Abstract

This research attempts to describe the young Minangkabau generation's reception of Muslim dress codes in the public sphere and to reflect on an attempt to reconstruct the local identity of West Sumatra. Although the Muslim dress code has become a common sight and has been uniformly implemented in all educational institutions and government agencies, the reception of the younger Minangkabau generation towards these rules is not always directly proportional to the phenomenon. Using a qualitative approach and interviews with young people in Agam district, Lima Puluh Kota, and Tanah Datar, the research found that most of the sources contacted were unaware of the exact scope and legal enforcement of the regulation. But as Moslem, they agreed with the codes, although the critical notes about the implementation. Besides, only a small percentage opposed it. Considering the further discussion about the contents, the codes should also be implemented proportionately, without binding and forcing another religious follower to avoid the intolerant and discriminatory labels attached to the people of West Sumatra. Further, the reception must also be considered to regulate legal products that are close to Minangkabau community traditions to reconstruct the local identity of West Sumatra.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hukum hakim dalam menjatuhkan putusan terhadap terdakwa kasus tindak pidana narkotika di Pengadilan Negeri Lubuk Sikaping berdasarkan Putusan Nomor 123/Pid.Sus/2023/PN Lbs. Kajian ini juga membahas mengenai proses pembuktian, penerapan pasal-pasal dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, serta kemungkinan upaya hukum yang ditempuh oleh pihak terdakwa. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan yuridis normatif. Data diperoleh melalui studi kepustakaan, dokumentasi putusan pengadilan, serta analisis terhadap pertimbangan hukum hakim dan argumentasi yuridis yang digunakan. Hasil penelitian menunjukkan bahwa hakim menjatuhkan pidana penjara selama 15 (lima belas) tahun terhadap terdakwa karena terbukti secara sah dan meyakinkan memiliki serta mengedarkan narkotika golongan I jenis sabu tanpa izin. Pertimbangan hukum hakim didasarkan pada aspek yuridis, sosiologis, dan moral dengan tujuan memberikan efek jera serta melindungi masyarakat dari bahaya penyalahgunaan narkotika. Dalam kasus ini, terdakwa mengajukan upaya hukum banding namun ditolak oleh Pengadilan Tinggi Padang, dan kasasi yang diajukan ke Mahkamah Agung juga dikuatkan. Hal ini menunjukkan konsistensi penerapan hukum dalam perkara narkotika.

Abstract

Cooperatives are legal entities established with the aim of improving the welfare of members based on Law No. 25 of 1992 on Cooperatives. As time goes by, there are many cooperative practices that carry out banking business without license, such as deposits or term savings. Not a few cooperatives end up going bankrupt or being reported for fraud because they are unable to pay interest and disburse deposit funds from their members or non-members. The practice of banking activities without a license carried out by cooperatives clearly violates Article 46Pparagraph (1) of Law No. 10 of 1998 on Amendments to Law No. 7 of 1992 on Banking. The rise of banking practices without license carried out by cooperatives is partly due to weak supervision of cooperatives by the government which should be carried out by the Ministry of Cooperatives and Small and Medium Enterprises. Therefore, referring to Article 44B Paragraph (3) of Law No. 4 of 2023 on Development and Strengthening of the Financial Sector jo. Article 6 of Law No. 21 of 2011 on the Indonesia Financial Services Authority (OJK), the institution that has the right to supervise cooperatives operating in the financial services sector is the Indonesia Financial Services Authority (OJK).
