Abstract

Premeditated murders are quite challenging to obtain additional statements as there are generally no witnesses at the crime scene. However, the perpetrators have already planned to eliminate possible witnesses. Therefore, the role of the perpetrator’s witness (justice collaborator) is very important in the investigation process and court decision. According to the Criminal Code, the legal subject of the case is a “person” (for example, in article 340 of the Criminal Code, it is referred to as “anyone,” which means a specific individual). This research aims to understand the role of justice collaborators in sanction decisions by judges and analyze the differences in judges’ decisions through a study of two decisions: 103/Pid.B/2022/Pn.Mks and 798/Pid.B/2022/Pn.Jkt.Sel. This research used normative approach, relying on secondary data such as laws, court decisions, and legal theories. This research showed that there is no specific regulation on sanctions for a justice collaborator (witness who cooperates with law enforcement) in Indonesia. Judges have the flexibility to consider the sanctions imposed on justice collaborators, so there are often differences in punishment even though the offenses are the same. Justice collaborators get an advantage in law if they help law enforcement officials solve criminal cases.

Abstract

Artikel ini membahas kegiatan pemberdayaan dan pengabdian masyarakat yang dilakukan di PT Nippon Piston Ring Manufacturing Indonesia, Kabupaten Pasuruan, dengan fokus pada pembentukan Satgas Pencegahan dan Penanganan Kekerasan Seksual di Tempat Kerja. Melalui tahapan persiapan, pelaksanaan, dan evaluasi, kegiatan ini bertujuan untuk menerapkan teori perlindungan hukum preventif guna mencegah kekerasan seksual sebelum terjadi. Kegiatan pengabdian ini mengidentifikasi kebutuhan peningkatan pemahaman mengenai peraturan dan kebijakan terkait kekerasan seksual di tempat kerja serta mengedukasi peserta tentang dampak kekerasan seksual dan pentingnya pembentukan Satgas. Hasilnya menunjukkan bahwa pembentukan Satgas berperan penting dalam memastikan penerapan kebijakan yang sesuai dan menciptakan lingkungan kerja yang aman, harmonis, dan produktif. Evaluasi selanjutnya akan menilai efektivitas Satgas dan keberlanjutan program dalam mendukung perlindungan pekerja dan hubungan industrial yang harmonis.

Abstract

This study examines the constitutional supremacy in shaping statutory regulations, positioning it both as a guiding framework and a binding compliance standard for the public particularly state authorities and their institutions. It argues that the Law on the Formation of Laws and Regulations serves as a definitive and legitimate benchmark in constitutional review. Nonetheless, practical realities reveal instances where the principle of utility can override arguments concerning formal defects in legislation and Government Regulations in Lieu of Law (Perppu). Employing a normative legal research method that integrates statutory and conceptual approaches, this paper provides a descriptive analysis of the issue. The findings indicate that constitutional review functions as an embodiment of constitutional supremacy through the judicial examination of laws, with the Law on the Formation of Laws and Regulations serving as a key parameter in determining constitutionality a parameter whose application continues to evolve.
