Abstract

Kecamatan adalah instansi pemerintah yang bertanggung jawab langsung melayani dan berinteraksi dengan masyarakat. Sayangnya, banyak kecamatan yang tidak bisa memberikan pelayanan optimal karena sistem yang ada belum terkomputerisasi. Banyak kota daerah masih kekurangan alat pertukaran informasi. Oleh karena itu, tujuan dari penelitian ini adalah untuk mengkomputerisasikan sistem pelayanan masyarakat dengan membangun sistem pelayanan masyarakat secara online yang nantinya akan diterapkan di kecamatan untuk membantu kabupaten dalam meningkatkan jangkauan dan pelayanan masyarakat. Dalam penelitian ini, penulis menggunakan metode pengumpulan data observasi dan wawancara. Metode analisis sistem yang digunakan penulis adalah metode PIECES. Metode perancangan sistem yang digunakan oleh penulis adalah metode waterfall. Metode ini dipilih karena sistem yang akan dibangun sangat luas. Hasil dari penelitian ini adalah sebuah aplikasi sistem informasi pelayanan administrasi berbasis website, yang nantinya dapat membantu dinas wilayah untuk menginformasikan kepada masyarakat dan memaksimalkan tenaga kerja dinas.

Abstract

The ongoing family conflicts cannot be separated from the neglect of the position of the husband and wife in Islamic family law, known as nusūz. The purpose of this study is to understand Mufassireen's interpretation of nusyūz. This study is a qualitative research, a literature survey with an interdisciplinary approach - philosophical, Historical, psychological, sociological, and Islamic law approach - and a descriptive analysis from various sources such as tafsir, hadith, Islamic Yurisprudance, legal maxim and legislation. The meaning of nusyūz in al-Nisa 4:34 according to Mufassireen is similar. The difference between classical mufassirs and contemporary mufassirs is that classics allow and contemporary ones reject wife beating. There is also an interpretation of verse al-Nisa 128, where commentators argue that the husband's nusūz means relinquishing rights and obligations due to polygamy and unequal living, and the form of resolving the husband's nusūz is through advice and mediation. The judge's decision in resolving husband and wife nusu'us problems was the judge's reference to al-Baqarah paragraph 241, School Al-Dzahiriyah Article 39 paragraph 2 of Law Number 1 of 1974 concerning Marriage, Articles 149 and 241 Compilation of Islamic Law of 1991 as the implementation of takhsis al- qada is based on benefit which refers to the Islamic legal maxim Hukm al-Hakim Yarfa al-Khillaf, Tassaruf al-Imam Ra'iyah Ala Manut bi al-Maslahah.

Abstract

The settlement of joint property between husband and wife after divorce often ends up in the Religious Court, even reaching the level of cassation and judicial review (PK), such as in the Supreme Court Decision Number Register 159/K/AG/2018. In this case, especially related to disputes over joint property in marriages with minor children, the Supreme Court not only refers to the normative law contained in the law, but also considers a sense of justice and benefit. This research uses a qualitative descriptive method with an empirical juridical approach. This approach is referred to as empirical legal research because it focuses on analyzing the implementation of normative legal provisions directly (in action) in certain legal events in society. Primary data was obtained from Supreme Court decision No 159 K/Ag/2018, No 618/Pdt.G/2012/PA.Bkt, No 38/Pdt.G/2013/PTA.Pdg, No 88K/Ag/2015, No 159/K/AG/2018, No 99/Pdt.G/2023/MS, as well as laws related to the research being discussed. Secondary data is obtained from books, scientific articles and previous research results related to joint property and those that have the same discussion. Data collection techniques using literature study and qualitative data analysis are used to explore certain phenomena and find out the causes. The results showed that the Supreme Court judge in deciding this case used the method of legal discovery through legal interpretation, especially systematic interpretation and sociological interpretation. In the case, the judge postponed the division of joint property until the children of the disputing parties reached the age of mumayyiz, thus showing attention to aspects of substantive justice. Systematic and sociological legal interpretations by judges show that in resolving post-divorce joint property disputes, especially those involving minors, judges must consider the social realities that live in society to actualize justice. This emphasizes the role of judges not only as law enforcers, but also as guardians of the public good. This research concludes that legal discovery by judges through interpretation based on systematic and sociological approaches can realize concrete justice in society, especially in divorce cases involving children.

Abstract

Contemporary Islamic economics requires innovation in contract implementation to address modern challenges. This research examines the fundamental reasoning and philosophical aspects of combined contracts (hybrid) through a descriptive-analytical approach, considering both normative and doctrinal aspects of Islamic law. The study reveals that hybrid contracts are the result of juristic reasoning (ijtihad) aimed at creating adaptive financial instruments while maintaining compliance with Shariah principles. The development of these hybrid formats is conducted rationally to maximize benefits for Islamic business practitioners. Several forms of hybrid contracts that have evolved include Mudharabah Musytarakah (partnership and profit-sharing), Musyarakah Mutanaqisah (asset ownership financing), al-Musyarakah al-Muntahiyah bi al-Tamlik (gradual partnership), and al-Ijarah al-Muntahiyah bi al-Tamlik/IMBT (lease with ownership option).

Abstract

This research aims to analyze the application of the maslahah principle in the transformation of waqf law in Indonesia and its impact on social welfare. the importance of effective and sustainable waqf management to improve the quality of life of the community. The research method used is a qualitative approach with normative analysis, which examines the regulations and practices of waqf management in Indonesia. The research results show that the maslahah principle is applied in the transformation of waqf law in Indonesia through integration with various policies and regulations governing the management of waqf assets. Law Number 41 of 2004 concerning Waqf has integrated the principle of maslahah by determining that the management of waqf assets must be carried out in the public interest and can provide maximum benefits for the community. The impact of the maslahah philosophy on social welfare in the context of waqf is very significant, where the application of this principle has increased the effectiveness and efficiency of waqf asset management, so that it can be used for various social programs such as education, health and social infrastructure. Real examples such as productive waqf management, istibdal of waqf assets, and the formation of the Indonesian Waqf Board (BWI) show how the principle of maslahah can directly improve community welfare.

Abstract

Hoarding in Islam is known as ihtikar, meaning hoarding behavior, which is one part of monopolistic practices. This hoarding behavior hurts the supply of goods in the market, so it can cause instability in the availability of goods and demand for goods and can result in market distortions. This research uses normative juridical, with a qualitative approach based on library research. Many business actors conduct monopolies by setting higher prices; according to business law in Indonesia, such monopolistic practices are strictly prohibited. In Islamic law, monopoly is allowed under restrictions and provisions based on the Koran and Hadith. Monopolies are permitted as long as they do not carry out hoarding (Ihtikar), especially goods that become staple foodstuffs or are related to the livelihood of many people. The role of government is to control monopolies and maintain stability by making regulations and direct intervention.

Abstract

This study aims to examine the economic impact of usury (riba) on Islamic economics and the challenges faced in applying Islamic economic principles in the context of economic globalization. Riba, which is strictly prohibited in Islamic law, is seen as a source of economic injustice that exacerbates social and economic inequalities. The research analyzes how the principles of social justice and balance, which are the foundation of Islamic economics, can offer solutions to the inequality issues caused by the interest-based system. Through a literature analysis and case study approach, it was found that while the application of Islamic economics faces significant challenges in the context of the global capitalist system, the principles embedded in Islamic finance, such as justice, balance, and social sustainability, can provide a more stable and ethical alternative. The findings of this study suggest that Islamic economics has the potential to offer solutions to global economic instability and contribute to more equitable economic sustainability. This research also provides suggestions for future studies on the implementation of Islamic economics in a financial world increasingly influenced by digitalization and financial technologies.

Abstract

Guru menggunakan model pembelajaran Example non Example dalam menciptakan pembelajaran yang interaktif dan edukatif. Tujuan dari penelitian ini adalah untuk mengetahui keaktifan siswa selama penerapan model pembelajaran Example non Example. Penelitian ini menggunakan desain penelitian quasi-eksperimen dengan dua kelompok yaitu kelompok kontrol dan kelompok eksperimen. Hasil penelitian ini menunjukkan bahwa terdapat perbedaan skor hasil belajar pada kelas kontrol dengan kelas eksperimen. Rata-rata hasil belajar kelas eksperimen 1,85 lebih besar dibandingkan dengan kelas kontrol. Perbedaan tersebut disebabkan model Example non Example membuat siswa lebih aktif didalam proses pembelajaran.
