Abstract

This study aims to analyze the regulation of the death penalty in Indonesia and its implications for human rights. The method used in this study is library research with a normative approach and legal documentation. Regulations regarding the death penalty in Indonesia are regulated in the Criminal Code (KUHP) and in other sectoral laws. Based on statistical data and studies by criminologists, the death penalty is considered ineffective in reducing crime rates, because it does not provide a significant deterrent effect. On the other hand, the existence of the death penalty is considered contrary to the principles of human rights, especially the right to life. The right to life is a fundamental right guaranteed in various human rights instruments, such as the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the American Convention on Human Rights, Law Number 39 of 1999 on Human Rights, and the Charter of Fundamental Rights of the European Union. At the national level, the right to life is also constitutionally guaranteed in Article 28I paragraph (1) of the 1945 Constitution. In the perspective of Islamic law, the death penalty (qishash) was known before the advent of Islam and underwent reforms in its application in accordance with the principles of justice and protection of the soul. Therefore, the discourse on the sustainability of the death penalty in Indonesia needs to consider a comprehensive juridical, ethical, and theological approach.

Abstract

The development of this modern era, many crimes happen outside human reason, the crime rate of criminal acts everyday seems to never run out, even crimes happen the more increase on society. In 2020 there was a criminal case of premeditated murder by a husband againts his wife which causes the victim to be disabled for life. In criminal law its regulated in article 339 and 340 of criminal code article about murder and prmeditated of murder. The author’s aim is to make this a form of understand the factors of occurance a criminal case of premeditated murder and how to prevent a criminal case of premeditated murder. and added again less of attention from relatives of both and socialization from neighbor so that’s making crimes of murder and prmeditated of murder this happen. factors of occurance a criminal case of premeditated murder is heartache factor, treason factor, economic factor, low level of education and social environment. Preventif, repressive, and currative is prevent a criminal case of premeditated murder. Abstrak: Perkembangan zaman yang sudah modern ini banyak tindak pidana terjadi diluar nalar manusia. Angka kriminalitas tindak pidana setiap harinya seakan tiada pernah habis. Bahkan hingga kini, pada tahun 2020 kemarin terjadi kasus tindak pidana pembunuhan berencana oleh suami terhadap istri yang menyebabkan seorang istri menjadi korban. Dalam hukum pidana diatur pada pasal 338-340 KUHP. Tujuan penulis membuat ini sebagai bentuk untuk memahami faktor-faktor penyebab terjadinya tindak pidana pembunuhan berencana dan upaya pencegahan pembunuhan berencana. Faktor dendam (sakit hati), faktor perselingkuhan, faktor ekonomi, faktor kekerasan, rendahnya tingkat pendiddikan dan lingkungan pergaulan merupakan faktor penyebab terjadinya pembunuhan berencana. Adapun upaya preventif, upaya refresif dan upaya kuratif adalah upaya untuk mencegah terjadinya tindak pidana pembunuhan berencana.

Abstract

This study aims to find out and analyze the implementation of the rights of suspects as a manifestation of the principle of presumption of innocence in the examination process at the investigation level and to find out the factors that hinder the investigator in the implementation and analyze the rights of suspects as a manifestation of the principle of presumption of innocence at the examination process at the investigation level. This study used the Empirical Law research method, with interviews with related samples/respondents. The source of this research data is to the investigators of the Makassar City Police and some of the rights of suspects as a manifestation of the principle of presumption of innocence in the examination process at the level of investigation of victims of abuse. The results of this study The factors that caused the suspect not to get his rights in the investigation process were the lack of communication between the investigator and the suspect regarding the rights of the suspect contained in the Criminal Procedure Code, in the investigation process the suspect refused to get legal assistance because he was afraid and unable to pay legal counsel even though it was known that there was a right to get legal assistance free of charge. Abstrak Penelitian ini bertujuan Untuk mengetahui dan menganalisis implementasi hak-hak tersangka sebagai perwujudan asas praduga tak bersalah dalam proses pemeriksaan ditingkat penyidikan dan Untuk mengetahui faktor-faktor yang menjadi hambatan penyidik dalam implementasi dan menganalisis hak-hak tersangka sebagai perwujudan asas praduga tak bersalah pada proses pemeriksaan ditingkat penyidikan.Penelitian ini menggunakan metode penelitian Hukum Empiris, dengan wawancara terhadap sampel/responden terkait. Adapun sumber data penelitian ini adalah kepada pihak penyidik Polrestabes Kota Makassar serta beberapa hak-hak tersangka seabagai perwujudan asas praduga tak bersalah dalam proses pemeriksaan ditingkat penyidikan korban penganiayaan. Hasil penelitian ini Faktor-faktor yang menyebabkan sehingga tersangka tidak mendapatkan haknya dalam proses penyidikan kurangnya komunikasi pihak penyidik dengan tersangka mengenai hak-hak tersangka yang terdapat di dalam KUHAP, pada proses penyidikan tersangka menolak untuk mendapatkan bantuan hukum karena takut dan tidak mampu untuk membayar penasehat hukum padahal diketahui bahwa ada hak mendapatkan bantuan hukum secara cuma-cuma.

Abstract

The aim of this research is to understand and analyze legal regulations relating to genocide as a violation of human rights in Indonesia, both in Article 7 a and Article 8 of Law No. 26 of 2000 concerning Human Rights Courts, the old Criminal Code Regarding Genocide and Article 598 in Law No. 1 of 2023 concerning the Criminal Code which relates to genocide regulations. This study uses a normative research type (normative law research) or doctrinal legal research, namely legal research that uses legal material sources or is library research, a study of legal materials. The results of this study indicate that, First, the legal regulations relating to genocide as a violation of human rights in Indonesia, both in Article 7a and Article 8, have a definition of the crime of genocide. However, this article has advantages and disadvantages in interpreting and determining the crime of genocide. Second, actions that fall into the category of genocide in the old Criminal Code are often categorized as general crimes such as premeditated murder, serious abuse, or crimes against humanity. And third, the perpetrators are often only charged with general articles with lighter penalties than if there were special articles for genocide. So this will make the crime of genocide potentially committed by a group of people and result in loss of life throughout Indonesia in the future. Finally, Law No. 1 of 2023 includes genocide crime regulations in Article 598 which specifically regulates the crime of genocide. The suggestions from this study indicate the need for national regulatory officials, especially Article 7a and Article 8 of the Law on Human Rights Courts and Article 598 concerning genocide, to explain more clearly the crime of genocide, both in terms of definition, categorization of the crime of genocide and protection of victims.

Abstract

This research aims to analyze the process of criminalizing children and actions against delinquent children at the Maros District Court, as well as the obstacles faced in its implementation. The research method used was qualitative with interview and documentation techniques at the Maros District Court and the Maros Class II State Detention Center. The research results reveal that the implementation of Law no. 11 of 2012 Juncto Law no. 3 of 1979 concerning the Juvenile Court in Maros Prison has considered the statements of witnesses and victims in the criminal sentencing process. Punishment is generally imposed on children who commit crimes, except serious crimes, by considering negotiations and alternative sanctions. This opinion is generally held by juvenile court judges and greatly influences decision making. As a country that is legally bound by the UN Convention on the Rights of the Child, Indonesia is obliged to protect children who are in conflict with the law. Law no. 11 of 2012 Juncto Law no. 3 of 1979 concerning Children's Courts is expected to be a control in law enforcement that protects children's rights.
