Abstract

Penelitian ini membahas problematika dualisme regulasi dalam praktik ekonomi syariah di Indonesia, yang muncul akibat belum maksimalnya sinkronisasi antara norma fikih muamalah dan hukum nasional. Meskipun telah terdapat berbagai peraturan perundang-undangan yang mengatur tentang ekonomi syariah, seperti Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah dan regulasi dari OJK, masih terdapat ketidaksesuaian dan ketidakkonsistenan antara substansi hukum positif dengan prinsip-prinsip syariah. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui studi kepustakaan, kemudian dianalisis secara kualitatif dengan teknik interpretasi sistematis dan teleologis. Hasil penelitian menunjukkan bahwa upaya harmonisasi regulasi ekonomi syariah harus memperhatikan prinsip maqashid syariah dan menjembatani perbedaan antara hukum positif dan hukum Islam secara konstruktif, agar tercipta kepastian hukum, keadilan, dan kemaslahatan dalam praktik ekonomi syariah di Indonesia.

Abstract

Waqf, as an important form of financial worship, has significant economic potential and has evolved from traditional forms such as land and buildings to innovations like cash waqf, which is more flexible for developing productive enterprises. Although the potential for cash waqf in Indonesia is very high, reaching Rp180 trillion per year according to the Indonesian Waqf Board, its management is not yet optimal. The aim of this research is to analyze and compare the development of Sharia stock benefit waqf as a form of productive waqf modernization in Indonesia and Malaysia, and to identify its development potential to increase the effectiveness and benefits of waqf in the context of modern Islamic economics. This research uses normative legal research methods with statutory and conceptual approaches, focusing on analyzing regulations and legal concepts related to Sharia stock benefit waqf in Indonesia and Malaysia. Legal sources include primary, secondary, and tertiary materials, with data collection techniques through literature study and data analysis using a comparative qualitative approach. The research results show that stock waqf has been implemented in Indonesia and Malaysia in accordance with applicable regulations, with differences in the institutional structure of its management. In Indonesia, stock waqf is regulated by the Ministry of Religion, the Indonesian Waqf Board, and the National Sharia Council, while in Malaysia it is managed by the State Islamic Religious Council in each state. Indonesia focuses on Sharia stock waqf or its profits, while Malaysia raises funds through share offerings to finance specific programs. Nevertheless, the potential for stock-based waqf in both countries has not been optimally maximized. Factors influencing development in Indonesia include stock waqf literacy, nazir capacity, and inefficient digitalization, while in Malaysia it is constrained by regulatory inconsistencies between states, lack of a transparent and accountable regulatory framework, and limited regulations on mechanisms for collecting and distributing cash waqf including shares.

Abstract

The development of Islamic financing through the Ijarah Muntahiyah Bittamlik (IMBT) contract shows fundamental differences in contract structure and regulatory approach between Indonesia and Malaysia, which have implications for the application of the principles of freedom of contract and certainty of Islamic law. The research gap is still evident in the lack of comparative studies linking the differences in the structure of the IMBT contract with legal culture, maqasid shariah, and judicial practices in Indonesia. This study aims to analyze and compare the application of the principles of freedom of contract and certainty of Islamic law in IMBT in Indonesia and Malaysia. The research method used is normative juridical with a comparative legal approach, through analysis of laws and regulations, fatwas of Islamic authorities, regulatory policies, and relevant court decisions. The research findings show that: (1) Indonesia emphasizes the formal separation of ijarah and tamlik contracts to maintain legal certainty and Islamic prudence; (2) Malaysia adopts an integrated wa'd- based contract structure with a substantive approach and is oriented towards maqasid shariah; and (3) these differences reflect variations in legal culture and sharia governance models in each country. The implications of this research emphasize the importance of harmonizing formal legal certainty and substantive interests in the development of IMBT contracts, in order to encourage sharia financing that is more adaptive, fair, and responsive to the dynamics of the Islamic financial industry.
