Abstract

Patients have the right to accept and refuse treatment, and the right to receive information from their doctor before giving Consent to Medical Action. Patients have the right to self-determination as a basis for human rights, and the right to information owned by the patient about their illness and what medical action is to be performed on them. To find out the hymen examination carried out by medical personnel or health workers who meet the principles of propriety and do not violate professional ethics. The research method used in this study is in accordance with normative juridical supported by prescriptives related to the protection of women's human rights against medical actions regarding hymen examination using the 'two-finger' test method. The results of the study on secondary data (primary, secondary and tertiary legal materials), then obtained on the technical implementation of the examination contained in the Standard Operating Procedure Guidelines for the Implementation of Minimum Service Standards (SPM) in the Field of Integrated Services for Women and Children Victims of Violence. The conclusion is that hymen examination using the 'two finger' test method is very contrary to the law, both in terms of the Medical Practice Law, contrary to the medical code of ethics, contrary to the regulations of the Minister of Health, contrary to Human Rights and contrary to the recommendations of the World Health Organization (WHO).

Abstract

The application of virtual autopsy to help determine the cause of death, which can be studied from ethical, bioethical, medicolegal, socio-cultural and religious aspects, although the literature discussing it is not too much, besides the professionalism of the medical personnel involved and multidisciplinary cooperation are formed into good ethical aspects of Virtual autopsy. The collection of data obtained from virtual autopsy is expected to complement conventional autopsy and also as a learning experience if conventional autopsy is not possible to carry out, although currently conventional autopsy is still the gold standard for forensic examination. The research method used in this study is normative juridical supported by prescriptives related to virtual autopsy as one of the enforcers of the cause of death. Based on the results of research on secondary data (primary legal materials), it was found that in the Regulation of the Minister of Health of the Republic of Indonesia Number 38 of 2024 concerning Medical Services for Legal Interests, it is stated that Virtual autopsy (Post Mortem CT Scan) can be applied to help establish the cause of death. This regulation aims to provide guidelines and regulations related to the implementation of medical services related to legal interests, including procedures, infrastructure, medical devices, and parties involved.

Abstract

Di Indonesia, pencatatan mengenai sebab kematian belum tertata dalam suatu sistem yang terpadu antara Kementerian Kesehatan maupun Kementerian Dalam Negeri, sebab pencatatan sebab kematian di suatu negara memberikan asupan penting bagi para pengambil keputusan dalam menentukan kebijakan dan program kesehatan. Untuk memenuhi kepentingan statistik penyebab kematian yang menginformasikan seluruh data dalam masyarakat, maka diperlukan suatu pencatatan penyebab kematian yang memenuhi standar internasional. Surat keterangan Kematian (SKK) merupakan instrumen pencatatan penyebab kematian yang memenuhi kriteria Internasional Clasification of Disease -10 (ICD-10) yang bisa digunakan oleh dokter yang merawat atau yang memeriksa almarhum/ah sebelum meninggal. Penelitian ini adalah merupakan penelitian deskriptif, dengan studi observasional secara retrospektif mengenai kelengkapan dan kesesuaian penulisan pada Surat Keterangan Kematian (Sertifikat Medis Penyebab Kematian (SMPK)) terhadap pasien yang meninggal dalam perawatan di RSPAD Gatot Soebroto. Terdapat prosentase sebesar 86,6% pengisi (pendiagnosis) sebab kematian diisi oleh dokter bukan yang merawat. Sedangkan menurut buku pedoman pengisian Surat Keterangan Kematian (SKK) bahwa yang mengisi dan menandatangani sebab kematian pada Surat Keterangan Kematian (SKK) adalah dokter yang merawat

Abstract

Hymen examination is synonymous with the 'virginity test' which is a controversial examination by medical professionals. One of the famous myths about virginity is that 'virginity' is proven by writing the appearance of "intact hymen". Along with the times, this can also have an impact on the legal field, especially health law, that examination of the hymen which is carried out by medical professionals raises pros and cons. The hymen is done by medical professionals properly and correctly when viewed from the perspective of human rights. The form of this research is normative juridical research. with a conceptual approach, while the type of research is descriptive exploratory. Examination of the hymen which can be called a virginity test is not allowed because it is not in accordance with the dignity of women and contains elements of discrimination. This is contrary to Law No. 7 of 1984 (women's convention). While the understanding that is believed to support the elimination of discrimination is the ideology of Feminism, Feminism is an ideology that views differences in women's rights based on the equality of women and men and this is interesting to discuss because of the belief that women experience injustice because of their gender.
