Abstract

Hubungan kesejahteraan hakim dengan kualitas putusan menjadi legal issue yang menarik. Disamping secara teoritik belum banyak yang membahas, juga secara empiris topik ini menjadi pembicaraan massif khususnya di kalangan para hakim. Artikel ini menjadi salah satu kontribusi penting dan original untuk mengisi kekosongan penelitian terkait relasi kesejahteraan hakim dengan kualitas putusan. Penelitian didasarkan pada tiga rumusan masalah 1) Bagaimana pandangan hakim terkait gaji saat ini dan gaji yang diharapkan? 2) Bagaimana relasi dan pengaruh antara kesejahteraan hakim dengan kualitas putusan? 3) Bagaimana konstruksi relasi kesejahteraan hakim dengan kualitas putusan yang berkeadilan?. Penelitian ini termasuk dalam penelitian hukum empiris dengan pendekatan socio legal. Adapun teknik pengumpulan bahan hukum dan data diperoleh dengan wawancara mendalam terhadap responden yang telah ditetapkan dengan teknik purposive sampling. Temuan studi menghasilkan; Pertama, kesejahteraan hakim masih relatif kurang, hal ini dilihat dari sisi tanggung jawab profesi dan beban kerja serta dari beberapa perbandingan gaji hakim di beberapa negara. Kedua, terdapat hubungan tidak langsung antara kesejahteraan hakim dengan kualitas putusan dan hubungan keduanya berpengaruh positif. Ketiga, konstruksi relasi positif antara kesejahteraan hakim dengan kualitas putusan. Hal ini dilegitimasi secara teoritik baik dari perspektif teori ekonomi maupun realisme hukum. Sedangkan secara empiris disimpulkan bahwa meskipun kesejahteraan hakim tidak menjadi instrumen untuk menghasilkan putusan yang berkeadilan tetapi secara empiris kesejahteraan hakim adalah sebuah keniscayaan.

Abstract

Sexual violence against children in Indonesia continues to increase every year. Perpetrators of violence come from various backgrounds, including those closest to the victim. Sexual violence can occur in various places, including in homes that should be the safest place for children. This study aims to analyze the implementation of legal protection for child rape victims in the family environment. This research is empirical legal research, namely legal research based on facts in the field or direct observation. This research uses qualitative descriptive methods and uses data collection through observation, interviews and documentation at the Technical Implementation Unit of the Women and Children Protection Area (UPTD PPA) Sidoarjo Regency. Thegovernment has issued implementing regulations for the Child Protection Law through Government Regulation No. 78 of 2021 concerning Special Protection for Children, which includes special protection for child victims of sexual crimes. Special protection for children is carried out in the Regional Technical Implementation Unit referring to established service standards. The results of this study concluded that the government imposed a penalty for perpetrators of child rape in the family environment with an additional penalty of 1/3 (one-third) of the criminal threats that should be received and UPTD PPA Sidoarjo Regency has implemented legal protection in accordance with applicable regulations Starting from mentoring, psychological assistance and others. However, there are still several problems that hinder the implementation of child protection such as low public awareness, insufficient reporting rates, unpreparedness of witnesses, and other factors that can hinder the judicial process.

Abstract

This study aims to examine the efforts and challenges faced by the East Java Regional Police in enforcing the law against e-commerce fraud, which has become increasingly prevalent in the digital era. The research employs a qualitative method with a juridical-empirical approach and a descriptive research type, by collecting primary data through direct interviews with the Head of the Cyber Unit at the East Java Regional Police and victims of fraud, as well as secondary data from legislation such as the Indonesian Penal Code (KUHP) and Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law), supplemented by secondary and tertiary legal materials from various relevant literature and sources. The data analysis was conducted using triangulation by combining various data sources to enhance the validity of the findings. The results show that the East Java Police have made systematic efforts to enforce the law on e-commerce fraud, including digital data analysis, cyber forensic involvement, and coordination with financial authorities such as OJK and Bank Indonesia. However, the effectiveness of these efforts is hindered by technological limitations, a lack of skilled human resources, low digital literacy among the public, and suboptimal regulatory support and collaboration with e-commerce platforms. Therefore, strengthening institutional capacity and inter-agency synergy is essential to address the growing challenges of digital crime.

Abstract

This study investigates the impact of judicial welfare particularly salary structures, allowances, and institutional support on the quality of judicial decisions in Indonesia. Amid a wave of reform marked by Government Regulation Number 44 of 2024 and the 2025 salary adjustment policy, questions persist regarding whether financial improvements alone can ensure judicial independence and reasoning integrity. Using a normative legal research approach combined with doctrinal analysis and comparative jurisprudence, this paper examines salary disparities, workload imbalances, and structural gaps across judicial tiers. Findings reveal that trial-level judges continue to face excessive caseloads, inadequate access to legal resources, and limited professional development despite recent financial reforms. These structural deficiencies contribute to formalistic adjudication, reduced legal innovation, and vulnerability to ethical fatigue. The study affirms that judicial welfare reform must go beyond monetary adjustments and integrate performance-based incentives, reasoning-focused evaluation systems, and equitable institutional infrastructure. Drawing on theories of justice and motivation, the research offers a multidimensional framework for understanding how welfare structures influence judicial output. It concludes that sustained judicial quality and independence require a holistic policy response that bridges normative ideals and institutional realities.

Abstract

This article examines judicial reasoning and sentencing proportionality in West Jakarta District Court Decision No. 96/Pid.Sus/2023/PN Jkt.Brt concerning Teddy Minahasa Putra, a senior police officer convicted of participating in narcotics trafficking. The defendant was sentenced to life imprisonment, and the sentence was subsequently upheld at the appellate and cassation levels. This study employs normative legal research using statutory, case, and conceptual approaches. Primary legal materials include the Indonesian Narcotics Law, the Police Law, the Judicial Power Law, the Criminal Procedure Code, and the relevant court decisions. The court’s reasoning is evaluated by examining the fulfilment of Article 114 paragraph (2) of Law No. 35 of 2009 in conjunction with Article 55 paragraph (1), point 1, of the Criminal Code, as well as principles of retribution, deterrence, prevention, proportionality, and substantive justice. The findings indicate that the conviction was supported by evidence of coordinated participation in the diversion and distribution of methamphetamine controlled by the police. Life imprisonment was legally available and substantively proportionate to the quantity of narcotics, the defendant’s degree of participation, the abuse of command authority, and the resulting damage to public trust. Nevertheless, the judgment should have explained more systematically how each aggravating and mitigating circumstance supported the selection of life imprisonment over other legally available sanctions. This article proposes a more structured framework for assessing judicial reasoning in serious narcotics cases involving law enforcement officers.
