Abstract

Fiscal policy is a fundamental tool for achieving macroeconomic goals such as economic stability, growth, and income equality. This study explores the concept and philosophy of fiscal policy, emphasizing its role in both modern and historical contexts, including its implementation during the Prophet Muhammad’s era. Employing a qualitative methodology with a literature review approach, the research analyzes fiscal policy instruments, including taxes, subsidies, debt, and state budget expenditures, particularly within the Indonesian context. Findings reveal that fiscal policy reflects Keynesian principles, emphasizing government intervention to address market inefficiencies, stabilize the economy, and promote equitable growth. Historical analysis highlights the philosophical alignment of fiscal policies during the Prophet Muhammad’s time with modern practices, focusing on justice, equality, and sustainability through instruments like zakat, kharaj, and wakaf. The study underscores the effectiveness of fiscal policy during crises, such as the COVID-19 pandemic, in mitigating severe economic impacts and fostering long-term development. To optimize fiscal policy, this research suggest that governments should enhance transparency, accountability, and technological integration to improve resource management and efficiency. Additionally, adopting principles of equity and sustainability from historical Islamic fiscal policies and fostering collaboration among stakeholders can address contemporary economic challenges while upholding philosophical foundations.

Abstract

The main issue in this study is how the role of fatwa in the process of drafting qanun, as well as its implications in legal practice, especially in the context of the relationship between fiqh, fatwa, and qanun. The purpose of this study is to analyze the interaction between fiqh, fatwa, and qanun in the Islamic legal system, as well as to explore how fatwa can influence legal policies in line with Islamic principles. The research method used is a qualitative approach through literature study analysis and case studies, focusing on the application of fatwa in qanun, particularly in Indonesia. The main results achieved show that fiqh provides the basis for issuing practical fatwas, which then become the basis for drafting qanuns. Although fatwas are not legally binding, they have an important role in shaping public policy, influencing social norms, and providing legitimacy to legislation based on Islamic principles, as seen in MUI fatwas related to zakat and halal products. However, the implementation of fatwa in qanun faces major challenges, such as constitutionality, public acceptance, and the low level of fatwa socialization.

Abstract

This study aims to examine the economic impact of usury (riba) on Islamic economics and the challenges faced in applying Islamic economic principles in the context of economic globalization. Riba, which is strictly prohibited in Islamic law, is seen as a source of economic injustice that exacerbates social and economic inequalities. The research analyzes how the principles of social justice and balance, which are the foundation of Islamic economics, can offer solutions to the inequality issues caused by the interest-based system. Through a literature analysis and case study approach, it was found that while the application of Islamic economics faces significant challenges in the context of the global capitalist system, the principles embedded in Islamic finance, such as justice, balance, and social sustainability, can provide a more stable and ethical alternative. The findings of this study suggest that Islamic economics has the potential to offer solutions to global economic instability and contribute to more equitable economic sustainability. This research also provides suggestions for future studies on the implementation of Islamic economics in a financial world increasingly influenced by digitalization and financial technologies.

Abstract

Income distribution inequality, unequal access to resources, and high poverty levels indicate that the current economic in Indonesia system still faces challenges in achieving social justice. Islamic economic principles emphasize the importance of fair wealth distribution through mechanisms such as zakat and waqf, which serve as social safety nets for underprivileged groups. This study analyzes the allocation and distribution of national income from the perspective of Islamic law, focusing on the implementation of zakat and waqf as key instruments in income redistribution. The research employs a normative-conceptual approach by analyzing Islamic legal sources and academic literature related to state fiscal policies from the perspective of Islamic economics. The findings indicate that optimal management of zakat and waqf can enhance societal welfare and strengthen economic justice. The government plays a crucial role in regulating and integrating Sharia principles into fiscal policies, including centralized zakat management and market regulations that prevent monopolistic practices and economic exploitation. As a recommendation, a professional and transparent zakat and waqf administration system is needed to improve the effectiveness of fund distribution.
