Abstract

This paper discusses about licensing the establishment of houses of worship. In practice, the licensing arrangements for worship in both countries have significant differences. Indonesia has a bureaucratic approach that is formal, administrative, and social and community-based. Indonesia specifically regulates the requirements for the establishment of houses of worship in PBM 9 & 8/2006. Administrative, technical, and special requirements are required to obtain licenses. However, PBM 9&8/2006 has a loophole for the rejection of houses of worship, thus potentially inhibiting freedom of worship. On the other hand, Germany takes an ecological, spatial, and architectural approach to licensing houses of worship. Germany adheres to BauGB as a regulation related to building construction by paying attention to FNP and B-Plan as guidelines. This normative juridical research uses comparative, conceptual, and statutory approaches. The main finding of this research is that the two countries have different approaches in considering permits for the establishment of houses of worship. It is found that the difference between the two lies in the aspects of regulation, characteristics, and the approach to resolving disputes over the establishment of houses of worship.

Abstract

This study discusses the application of the Piercing the Corporate Veil (PCV) doctrine as an alternative to optimise the bankruptcy estate in the insolvency case of PT Sri Rejeki Isman Tbk (PT Sritex). PT Sritex was declared bankrupt by the Commercial Court of Semarang due to its failure to fulfil debt obligations amounting to IDR 29.8 trillion. The problem became more complex following the disclosure of alleged corruption by the former President Director, Iwan Setiawan Lukminto, who misused loan facilities totalling IDR 692.9 billion obtained from Bank BJB and Bank DKI. This case created an overlap between criminal asset confiscation and general bankruptcy execution, potentially reducing the value of the bankruptcy estate and harming creditors, particularly unsecured creditors. Therefore, the proposed solution is to optimise the bankruptcy estate by applying the PCV doctrine, which extends liability to the personal assets of directors, as stipulated in Law Number 40 of 2007 concerning Limited Liability Companies. This research employs a normative juridical approach, analysing statutory regulations, legal literature, and relevant court decisions. The findings indicate that the elements of Article 3 paragraph (2) and Article 104 paragraph (2) of the Company Law are fulfilled, directors can be held personally liable, and their assets drawn into the bankruptcy estate. To address the conflict between criminal and bankruptcy confiscation, a separation of assets is necessary, so that the proceeds of corruption can be returned to the state. In contrast, the legitimate assets of the company and its directors can still be distributed proportionally to creditors.

Abstract

Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013 telah mengubah urutan prioritas pembayaran boedel pailit dengan menempatkan upah pekerja sebagai prioritas utama. Dalam kasus PT Sritex Group, kurator telah membayarkan upah pekerja, tetapi masih terdapat permasalahan dalam pemenuhan hak-hak Pekerja/Buruh selain upah. Hal tersebut baru dapat dipenuhi, jika kreditur separatis telah memperoleh haknya. Sedangkan UU KPKPU tidak menetapkan batas waktu pemberesan boedel pailit, menyebabkan ketidakpastian pembayaran hak-hak tersebut. Selain itu, PHK yang dilakukan sebelum Hari Raya Idul Fitri mengakibatkan pekerja tidak memperoleh THR. Mengatasi hal tersebut BPJS Ketenagakerjaan telah bekerja dengan tepat dengan mempercepat pencairan JHT dan JKP. Selain itu, keputusan kurator untuk tidak melakukan going concern dinilai tepat karena tujuan utama going concern adalah menjaga nilai boedel pailit sebelum likuidasi, bukan untuk mempekerjakan Pekerja/Buruh dalam jangka waktu yang lama. Di sisi lain mekanisme penyewaan aset dapat menjadi solusi jangka pendek bagi mantan Pekerja/Buruh dengan hubungan kerja PKWT. Terdapat tantangan bagi Pekerja/Buruh PT Sritex pasca-PHK, yakni mencakup aspek usia dan jenis kelamin, yang berimplikasi pada kesulitan memperoleh pekerjaan. Oleh karena itu, diperlukan kebijakan dan peran stakeholder terkait yang dapat menjamin akses pekerjaan tanpa diskriminasi usia dan gender bagi pekerja terdampak. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi Pekerja/Buruh PT Sritex Group yang terkena PHK pasca pailit serta menelaah kemungkinan nasib Pekerja/Buruh pasca PHK. Untuk itu penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach).

Abstract

Land conflicts in Indonesia remain persistent, particularly disputes over Grondkaart lands controlled by Perseroran Terbatas Kereta Api Indonesia (PT KAI). The absence of explicit regulation in the Basic Agrarian Law (UUPA) and fragmented policy paradigms across institutions have led to legal uncertainty. Previous studies conducted by Karini (2021), Silvianna (2020), and Sulistiowati et al. (2020) examined Grondkaart as evidence of control or dispute resolution. However, they did not provide a comprehensive conceptualisation of permanent land rights for railway infrastructure. This research addresses that gap by analysing Grondkaart through the framework of Special Use Rights (Hak Pakai Khusus) as a sustainable legal solution. This normative juridical research uses statutory and conceptual approaches, focusing on the historical trajectory of Grondkaart from Dutch nationalisation and its problematic conversion into temporary Rights to Use. The findings show that granting PT KAI Special Use Rights with permanent validity provides stronger legal certainty than temporary rights, considering the permanent social function of railways. In practice, binding precedents and Supreme Court Circular Letters (SEMA) can guide judges in resolving disputes, though challenges persist in consistency and judicial understanding. This research recommends reforming agrarian law by affirming Special Use Rights for PT KAI as a permanent solution. Internationally, the article offers insights into post-colonial land disputes, showing how reconciling historical claims with present infrastructure needs can inspire reforms in other jurisdictions. The Indonesian case enriches global discourse on land rights and legal certainty, making it relevant to foreign scholars and policymakers.
