Abstract

An authentic deed is known as the strongest and most legally binding evidence in legal proceedings. However, its integrity can be compromised when fraudulent data is incorporated, leading to the degradation of its evidentiary value. This research aims to analyze the legal implications of authentic deeds that have been degraded due to data falsification and to explore the notary’s responsibility in such cases. This research used normative juridical approach, this study examined statutory regulations, court decisions, and legal doctrines related to document authenticity. The findings indicate that an authentic deed containing falsified data may lose its status as a perfect piece of evidence and be downgraded to an underhand deed, depending on the extent of the forgery. Additionally, notaries may be held accountable if negligence is proven in verifying the validity of the data. This research contributes to a better understanding of the legal protection mechanisms for parties involved in notarial transactions and highlights the importance of strict verification procedures to uphold the authenticity of legal documents.

Abstract

Back date agreement is an agreement made to accommodate past legal actions. The back date agreement is basically made based on the agreement of the parties so that it generally does not cause harm to the parties. Problems arise if this back date agreement is made in the form of an authentic deed, this is because Article 16 paragraph (1) letter m of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Positions states that: In carrying out his position, the Notary is obliged to: read the deed before an appearance in the presence of at least 2 (two) witnesses, or 4 (four) witnesses specifically for the making of an underhand will, and signed at the same time by the appearer, witness, and Notary." The results of this study indicate that agreements made on a back date, both in the form of oral agreements, underhand deeds, and authentic deeds, basically have fulfilled the legal requirements of the agreement as referred to in Article 1320 of the Civil Code, so that it has legal.

Abstract

Penelitian ini mengeksplorasi perdebatan mendasar dalam filsafat hukum mengenai keterkaitan antara hukum, moralitas, dan keadilan melalui kajian terhadap lima aliran utama, yaitu positivisme hukum, teori hukum alam, konsep moralitas internal Lon L. Fuller, interpretivisme Ronald Dworkin, serta hukum progresif Satjipto Rahardjo. Permasalahan ini berangkat dari persoalan klasik tentang tarik-menarik antara kebutuhan akan kepastian hukum dan tuntutan keadilan substantif, yang hingga kini masih menjadi tantangan dalam membangun sistem hukum modern. Tujuan utama penelitian ini adalah memberikan pemahaman menyeluruh mengenai fondasi teoritis yang membentuk kerangka pembentukan dan penerapan hukum, sekaligus menelaah relevansi kelima aliran tersebut terhadap praktik penegakan hukum di Indonesia. Metode penelitian yang digunakan adalah studi kepustakaan dengan pendekatan analisis kualitatif-komparatif, yaitu dengan membandingkan pemikiran para tokoh dan implementasinya dalam konteks sistem hukum nasional. Temuan penelitian menunjukkan bahwa masing-masing teori memiliki kontribusi dan keterbatasannya: positivisme menekankan pentingnya kepastian hukum, teori hukum alam berorientasi pada keadilan, Fuller menyoroti aspek moralitas prosedural, Dworkin menegakkan integritas dalam penafsiran hukum, sedangkan Satjipto menawarkan pembaruan hukum yang lebih adaptif dan kontekstual. Berdasarkan hasil analisis, disimpulkan bahwa pengembangan sistem hukum yang ideal memerlukan pendekatan integratif dengan memadukan unsur kepastian, keadilan, dan nilai kemanusiaan guna membangun hukum yang lebih responsif terhadap dinamika sosial masyarakat.
