Abstract

The age of marriage in Indonesia according to the 1974 marriage law is 16 years for men and 16 years for women. Then the regulation was revised in law number 16 of 2019 to make the minimum age for marriage for men and women to be 19 years. Malaysia also has minimum marriage regulations in Islamic family law that states that men must be at least 18 years old and women must be at least 16 years old. This research will discuss the comparative comparison of marriage age policy rules and the philosophy of the legal rules that apply between Indonesia and Malaysia. This research uses a descriptive qualitative approach. The result of this article is that the policies made by the two countries have the same goal, one of which is preventing early marriage. And also the marriage age regulations are more effective than the regulations that apply in Malaysia, due to the very strong influence of cultural customs, they are not applied to all Malaysian people, the adult category in Malaysia is 18 years but usually the minimum marriage for women is still 16 years.

Abstract

Pandongani is the best man and bridesmaid at traditional Batak weddings. Pandongani has been around for a long time, and the existence of pandongani to accompany the bride and groom is generally known by the Batak traditional community. This research wants to examine the existence of pandongani in the study of Islamic law and customary law. This research method uses empirical juridical methods. In Islamic law there is no problem with the practice of pandongani. And according to Batak customary law, Pandongani are required to be present to accompany Batak traditional wedding ceremonies.

Abstract

Sinamot adalah tradisi dalam adat Batak pada sebelum perkawinan berlangsung. Sinamot merupakan pemberian harta benda oleh calon suami kepada calon istri sebagai bentuk keseriusan untuk hidup bersama dalam perkawinan, dan jumlahnya ditentukan dari kesepakatan antara dua belah pihak keluarga. Dalam tulisan ini akan membahas pemberian sinamot dikaji dari keadilan gender. Penelitian ini ialah yuridis-normatif yang merupakan penelitian yang mengkaji prinsip-prinsip hukum positif yang ditulis dengan menggunakan sumber pustaka atau data sekunder. Adapun hasil dari penelitian ini adalah dalam kajian keadilan gender seharusnya untuk sinamot, pihak laki-laki dan perempuan harus sama-sama memberikan harta benda sebab kegunaan sinamot yang ada di adat batak ialah untuk kemanfaatan bersama seperti acara pesta perkawinan, sidang adat dan lain sebagainya. Dikarenakan juga sinamot tidak diucapkan pada saat akad ijab kabul dan tidak tercatat jumlahnya.
