Abstract

The high interest of the Indonesian people in skincare products and the diversity of products and innovations offered by various local and international brands is one of the triggers for the emergence of problems, namely skincare products that are sold without a distribution permit from the Food and Drug Supervisory Agency (BPOM). The purpose of this research is to analyze juridically and the actions taken by BPOM against the buying and selling of skincare products that do not have a BPOM license. The research method used is normative juridical with a statute approach that refers to a number of regulations such as Law No. 17 of 2023, BPOM Regulation No. 21 of 2022, and Law No. 8 of 1999. Skincare products without a BPOM license are considered unlawful and can be subject to criminal and administrative sanctions. BPOM has taken various actions such as surveillance operations, temporary production stoppages, recalls of hazardous products, revocation of distribution permits, and education to the public. The results of this study emphasize the importance of compliance with the rule of law to protect consumers and support the development of a safer and more responsible industry.

Abstract

Law Number 11 of 2020 concerning Job Creation which uses the omnibus law method has sparked widespread controversy, especially in the employment aspect. Significant changes to several previous legal provisions are considered to weaken the protection of workers' rights. The research method used is normative juridical with a statutory approach which refers to Law Number 11 of 2020 concerning Job Creation. This research analyzes this issue from a Critical Legal Studies perspective, which highlights law as a social construction influenced by the interests of economic and political elites. The research results show that the Job Creation Law is not completely neutral and objective. On the contrary, this law strengthens the dominance of employers' interests at the expense of workers' basic rights. This article emphasizes the need for revision of the Job Creation Law to create a balance between investment interests and protecting workers' rights. By involving the active participation of all stakeholders, more inclusive and socially just regulations can be realized.

Abstract

Di tengah pertumbuhan transaksi jual beli online, sistem pembayaran cash on delivery (COD) semakin populer karena dianggap praktis dan menguntungkan konsumen. Namun, praktik di lapangan menunjukkan adanya pembulatan harga secara sepihak oleh kurir J&T Express Drop Point Diwek di Desa Cukir, Kabupaten Jombang, yang memicu ketidakpuasan dan potensi kerugian bagi konsumen. Penelitian ini bertujuan untuk menganalisis praktik pembulatan harga dalam sistem COD dan meninjaunya dari perspektif hukum ekonomi syariah. Penelitian ini menggunakan pendekatan yuridis-empiris dengan metode kualitatif melalui observasi, wawancara, dokumentasi, dan studi kepustakaan. Hasil penelitian menunjukkan bahwa pembulatan harga terjadi karena keterbatasan uang pecahan serta alasan efisiensi waktu pengantaran, dan seringkali dilakukan tanpa pemberitahuan kepada konsumen. Dari sudut pandang hukum ekonomi syariah, praktik ini memenuhi prinsip kebebasan, kebolehan bertransaksi, dan kemudahan, tetapi melanggar prinsip ketuhanan, keadilan, dan amanah. Implikasinya, praktik pembulatan dapat dibenarkan apabila dilakukan secara transparan dan atas persetujuan konsumen, tetapi menjadi batil jika dilakukan sepihak
