Abstract

Penelitian ini bertujuan untuk menganalisis aspek hukum penjualan baju thrift di TikTok Shop dari perspektif hukum positif dan hukum ekonomi syariah. Metode yang digunakan adalah deskriptif kualitatif, dengan pengumpulan data melalui berbagai sumber, termasuk buku, media, dan penelitian sebelumnya. Hasil penelitian menunjukkan bahwa meskipun penjualan pakaian bekas impor dilarang berdasarkan regulasi yang ada, praktik jual beli baju thrift domestik masih marak di TikTok Shop. Penjual yang mematuhi ketentuan hukum dapat beroperasi secara legal, namun terdapat tantangan terkait transparansi informasi dan potensi ketidakpuasan konsumen. Selain itu, penelitian ini mengidentifikasi perlunya peningkatan kesadaran akan hak-hak konsumen dan dampak ekonomi dari praktik ini terhadap industri lokal.

Abstract

The purpose of this study is to determine the concept of guardianship, nasaband inheritance rights of adulterated girls according to Islamic law. InIslam, guardianship of adulterated daughters can be granted to theirbiological father with the condition of recognition from the father. Unlikethe case with the nasab of adulterated girls in Islam, someone who givesbirth outside a valid marriage in shara', the nasab of children born fromthat marriage is fully related only to the mother. Similarly, the inheritancerights of adulterated daughters are when they are not related to their father,they will not receive inheritance from their father. Therefore, we areinterested in discussing the guardianship of nasab and the inheritance rightsof adulterated daughters from the perspective of Islamic law.

Abstract

This research aims to analyze Verbal Violence of Husband Against Wife inPre-Prosperous Family from Criminal Perspective, where individuals orfamilies have not been able to meet the basic needs of life properly. Using aqualitative method with a literature study, data was collected from varioussources, including scientific journals and relevant laws and regulations. Theresults show that verbal violence, although often considered trivial, has asignificant psychological impact on victims, including trauma and mentalhealth disorders. This verbal violence is a serious violation of human rightsand is regulated in Law No. 23/2004 on the Elimination of DomesticViolence. This research emphasizes the importance of understanding thefactors that cause verbal violence, such as economic conditions, socialnorms, and psychological factors, to formulate more effective preventionstrategies in addressing the issue of domestic violence.Keyword:Verbal Abuse, Husband And Wife, Pre-Prosperity,Crime
