Abstract

Perkembangan teknologi digital yang pesat telah mengubah cara distribusi dan konsumsi konten berhak cipta, khususnya melalui layanan Over The Top (OTT) seperti Netflix dan Spotify. Namun, kemudahan akses ini juga meningkatkan risiko pelanggaran hak cipta, seperti pembajakan dan distribusi ilegal. Digital Rights Management (DRM) muncul sebagai solusi teknologi untuk melindungi hak cipta digital dengan mengatur akses dan penggunaan karya kreatif. Penelitian ini membandingkan kerangka regulasi DRM di Indonesia yang diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dengan Digital Millennium Copyright Act (DMCA) di Amerika Serikat. Dengan menggunakan metode yuridis normatif dan pendekatan perbandingan hukum, penelitian ini mengidentifikasi perbedaan dan kesamaan antara kedua regulasi tersebut. Hasil penelitian menunjukkan bahwa DMCA memiliki pendekatan yang lebih rinci dan komprehensif, sedangkan pengaturan DRM dalam UU Hak Cipta masih bersifat umum dan menghadapi tantangan dalam hal standarisasi teknis dan penegakan hukum. Penelitian ini menekankan pentingnya penguatan regulasi, pengembangan teknologi, dan peningkatan kesadaran masyarakat untuk mendukung implementasi DRM yang lebih efektif di Indonesia. The rapid development of digital technology has transformed the way copyrighted content is distributed and consumed, particularly through Over The Top (OTT) services like Netflix and Spotify. However, this ease of access also increases the risk of copyright infringement, such as piracy and unauthorized distribution. Digital Rights Management (DRM) emerges as a technological solution designed to protect digital copyrights by regulating access and usage of creative works. This study compares the regulatory framework for DRM in Indonesia, as outlined in Law No. 28 of 2014 on Copyright, with the Digital Millennium Copyright Act (DMCA) in the United States. Using a normative juridical method with a comparative legal approach, this research identifies key differences and similarities in the two regulatory frameworks. Findings reveal that while DMCA provides a more detailed and comprehensive approach to DRM implementation, Indonesia's copyright law remains general and faces challenges in technical standardization and law enforcement. This study highlights the importance of adopting a more integrated approach to DRM in Indonesia, combining regulatory improvements, technological advancements, and public awareness campaigns to strengthen copyright protection in the digital era.

Abstract

Private Placement merupakan salah satu mekanisme yang memungkinkan perusahaan terbuka untuk memperoleh pendanaan tambahan tanpa memberikan Hak Memesan Efek Terlebih Dahulu (HMETD) kepada pemegang saham eksisting. Penelitian ini bertujuan untuk menganalisis pengaturan hukum Private Placement dalam pasar modal di Indonesia, dampaknya terhadap kepastian hukum, dan perlindungan hak-hak pemegang saham minoritas. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta mengkaji regulasi seperti Undang-Undang Pasar Modal, Undang-Undang Perseroan Terbatas, dan POJK No. 38/2014. Hasil penelitian menunjukkan bahwa Private Placement dapat berdampak pada dilusi kepemilikan saham minoritas, meskipun regulasi telah menetapkan prinsip keterbukaan informasi dan kewajiban pengawasan oleh OJK untuk melindungi para pemangku kepentingan. Temuan ini menegaskan pentingnya penguatan pengaturan hukum dan penerapan prinsip tata kelola perusahaan yang baik dalam pelaksanaan Private Placement agar tercapai keseimbangan antara kepentingan emiten dan perlindungan investor. Penelitian ini memberikan kontribusi terhadap pengembangan kebijakan yang lebih adil dan transparan di pasar modal Indonesia. Private Placement is a mechanism that allows publicly listed companies to secure additional funding without granting Pre-emptive Rights (HMETD) to existing shareholders. This research aims to analyze the legal framework of Private Placement in Indonesia’s capital market, its impact on legal certainty, and the protection of minority shareholders' rights. The study adopts a normative juridical method with a statute and conceptual approach, examining regulations such as the Capital Market Law, the Limited Liability Company Law, and POJK No. 38/2014. The findings reveal that Private Placement may dilute minority shareholdings despite existing regulations enforcing transparency principles and oversight by OJK to safeguard stakeholders. These findings highlight the importance of strengthening the legal framework and applying good corporate governance principles to ensure a balance between the interests of issuers and the protection of investors. This study contributes to the development of more equitable and transparent policies in Indonesia’s capital market.

Abstract

The rapid advancement of digital technology has significantly heightened the risk of copyright infringement in streaming services, making the implementation of Digital Rights Management (DRM) an essential mechanism for protection. This study aims to analyze the effectiveness of DRM regulations in safeguarding copyrights on digital platforms in Indonesia and to propose measures to enhance their enforcement. The research employs a normative juridical approach, focusing on an in-depth examination of Indonesia’s Law No. 28 of 2014 on Copyright, alongside a comparative analysis of international cybersecurity regulations, particularly in the European Union (EU) and the United States (US), where DRM frameworks are more robust and extensively enforced. The findings of this study indicate that, first, while DRM is legally recognized in Indonesian regulations, its practical implementation remains vulnerable to cyberattacks and digital piracy. The existing legal framework remains general and lacks specificity in addressing the technical complexities of DRM protection for digital content. Second, comparative insights reveal that countries with more developed cybersecurity infrastructures, such as the EU and the US, provide more comprehensive protection through detailed legal frameworks and advanced technological measures that reinforce DRM enforcement. Based on these findings, this study recommends updating Indonesia’s DRM regulations, strengthening cybersecurity infrastructure by adopting international best practices, and enhancing global cooperation to combat digital piracy through cross-border networks. These measures are essential to fortifying copyright protection in Indonesia’s digital streaming landscape and ensuring a secure and sustainable digital economy.
