabulkan gugatan PT Danataru Jaya, dan putusan tersebut kemudian dikuatkan oleh Pengadilan Tinggi DKI Jakarta. Putusan ini dinilai merugikan Yayasan karena berpotensi menghambat akses umat dalam menjalankan kegiatan keagamaan. Atas dasar itu, Yayasan mengajukan kasasi ke Mahkamah Agung. Pada tingkat kasasi, Mahkamah Agung mengabulkan permohonan Yayasan, membatalkan putusan sebelumnya dari PN dan PT, serta menegaskan bahwa akses jalan menuju Vihara memiliki fungsi penting sebagai penunjang aktivitas keagamaan sehingga patut mendapat perlindungan hukum.
