Abstract

Penelitian ini mencoba untuk menjelaskan pemikiran Jeremy Bentham tentang utilitarianisme sebagai sebuah paham filosofis dalam diskursus ilmu hukum (jurisprudence), serta melihat keterlibatannya terhadap perkembangan tradisi dominan dalam ilmu hukum (jurisprudence), yakni positivisme hukum (klasik). Penelitian ini menggunakan metode penelitian hukum doktrinal dengan pendekatan konseptual (teoritis). Bahan hukum akan diasalkan dari sumber-sumber normatif yang relevan dengan permasalahan yang dikaji dalam penelitian ini guna mengungkap pemikiran Jeremy Bentham. Sosok Bentham tumbuh dalam tradisi hukum Anglo-Saxon (common law), yang mana pada waktu itu tradisi empirisme cukup kuat berakar di Inggris. Melalui tradisi epistemik yang berkembang sewaktu itu, Bentham melakukan kritik radikal terhadap sistem hukum –common law– di Inggris yang dianggapnya cukup menyesatkan masyarakat Inggris. Bentham mencoba melakukan reformasi terhadap ilmu hukum (jurisprudence) dan sistem hukum –common law– Inggris yang didasarkan oleh paradigma hukum alam (natural law). Hasil penelitian ini menunjukkan bahwa berdasarkan prinsip utilitarianismenya Bentham berusaha memberikan fondasi yang kokoh terhadap pembentukan hukum yang adil dan dapat menjadi tolok ukur yang pasti bagi sistem hukum Inggris melalui hukum positif. Pemikiran Bentham pun sekaligus menandai kemunculan tradisi positivisme hukum sebagai tradisi dominan dalam ilmu hukum (jurisprudence) modern

Abstract

Regional head regulations as regional government implementers based on the principle of regional autonomy are posited in two aspects: statutory regulations and policy rules. This sometimes leads to forming regional head regulations in the name of beleid (kebijakan) without any normative foundations. Furthermore, the implications of these two positions are theoretically important in the discourse of administrative law [studies]. Based on this matter, this paper aims to examine the position of regional head regulations in its dual position and then decide its normative [re]position in the Indonesian legal system. For this reason, the research questions in this paper are: What is the normativity of regional head regulations among their position as statutory regulations or policy rules in the Indonesian legal system? The research method used in this paper is doctrinal legal research with a conceptual approach and a statutory approach. Based on the research results, this paper argues that regional head regulations are statutory regulations and no longer have a duality of position, especially as material policy rules. Therefore, this paper concludes that every creation of regional head regulations must be based on the provisions of attribution and delegation as well as being the object of juridical control in the form of judicial review and executive review.

Abstract

This study seeks to broaden the legal definition of corporations to encompass political parties as entities subject to criminal law. By expanding how we understand corporations in criminal contexts, the research explores whether political parties can be treated as corporate entities that bear criminal responsibility and face prosecution. The proposed criminal penalties for political parties would mirror those applied to corporations under the National Criminal Code, with one notable exception: the potential for dissolution. However, the authority to dissolve political parties remains solely with the Constitutional Court under the 1945 Constitution. The article addresses two primary questions: how political parties should be classified within criminal law frameworks, and what forms of criminal accountability and sentencing should apply to political parties under the new National Criminal Code.
