Abstract

In Balunganyar Village, Lekok, Pasuruan, access to information about public services is still limited. Most people in this village do not fully understand the types of services provided by the village government, the procedures for accessing these services, and the benefits that can be obtained. Based on the background that has been explained, there are several problems that need to be resolved through this program, namely how to increase awareness and understanding of the Balunganyar Village community about public services available in the village, then how to utilize video media as an effective communication tool in conveying public service information. The implementation of this PkM program uses a participatory approach, where the Balunganyar Village community is actively involved in the entire activity process, from planning, training, to evaluation. This approach was taken because active community participation is considered the key to success in improving their understanding and independence.

Abstract

The concept of force majeure is essential in business agreements in Indonesia, as it regulates the release of contractual obligations that cannot be fulfilled due to events beyond their control such as natural disasters, pandemics, conflicts, or government policies. This study examines force majeure clauses in business agreements in Indonesia from a normative juridical perspective, focusing on the legal framework, its application practices, and its legal implications for contractual certainty. Using normative juridical qualitative methods, data were analyzed from the Civil Code (KUHPerdata) Articles 1244–1245 and 1444–1445, legal doctrine, and literature. The results of the study underlined that the force majeure clause has a strong legal basis in the Civil Code, which exempts the affected party from the obligation of compensation if the failure to perform the obligation is caused by events beyond his control. The application of this clause in the contract allows for the revision, postponement, or termination of a temporary contract, thereby guaranteeing legal certainty and protecting the principles of good faith and contractual fairness. In addition, the formulation of detailed clauses in the contract is crucial to prevent potential legal disputes down the road and ensure fair protection for all parties involved in the business agreement.

Abstract

Intiasri Penelitian ini mengkaji perlindungan hukum pekerja perempuan dalam hubungan kerja fleksibel di Indonesia, dengan fokus pada kekosongan norma dan urgensi reformulasi hukum. Hubungan kerja fleksibel seperti perjanjian kerja waktu tertentu, kerja proyek, alih daya, dan platform digital menawarkan efisiensi bagi dunia usaha, tetapi menimbulkan kerentanan bagi pekerja perempuan. Ketidakjelasan perlindungan terhadap hak-hak reproduksi, jam kerja, jaminan penghasilan, dan keberlanjutan hubungan kerja menempatkan pekerja perempuan pada posisi yang rentan, sekaligus memperkuat ketimpangan gender. Penelitian ini menggunakan pendekatan kualitatif normatif, melalui studi kepustakaan dan analisis regulasi ketenagakerjaan. Hasil menunjukkan bahwa kekosongan norma hukum tidak hanya bersifat teknis, tetapi berdampak sistemik terhadap keadilan gender. Perlindungan berbasis status kerja tidak mampu mengakomodasi kebutuhan pekerja perempuan yang menghadapi beban biologis, sosial, dan ekonomi. Oleh karena itu, diperlukan reformulasi hukum yang inklusif, adaptif, dan responsif gender, dengan prinsip inklusivitas untuk seluruh bentuk hubungan kerja fleksibel, fleksibel terhadap dinamika pasar kerja dan teknologi, serta keadilan substantif untuk menjamin hak-hak fundamental pekerja perempuan. Reformulasi hukum harus mencakup perlindungan kontraktual, pengawasan efektif, hak maternitas, pengaturan jam kerja manusiawi, jaminan keberlanjutan hubungan kerja, dan akses pengembangan karier. Dengan demikian, hubungan kerja fleksibel tidak lagi menjadi ruang abu-abu hukum yang merugikan pekerja perempuan, tetapi dapat berfungsi sebagai instrumen pemberdayaan, kesejahteraan, dan kesetaraan gender.
