Abstract

Elections as one of the procedures in a democratic country have gone through a long journey, especially when talking about elections in Indonesia. Indonesia as a democratic country and also a rule of law state also regulates election matters in statutory regulations, namely Law Number 7 of 2017 concerning General Elections, but Law Number 7 of 2017 concerning Elections does not always work in an ideal system, in the Law No. The law regulates ex-convicts to be able to run in legislative elections, ex-convicts are explicitly allowed to run in legislative elections with several conditions. If you look at one form of an ideal system, elections should be a forum for selecting candidates for leaders or representatives of the people who are clean and have integrity without any criminal records. However, Article 240 Paragraph 1 Letter g allows ex-convicts to run for election to the legislature, this article creates uproar and is often tested for constitutionality in the Constitutional Court through the Judicial Review review  Pemilu sebagai salah satu prosedur dalam negara demokrasi telah melalui perjalanan panjang terutama jika berbicara pemilu di Indonesia. Indonesia sebagai negara demokrasi dan juga negara hukum juga mengatur soal pemilu dalam peraturan perundang-undangan yaitu Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, namun Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu tersebut tidak selalu berjalan pada sistem ideal, dalam Undang-Undang tersebut mengatur tentang mantan narapidana untuk bisa maju dalam pemilu legislatif, secara eksplisit mantan narapidana diperbolehkan untuk maju dalam pemilu legislatif dengan beberapa syarat. Jika melihat pada satu bentuk sistem ideal seharusnya pemilu menjadi wadah untuk memilih calon pemimpin atau waki rakyat yang bersih dan berintegritas tanpa ada catatan kriminal. Namun pada pasal 240 Ayat 1 Huruf g memperbolehkan mantan narapidana untuk bisa mencalonkan diri dalam pemilu legislatif, tenunya pasal tersebut melahirkan kegaduhan dan seringkali di uji konstitusionalitasnya di Mahkamah Konstitusi melalui jalur Judicial Review.

Abstract

The implementation of Law Number 23 of 2014 concerning Regional Government has brought about fundamental changes in the structure of authority between the central government, provinces, and districts/cities. This study examines the dynamics of governance in West Java Province, with a focus on challenges, institutional responses, and intergovernmental synergy strategies. The results of the study indicate that West Java Province faces various problems, such as institutional unpreparedness, weak cross-government coordination, fiscal limitations, and fragmentation of information systems. Meanwhile, institutional responses indicate efforts to adjust structures and innovate public services, but have not been fully integrated with districts/cities. As a novelty, this study offers a strategic policy framework based on equitable asymmetric decentralization, including the formulation of regional capacity indicators, integration of planning information systems, and strengthening cross-regional collaboration. This research is expected to be a theoretical and practical contribution in formulating a model of regional governance that is adaptive and responsive to the local context.

Abstract

Democracy does not operate without flaws. Although it represents the best concept of governance among the worst, democracy always contains the potential to lead toward authoritarian regimes. The problem of authoritarianism is a social psychology issue concerning a regime type that suppresses popular sovereignty. In various countries that have experienced it, authoritarianism does not emerge on its own; there are preconditions that can be analyzed based on the ongoing socio-political context, including in post-reform Indonesia. To demonstrate how authoritarian practices operate in Indonesia, this research employs a literature study approach, as its focus relies on sources derived from literature. The research findings indicate that symptoms of authoritarianism such as abusive constitutionalism practices, electoral cartelized systems, juristocracy, and autocratic legalism have occurred in Indonesia, reinforced by various factors such as the formation of legislation that disregards constitutional principles, electoral autocracy, and the partiality of judicial power to the political will of those in power. There are several recommendations for rebuilding Indonesian democracy to make it better, including legal reforms on limiting Presidential powers before elections, tightening ethical oversight of judges, strengthening the authority of state institutions that have been weakened, and encouraging parliament to undertake transformative legislature in order to implement democracy more substantively.
