Abstract

Abstrak Artikel karya ilmiah ini berisi tentang bagaimana ideologi negara kita yaitu Pancasila dapat menjadi pedoman kita, terutama dalam Pancasila pertama yaitu Ketuhanan Yang Maha Esa yang telah ditetapkan sebagai pedoman kita untuk hidup dalam kedamaian beragama. Dalam artikel ini, penulis akan membahas bagaimana Gereja ikut serta mengembangkan nilai-nilai luhur yang terkandung dalam Pancasila itu sendiri, Gereja juga membimbing umatnya di masyarakat untuk turut serta memajukan kehidupan cinta kasih untuk kehidupan yang lebih layak. Penulis juga mengkaji apa yang menghambat implementasi Pancasila dalam kehidupan masyarakat. Kesimpulan dari penelitian ini adalah Pancasila tidak bertentangan dengan kehidupan menggereja, pancasila dan nilai-nilai yang diajarkan oleh gereja dan pemuka agama kristiani adalah sejalan dan saling melengkapi. Pengimplementasian Pancasila dalam gereja menjadi sangat jelas dengan gereja mempromosikan hidup berdampingan dengan orang lain. Kata Kunci: Pancasila, Gereja, Masyarakat Abstract This scientific work article contains about how the ideology of our country namely Pancasila can be our guide, especially in the first Pancasila namely Belief in One God which has been set as our guide to living in a religious peace. In this article, the author also discusses how the Church participates in developing the noble values contained in Pancasila itself, the Church also guides its people in the community to participate in advancing the life of love for a more decent life. The author also examines what hinders the implementation of Pancasila in people's lives. The conclusion of this study is that Pancasila does not conflict with the life of the church, Pancasila and the values taught by the church and Christian religious leaders are in line and complement each other. The implementation of Pancasila in the church becomes very clear with the church promoting coexistence with others. Keywords: Pancasila, Church, Community

Abstract

This article examines the management of Indonesia's natural resources based on Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) and the Basic Agrarian Law (UUPA), as well as its impact on indigenous land rights in the development of the Nusantara Capital City (IKN). The state has the authority to control natural resources for the welfare of the people, as regulated by the UUPA, particularly Article 4 Paragraph (1) on land control rights. The UUPA was formulated to eliminate the dualism between colonial agrarian law and customary law and to provide legal certainty regarding land rights. With the enactment of Law No. 3 of 2022 on IKN, new challenges have emerged in managing land in Kalimantan, particularly regarding indigenous territories, which encompass 476 mapped areas with vast customary forests. The main implication of this policy is the potential for conflicts between indigenous communities and the government concerning land control. The author employs a qualitative research method, using a legal and customary law approach, to explore the issue of how to protect indigenous rights and prevent their marginalization in large-scale development projects. On the other hand, opportunities arise to create more inclusive and sustainable policies by ensuring that local interests are considered in the development of IKN. This article highlights the importance of harmonizing the 1945 Constitution, UUPA, and IKN Law to balance the needs of national development and the protection of indigenous rights, thereby reducing the potential for regional conflicts and increasing legal certainty for investors.
