Abstract

Penelitian ini bertujuan untuk mengetahui apakah putusan Badan Arbitrase Nasional Indonesia (BANI) mengikat bagi Pemohon dan Termohon serta mengetahui Bagaimana seharusnya sistem Arbitrase di Indonesia untuk kedepannya. Metode yang digunakan dalam penelitian ini adalah mentode penelitian yuridis normatif yang bersifat kualitatif yaitu penelitian yang mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan serta norma-norma yang hidup dan berkembang dalam masyarakat yang berkaitan dengan kekuatan hukum putusan Badan Arbitrase Nasional Indonesia (BANI) dalam menyelesaikan sengketa yang dilakukan berdasarkan perjanjian. Dari penelitian ini dapat disimpulkan sebagai berikut: pertama bahwa putusan arbitrase dari Badan Arbitrase Nasional Indonesia (BANI) adalah bersifat “final” yakni sebagai putusan pertama dan terakhir, dan mempunyai kekuatan hukum tetap secara mengikat (binding) bagi para pihak dalam hal ini pemohon dan termohon. Hal ini sebagaimana disebutkan dalam pasal 60 UU Arbitrase dan APS. Kedua, bahwa lahirnya PERMA No. 3/2023 merupakan jawaban dari gambaran bagaimana putusan lembaga arbitrase kedepan. Banyak hal yang sebelumnya tidak jelas diatur dalam UU 30/1999 diberikan penjelasan oleh Perma 3/2023. Hal ini membuktikan arbitrase benar-benar memiliki keunggulan sesuai janji UU No. 30/1999. Berkaitan dengan Arbitrase online pada dasarnya tidak dilarang untuk dilakukan dalam hal menyelesaikan sengketa antara para pihak namun masih perlu dikembangkan kembali pengaturan serta sarana dan prasarananya. Peluang untuk diterapkannya arbitrase online di Indonesia dinilai cukup menjanjikan.

Abstract

The highest legal regulation guidelines in apartment investment are in law of the Republic of Indonesia Number 20, 2011 Concerning Apartments. Where it is stated that what is purchased by an apartment investor is not only 1 small unit of his house to live in. But it is also an obligation to buy jointly owned land where the apartment stands, building/areas of share owned. Facilities such as corridors, parking, prayer rooms, swimming pool, and also buying jointly owned object. Such as elevators, installation cables, generators and so on which are jointly owned objects. Legally for all such joint ownership, it is mandatory to form a legal entity association to receive the transfer of jointly owned assets whose members are the owners and residents of the apartment. The facts found in the authors’s research over the past 10 years, 99% of the transfer have not been carried out. So that there is a high-level game that is allowed where, the building assets that are still collaterized by the developer in banking, in the end, whether intentionally or not, there is bankruptcy, where the apartment assets that have been sold to the public with a notarial deed, will be considered invalid. And this happens even in the courts throughout Indonesia as if turning a blind eye to the value of the Notarial AJB being considered invalid by itself. All land assets under the name of the developer will be confiscated by the curator. On another occasion, developer companies that go public also use apartment assets or building and condotels above them are recorded as company assets that are used to increase the selling value of share. Then become asssets that are assessed to issue long-term debt bonds. What about OJK and the ministry of Finance and the Ministry of PUPR as supervisors? They also automatically turn a blind eye as if they do not know that the apartment is subject to joint ownership law. On the other hand, the lower level as implementing and supervising government officials, are flocking to commit collective violations. There is a power struggle between developer employees and owners in terms of management, where investors, the owners who occupy, are charged monthly IPL bills which are said to be for maintaining the area and common property. As well as markups on financial values related to businesses held in apartments for the running of residential life. In our research, we fount that lower-level government officials who were given too much authority had overlapping powers. Starting from being an implementing officer, concurrently supervising, and concurrently acting as a supervisor, in the end the authority was easily bought by developers, especially when an error occurs, then the individual will be more intensive in trying to cover up the error by issuing regulations, and approvals as if everything was in accordance with the rules even though it clearly conflicts with the higher laws of the Republic of Indonesia.

Abstract

Penipuan adalah salah satu perbuatan hukum pidana yang diatur pada Pasal 378 Kitab Undang-Undang Hukum Pidana. Wanprestasi dapat berubah menjadi tindak pidana penipuan apabila memenuhi unsur menggunakan tipu muslihat, rangkaian kebohongan, nama palsu, dan keadaan palsu dengan maksud menguntungkan diri sendiri. Metode penelitian yang digunakan adalah penelitian yuridis normatif. Hasil penelitian menunjukkan pelanggaran dalam suatu perjanjian berupa wanprestasi dapat menjadi suatu tindak pidana jika terdapat unsur kesengajaan dari salah satu pihak untuk tidak memenuhi prestasinya, selain itu wanprestasi dapat menjadi suatu tindak pidana apabila niat awal salah satu pihak dalam melakukan perjanjian yaitu untuk mendapatkan keuntungan untuk dirinya sendiri maupun untuk orang lain dengan cara melawan hukum, selanjutnya jika perjanjian tersebut dilakukan karena sudah ada niat, dan adanya usaha untuk memalsukan isi perjanjian maka perkara ingkar janji dapat masuk ke ranah pidana dengan dugaan penipuan, dalam kondisi seperti ini, aparat penegak hukum dituntut untuk jeli dalam membedakan apakah perbuatan tersebut masuk ranah hukum perdata atau hukum pidana. Untuk itu unsur-unsur tindak pidana penipuan dapat terjadi dalam pembentukan suatu perjanjian apabila sebelum membuat perjanjian salah satu pihak sudah beritikad tidak baik dengan sebelum membuat perjanjian salah satu pihak sudah beritikad tidak baik dengan memakai nama palsu, martabat palsu, melakukan kebohongan dan menggunakan tipu muslihat dengan maksud menguntungkan diri sendiri.

Abstract

Law No. 35 of 2009 on Narcotics introduces a significant paradigm shift in handling narcotics abuse in Indonesia. The previous paradigm under Law No. 22 of 1997, which focused mainly on repressive measures, has evolved into a more comprehensive approach that integrates repressive, rehabilitative, preventive, and restorative dimensions. Articles 54, 55, and 103 mandate that drug users and addicts undergo medical and/or social rehabilitation, emphasizing that they should not be regarded solely as criminals but also as victims in need of recovery. This study employs a normative juridical approach by analyzing legislation and related legal instruments, such as Supreme Court Circular No. 4 of 2010 jo. Circular No. 3 of 2011. The findings show that the legal paradigm in the Narcotics Law strikes a balance between legal certainty, human rights protection, and social recovery objectives. Thus, rehabilitation policies are expected to reduce the rate of narcotics abuse while protecting Indonesia’s young generation.

Abstract

The rapid development of online transportation in Indonesia has brought significant challenges in regulatory and supervisory aspects. The lack of clear legal frameworks has led to conflicts between conventional and online transportation operators, raising concerns about legal certainty and public safety. The Department of Transportation, as the main regulatory body, plays a crucial role in overseeing and enforcing policies related to online transportation services. However, inconsistencies in the implementation of regulations at the central and regional levels create further complexities in ensuring compliance. This study employs a qualitative method with a normative legal approach, focusing on regulatory analysis and the interpretation of legal norms in practice. Data collection is conducted through a comprehensive literature study, analyzing primary sources such as laws, regulations, and court decisions, as well as secondary sources including legal books, journals, and previous research.The findings indicate that despite existing regulations, the effectiveness of legal enforcement remains limited due to weak coordination between authorities and inadequate monitoring mechanisms. The study also reveals gaps in legal protection for online transportation drivers and users, highlighting the need for more structured policies and digital-based monitoring systems. Strengthening legal harmonization between central and regional regulations is essential to prevent regulatory conflicts and improve law enforcement. In conclusion, a more integrated and adaptive regulatory framework is needed to enhance the safety, fairness, and sustainability of online transportation in Indonesia

Abstract

Domestic Violence (DV) is a serious legal and social issue that often escalates into premeditated murder, particularly when long-term abuse remains unaddressed. This study explores the criminological and legal aspects of premeditated murder in domestic violence cases, focusing on the underlying motives and challenges in law enforcement. The complexity of these cases arises from overlapping regulations between the Indonesian Penal Code (KUHP) and the Domestic Violence Law (UU PKDRT), which can impact judicial decisions. A comprehensive analysis is needed to evaluate whether existing legal frameworks effectively protect victims and deter perpetrators. This research employs a qualitative method with a normative juridical approach, utilizing primary and secondary legal sources such as legislation, court rulings, and academic literature. The collected data is analyzed through a descriptive qualitative method to systematically interpret the legal norms and practical implications. The findings indicate that economic pressures, prolonged psychological abuse, and sociocultural factors significantly contribute to premeditated murder in DV cases. Furthermore, inconsistencies in legal interpretation have led to disparities in sentencing, highlighting the need for legal harmonization. Strengthening law enforcement mechanisms, increasing judicial awareness, and enhancing victim protection services are essential to addressing this issue effectively. A multidimensional approach combining legal reforms and social interventions is necessary to mitigate domestic violence-related murders and ensure justice for victims.

Abstract

The principle of legality, necessity, and proportionality serves as the foundation for the use of force by law enforcement, ensuring that actions taken remain within the boundaries of justice and human rights. The implementation of these principles is regulated under Chief of Police Regulation No. 1 of 2009, yet its application in practice often encounters challenges. Issues such as discrepancies between regulations and field practices, lack of legal comprehension among officers, and weak accountability mechanisms contribute to the ineffectiveness of the regulation. This study examines how these principles are applied in police operations and evaluates the extent to which the existing legal framework ensures proportional and responsible use of force. This research employs a qualitative method with a normative juridical approach, focusing on regulatory analysis and the interpretation of legal norms in practice. Data collection is conducted through an extensive literature review, analyzing primary legal sources, academic journals, and relevant legal literature. Findings reveal that while regulations are comprehensive, gaps in enforcement persist due to insufficient training, limited evaluation mechanisms, and a lack of independent oversight. These challenges create inconsistencies in the application of the principles, occasionally leading to excessive use of force. Strengthening police training programs and legal education is crucial to ensure a proper understanding and application of these legal norms. Additionally, an independent supervisory body is recommended to improve accountability and ensure that law enforcement actions align with legal and human rights principles.

Abstract

The rapid growth of internet usage in Indonesia has accelerated information dissemination while enabling the spread of radical content that threatens national security. Social media serves as an effective platform for extremist groups to promote their ideology, making online radicalization an increasingly serious concern. The government has addressed this issue through Law No. 5 of 2018 on Terrorism and the Electronic Information and Transactions Law (ITE Law). However, implementation remains challenging, particularly in defining “radical content” and overcoming technological barriers in law enforcement. This study employs a qualitative method with a normative legal approach, focusing on regulatory analysis and interpretation of existing norms through literature review of primary, secondary, and tertiary legal materials. The findings indicate that despite an existing legal framework, enforcement is hindered by unclear definitions and detection difficulties on encrypted platforms. Regulatory reform and preventive strategies, such as digital literacy and state–platform collaboration, are essential to curb online radicalization effectively.

Abstract

Today's economic development has improved land law relations towards an increasingly complex situation. the use of land today has led to multifunctionality is not as simple as when Law No. 5 of 1960 on agrarian regulations and principles promulgated. Indonesia today is undergoing a shift and has stepped on the era of economic takeoff, the land is not only used for agricultural land but for the benefit and even become an object of business thus the forms of transition rights are diverse and complex. The passive attitude of PPAT in serving the parties in the sense of accepting only all data and information submitted to it without carefully researching the truth of the data or information, is an opportunity for certain parties to apply data or information that is not true or false to the creation of a land deed. PPAT as the official of the land deed maker at the request of certain parties enter data or information that is not true or False into the deed made in exchange for services and the inclusion of false or false information is an agreement between PPAT.
