Abstract

ABSTRAKTindakan medis di luar kewenangan klinis yang dilakukan oleh tenaga medis dalam pelayanan kesehatan merupakan isu penting yang dapat mempengaruhi kualitas dan efektivitas layanan kesehatan. Tenaga medis yang memiliki Surat Tanda Registrasi (STR) dan Surat Izin Praktik (SIP) seharusnya menjalankan praktik kedokteran sesuai dengan kewenangannya. Namun, dalam beberapa kasus, tenaga medis melakukan tindakan di luar batas kewenangannya, yang berpotensi menimbulkan dampak hukum. Penelitian ini bertujuan untuk menganalisis pengaturan hukum terhadap sanksi administrasi bagi tenaga medis yang melakukan tindakan medis di luar kewenangan klinisnya berdasarkan Peraturan Pemerintah Nomor 28 Tahun 2024 sebagai peraturan pelaksana dari Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan serta analisis terhadap bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa bentuk sanksi administrasi yang dapat dikenakan terhadap tenaga medis meliputi teguran lisan, peringatan tertulis, denda administratif, dan/atau pencabutan izin. Pelaksanaan sanksi administrasi ini bertujuan untuk menegakkan kepatuhan terhadap standar hukum dalam praktik medis serta meminimalkan potensi pelanggaran serupa di masa mendatang. ABSTRACT Medical actions outside the clinical authority performed by medical personnel in health services are an important issue that can affect the quality and effectiveness of health services. Medical personnel who have a Registration Certificate (STR) and a Licence to Practice (SIP) should practice medicine in accordance with their authority. However, in some cases, medical personnel perform actions outside the limits of their authority, which has the potential to cause legal impacts. This study aims to analyse the legal regulation of administrative sanctions for medical personnel who perform medical actions outside their clinical authority based on Government Regulation No. 28 of 2024 as an implementing regulation of Law No. 17 of 2023 on Health. This research uses a normative juridical method with a statutory approach and analysis of primary and secondary legal materials. The results show that the forms of administrative sanctions that can be imposed on medical personnel include verbal reprimands, written warnings, administrative fines, and/or licence revocation. The implementation of these administrative sanctions aims to enforce compliance with legal standards in medical practice and minimise the potential for similar violations in the future.

Abstract

The omnibus law concept refers to an approach that consolidates numerous regulations into a single regulatory framework. In 2023, the government applied this concept to Law Number 17 of 2023 on Health, with the objective of reforming health services to improve the health status of the Indonesian population and to address current and future health issues. However, various problems occurred during the drafting process, which affected the substance contained in the Health Law. The purpose of this study is to analyze the omnibus law concept and its influence on the Health Law. The research method employed is normative juridical, using a statutory approach by examining the Health Law and Government Regulation Number 28 of 2024 concerning the implementing regulations of the Health Law, as well as a conceptual approach. The results of this study indicate that the drafting process of the Health Law was conducted within a short period and did not adequately observe the principle of public participation, limiting public access to information regarding the substance of the law. This condition generated polemics within society and influenced substantive changes, including concerns from professional organizations that the Health Law removes their authority to supervise medical and health personnel, the expansion of authority in the supervision of the distribution of drugs and medical devices by BPOM, and the emergence of legal protection for pharmacists not only when performing their duties in pharmacies but also in extraordinary circumstances. The novelty of this research lies not only in examining the legislative process but also in analyzing substantive changes within the Health Law. Accordingly, this study provides a new perspective for future empirical research to examine the implementation of the Health Law.
