Abstract

This study discusses the obstacles faced by the Business Competition Supervisory Commission (KPPU) in enforcing competition law, with a focus on the difficulty in obtaining adequate evidence, the lack of authority to force related parties, and the unclear procedures that can harm the reporter and the reported. The research method used is a normative legal approach with an analysis of Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The main findings show that the KPPU faces serious obstacles in enforcing the law due to the lack of direct execution authority, non-transparent procedures, and the lack of legal protection for reporters. This study recommends several steps, including synchronizing Law No. 5 of 1999 with civil procedural law, granting direct execution authority to the KPPU, adding more stringent and effective sanctions, and increasing coordination between law enforcement agencies to accelerate the implementation of decisions and create a healthier and fairer business competition system.

Abstract

Penelitian ini mengeksplorasi realitas suku Baduy dalam menghadapi tantangan global, dengan penekanan pada penggunaan hukum adat Baduy sebagai alat mengikat. Pendekatan kualitatif dipilih untuk memahami lebih dalam realitas sosial mereka, mengakui bahwa kesadaran individu membentuk realitas sosial. Triangulasi sumber dan teori digunakan untuk memvalidasi data. Lokasi penelitian berada di Desa Kanekes, Banten, dihuni oleh suku Baduy yang menjalankan tradisi adat dengan kuat. Mereka meneruskan budaya mereka melalui transmisi lisan dan praktik yang turun-temurun. Ini menjaga nilai-nilai budaya mereka relevan. Perbedaan antara Baduy Luar dan Baduy Dalam memberikan wawasan tentang bagaimana dua kelompok menghadapi perubahan zaman. Baduy Luar menunjukkan fleksibilitas dalam memadukan budaya dengan nilai tradisional, sambil terbuka terhadap modernitas. Sebaliknya, Baduy Dalam menekankan pentingnya pendidikan internal dan organisasi dalam mempertahankan budaya mereka, mengambil isolasi sebagai sarana untuk menjaga kesinambungan budaya yang unik. Penelitian ini merinci proses pengumpulan, reduksi, penyajian data, dan verifikasi, mengacu pada kerangka kerja yang ditawarkan oleh Pudjiastuti. Secara keseluruhan penelitian ini memberikan wawasan tentang bagaimana suku Baduy mempertahankan budaya mereka dalam menghadapi dinamika perubahan zaman.

Abstract

Indonesia is a country of law (Rechsstaat) not a country of power (Machtstaat). Therefore, it must be the Commander, the law is not a tool of the ruler or businessman, the law does not belong to the ruler or businessman, as mandated by the 5th principle of Pancasila, “Social Justice for All Indonesian People”. “Equality before the law” all are equal before the law, no discrimination is the hope of all Indonesian people. On the other hand, corruption creates social inequality, the distance between the rich and the poor is getting further, and corruption has hampered development and social welfare. Corruption will continue to grow until the justice system can punish perpetrators of crimes and keep government authority under control. When justice is “bought” or intervened politically, the people are the victims who suffer. Das solen and das sein are two very different things, the law that is aspired to, the ideal law with the reality in society, the law that should occur in society with the law that occurs in society there is a disparity. Legal discrimination is a serious obstacle in upholding justice according to the expectations of the community, the perpetrators of corruption will continue to increase and increase and will not have a deterrent effect, if there are no concrete efforts to eradicate corruption. Leaders must pay serious attention and guarantee the independence of institutions that enforce the law to eradicate corruption. Now is the right time to end impunity for corruption.
