Abstract

The purpose of this article is to describe the fulfillment of social work rights, analyzing the extent to which the government provides social security for social workers. This study uses a qualitative method with a normative juridical approach. The analysis in this study contributes to the fulfillment of social workers' rights in terms of social security and provides recommendations regarding social security regulations as a fulfillment of social workers' rights. The results show that three aspects must be considered in the rights of social workers to social security in Indonesia, namely (1) Fulfillment of Social Workers' Rights, (2) Anticipation of regulations against the risks of social workers, and (3) Social security for social workers in Indonesia. From these three aspects, there are several efforts made by the government in regulation that has issued Law Number 14 of 2019 concerning Social Workers, but the law only regulates the Rights and Obligations of Social Workers in Indonesia. The findings may also impact the lives of social workers, including improved financial well-being, job security, and professional satisfaction. Previous studies have not discussed the aspect of social security as a fulfillment of social workers' rights, so this research contributes to this void by paying attention to the analysis of the fulfillment of social workers' rights in terms of social security aspects.

Abstract

The 2019 general election is considered a complex election in terms of organization and types of violations. Allegations of election violations prompted changes in the various laws governing them. In preparation for the 2024 election, the General Election Supervisory Agency (Bawaslu) is working to strengthen election laws. This includes improving enforcement institutions and establishing Bawaslu as a permanent institution. Additionally, they are addressing the increasingly complex types of violations and the severity of sanctions. A normative-legal approach is the research methodology employed in this study. The study found that Bawaslu addressed election violations in two ways: settling election administrative violations through an open hearing conducted by the examining panel and settling election administrative violations through a fast event, in accordance with Law Number 7 Year 2017 on General Elections, which specifically refers to Perbawaslu Number 7 Year 2022 on Handling Election Violation Findings and Reports, Perbawaslu Number 8 Year 2022 on Completion of General Election Administrative Violations, and Perbawaslu Number 3 Year 2023 on Integrated Law Enforcement Center.

Abstract

AbstractThe purpose of this research is to measure the possibility of delaying the implementation of the 2024 elections from the perspective of constitutional law in Indonesia. In this study, a normative juridical method was used with a statutory approach to study the legal basis, legal principles, and regulatory processes related to postponing elections in Indonesia. journals or surveys conducted by credible research institutions. The results of the discussion stated that the results of a survey conducted by Indonesia Political Opinion on the postponement of the general election in 2024, the result was that the approval rate was only 23% while the rejection rate was 77%. The details are 31% strongly disagree, 46% disagree. Besides that, through the General Election Commission Decree Number 21 of 2022 the implementation of the elections was set for February 14, 2024. The Central Jakarta District Court decision number 757/Pdt.G/2022/PN Jkt Pst which required the KPU to postpone the elections has also been annulled by the Jakarta High Court . Furthermore, related to efforts to postpone constitutional and comprehensive elections is by changing the provisions of the articles contained in the 1945 Constitution of the Republic of Indonesia, another way is by issuing a Presidential Decree. The conclusion of this article states that the chance of postponing the election is very small and even if it has to be postponed the correct procedures and procedures are only through amendments to the 1945 Constitution of the Republic of Indonesia. AbstrakTujuan penelitian ini adalah untuk menakar peluang terjadinya penundaan pelaksanaan Pemilu 2024 dalam perspektif Hukum ketatanegaraan di Indonesia. Dalam penelitian ini, digunakan metode yuridis normatif dengan pendekatan perundang-undangan untuk mempelajari dasar hukum, prinsip-prinsip hukum, dan proses pengaturan terkait penundaan pemilu di Indonesia, selain itu digunakan juga sejumlah dokumen hasil riset terdahulu dalam rangka memperkuat argumentasi penelitian, baik dalam bentuk jurnal ataupun survei yang dilakukan oleh lembaga peneliti kredibel. Hasil pembahasan menyatakan bahwa hasil survei yang dilaksanakan oleh Indonesia Political Opinion terhadap penundaan pemilihan umum di tahun 2024, hasilnya tingkat persetujuan hanya berada pada angka 23% sementara tingkat penolakan sebanyak 77%. Rinciannya 31% sangat tidak setuju, 46% tidak setuju. Disamping itu, melalui Keputusan Komisi Pemilihan Umum Nomor 21 Tahun 2022 pelaksanaan pemilu ditetapkan pada tanggal 14 februari 2024. Putusan PN Jakarta Pusat nomor 757/Pdt.G/2022/PN Jkt Pst yang mengharuskan KPU untuk menunda pemilu juga telah dibatalkan oleh Pengadilan Tinggi Jakarta. Selanjutnya, terkait upaya penundaan pemilu secara konstitisional dan komprehensif ialah dengan mengubah ketentuan pasal-pasal yang terdapat dalam UUD NRI 1945, cara lainnya dengan mengeluarkan dekrit Presiden. Simpulan artikel ini menyatakan bahwa peluang terjadinya penundaan pemilu ialah sangat kecil dan sekalipun harus ditunda prosedur dan tata cara yang benar hanya melalui amandemen UUD NRI 1945.

Abstract

This research critically assesses the role and effectiveness of the National Legislation Programme (Prolegnas) in the process of legal policy-making in Indonesia. This research aims to assess the extent to which Prolegnas can plan legislation in accordance with national legal needs. The method used is a literature review, in which various legal sources and reports on the implementation of Prolegnas are analysed in depth. The results of this study will provide insight into the various obstacles and challenges faced in the implementation of Prolegnas. It is also expected that this research will provide recommendations on how to improve the effectiveness of Prolegnas in supporting a more targeted and sustainable legal policy

Abstract

This research is motivated by the fact that the law enforcement system in Indonesia often faces challenges in achieving justice and legal certainty, which are influenced by the dynamics of legal politics. This research aims to analyse the influence of legal politics on the effectiveness of the law enforcement system in Indonesia. This research applies a normative legal approach with a descriptive analysis method to explore the relationship between legal policy and its implementation. Data was collected through document review, including laws and regulations and related academic literature. The data was also analysed using qualitative data analysis techniques to identify patterns and relationships within the legal system. The results of this study show that legal policy plays a significant role in shaping the direction of law enforcement, both in terms of policy and implementation on the ground. The findings of this study imply that there is a need for harmonisation between legal policy and law enforcement practices in order to achieve more equitable and transparent justice.

Abstract

The purpose of this article is to analyze the urgency of participatory supervision in the implementation of the 2024 regional head elections and the authority of Bawaslu in improving participatory supervision of the implementation of regional head elections. The method used in this study uses a normative legal approach. The results of the study show that the urgency of participatory supervision is an effort to ensure that each voter votes intelligently, which can be done by voters by collecting data, information and inventorying findings of alleged violations related to the implementation of regional head elections carried out by the community or independent organizations. Participatory supervision aims to realize the implementation of an honest, fair, clean and transparent election process and the results can be accepted by all parties, both election participants and the community. Bawaslu as the election organizer is responsible for the implementation of all stages of the implementation of quality, integrity and dignified regional head elections, which are expected to be able to encourage and continue to strengthen election supervision by providing reinforcement in the form of regulations, authority, human resources, and adequate facilities and infrastructure. The form of activity as one of the authorities owned by Bawaslu in increasing community participatory supervision in the process of organizing regional head elections is through Participatory Supervision Education (P2P) activities organized by Bawaslu Regency/City, given to various groups of people, especially new voters to optimize the understanding and desire of the community to increase participatory supervision carried out by the community. In addition to these activities, Bawaslu also continues to optimize efforts to increase participatory supervision carried out by the community, including through the formation of supervision villages in the community environment, socialization to community groups about the importance of supervision of the implementation of regional head elections which is packaged in various forms of activities.

Abstract

Penelitian ini bertujuan untuk menganalisis dinamika politik legislasi di Indonesia dengan menyoroti peran kepentingan politik dalam proses penetapan regulasi dan bagaimana politik mempengaruhi pembentukan, perubahan, dan penerapan hukum dalam konteks negara demokratis, dengan fokus pada studi kasus Indonesia. Penelitian ini menggunakan metode yuridis-sosiologis dengan pendekatan analisis dokumen. Hasil penelitian menunjukkan bahwa kepentingan politik memiliki pengaruh signifikan dalam pembentukan regulasi, yang sering kali mengabaikan aspirasi publik dan prinsip keadilan hukum. Kebaharuan penelitian ini terletak pada pemetaan sistematis aktor-aktor politik yang terlibat dalam proses legislasi serta analisis keterkaitan antara tekanan politik dan substansi regulasi yang dihasilkan. Kontribusi penelitian ini adalah memberikan rekomendasi untuk menciptakan proses legislasi yang lebih transparan dan akuntabel, serta menyeimbangkan kepentingan politik dengan kebutuhan masyarakat dan nilai-nilai hukum yang adil.

Abstract

This paper is aimed at investigating the status determination of State Capital City and its influence in establishing people welfare. The method used in this study is descriptive analysis method by explaining a whole general description and systematic phenomena occurred. Determination of territory becoming state capital city as a special territorial unit in accordance with Article 18B of the 1945 Constitution of the Republic of Indonesia is regulated by historical factor, regional needs factor, and regional atmosphere factor. Then, it is regulated through specific laws established by the government on the basis of philosophical, juridical, and sociological aspects. The regional government of  capital city has an important role to achieve welfare, with various aspects of community life related to the aspects of justice, law enforcement, respect for human rights, acceleration of economic development, improvement and development for existed communities in the region, which is not only determined by the government, but also based on individual aspiration (citizens), especially the majority of Muslim communities, in order to realize the Indonesian nation in protecting the entire Indonesian nation, advancing general welfare, educating nation life, and involving in realizing people welfare.

Abstract

The delay in taking these shares is due to unhealthy business practices or monopolistic practices with a rule of visible reason approach. So look objectively at whether the Commission's decision in the case of unfair trade competition is based on Law Number 5 of 1999 concerning Monopolies and Unfair Business Competition and impose sanctions in the form of fines on economic entities that do not notify such notification as the acquisition of shares, as exemplified in the alleged case delay in taking over the shares of PT Mitra Keluarga Karyasehat Tbk in PT Bina Husada Gemilang (Number 12/KPPU-M/2022). This legal research uses a normative juridical method. This decision confirms to law enforcers the violation of unfair business competition that results in market losses in healthily doing business

Abstract

Penelitian ini bertujuan untuk mengetahui penghitungan kerugian Negara yang dilakukan oleh Jaksa dalam Tindak Pidana Korupsi (TIPIKOR), untuk mengetahui proses penghitungan kerugian Negara oleh Jaksa dalam surat penetapan tersangka Nomor : PRINT 05/N.9.11.4/Fd.1/12/2017, dan untuk mengetahui kendala yang dihadapi Jaksa dalam proses penghitungan kerugian Negara, dalam upaya menjadi lebih baik dalam proses penghitungan kerugian Negara pada Tindak Pidana Korupsi (TIPIKOR). Penelitian ini dilakukan dengan metode deskriftif analisis  yaitu memberikan data-data  yang diteliti tentang keadaan objek yang diteliti, yaitu melakukan wawancara terhadap Kejaksaan terkait dengan yang diteliti, dan Pendekatan yuridis normatif. Berdasarkan hasil penelitian dapat ditarik kesimpulan bahwa penghitungan kerugian Negara yang dilakukan oleh Jaksa dalam Tindak Pidana Korupsi (TIPIKOR), Jaksa tidak berwenang menghitung Kerugian Negara sebagaimana  SEMA Nomor 04 Tahun 2016, sehingga penghitungan kerugian Negara pada tindak pidana korupsi yang dilakukan oleh Jaksa merupakan penyalahgunaan wewenang yang mengakibatkan timbulnya ketidakadilan dalam proses peradilan pidana. Proses penghitungan kerugian Negara oleh jaksa dalam Surat Penetapan Tersangka Nomor: PRINT 05/N.9.11.4/Fd.1/12/2017, batal demi hukum karena penghitungan kerugian Negaranya tidak sesuai dengan peraturan perundang-undangan yang mengaturnya.
