Abstract

This research discusses the Fiqh Siyasah Analysis of the Role of Supervision and Observation Judges based on Pasal 277 jo Pasal 280 of UU Number 8 of 1981 concerning Criminal Procedure Law (KUHAP) at the Menggala Class IIB District Court of Tulang Bawang Regency. The focus of this study is to evaluate the implementation of the judge's function in supervising the implementation of court decisions and reviewing its suitability with the principles of fiqh siyasah. The research used descriptive qualitative methods with data collection techniques through interviews and documentation. The results showed that the implementation of the duties of supervisory judges and observations in the field still faced obstacles such as limited human resources, lack of technical understanding, and the absence of standardized operational guidelines. In the perspective of fiqh siyasah, this role is a shar'i mandate that aims to maintain substantive justice and protect the rights of prisoners. Optimizing this role is important to ensure the implementation of the law in accordance with sharia and universal values of justice. This research is expected to enrich the study of Islamic law, become an academic reference, and provide practical recommendations to improve the effectiveness of the implementation of Kimwasmat in court.

Abstract

Children are basically the next generation of the nation who should ideally grow and develop naturally according to their age, and be under the care and protection of parents, society and the state. In reality, there are children who commit criminal acts, such as theft, sexual abuse and narcotics. Punishment of children who commit criminal acts is carried out by the Special Child Development Institute as an effort to prevent repetition of criminal acts. The problem in this research is: How is the guidance of correctional students as an effort to prevent the recurrence of criminal acts at the Class II Special Development Institution for Children in Bandar Lampung and why are there inhibiting factors in the guidance of correctional students as an effort to prevent the repetition of criminal acts at the Special Development Institution Class II children from Bandar Lampung? The problem approach used in this research is empirical juridical. The data type consists of primary data and secondary data. Data collection through literature studies and field studies. Data analysis was carried out qualitatively. The results of this research show: Guidance for correctional students as an effort to prevent repetition of criminal acts at LPKA Class II Bandar Lampung is carried out in the coaching stages, namely initial coaching, advanced coaching and final coaching. Types of coaching include personality coaching (fostering religious awareness and fostering national and state awareness, fostering legal awareness and fostering intellectual abilities) as well as fostering independence. Factors that hinder coaching consist of statutory factors, namely the absence of technical instructions regarding coaching for children. crime, law enforcement factors, namely the quantity of guidance for correctional students, facilities and facilities factors, namely the limited means and facilities needed to carry out guidance, community factors, namely the negative attitude of the community towards former criminal children who have been released and returned to public.Keywords: Guidance, Correctional Students, Repetition of Criminal Offenses

Abstract

With the issuance of Law No. 6/2014 on Villages, the position of the village government has become stronger, because it is no longer regulated in Law No. 23/2014 on Regional Government, but is regulated by a separate law. In addition to strengthening the status of the village as a community government, the Village Law also makes the village the basis for advancing the community and empowering the village community. Villages have the right to autonomy. As a logical consequence of having autonomy, it must have its own finances. Article 93 of Government Regulation No. 43/2014 on the Implementation of Law No. 6/2014 on Villages states that village finances include planning, implementation, administration, reporting, and accountability. Article 101 of Government Regulation No. 43/2014 on the Implementation of Law No. 6/2014 on Villages mentions the mechanism for preparing the Village Budget. The research method used in this research is a normative juridical approach. The results showed that the mechanism for preparing the Village Budget of Central Lampung Regency as the implementation of Article 101 of Government Regulation Number 43 of 2014 concerning the Implementation Regulations of Law Number 6 of 2014 concerning Villages has been implemented based on Article 20 of the Regulation of the Regent of Central Lampung Regency Number 14 of 2015 concerning Village Financial Management in Central Lampung Regency through 3 (three) stages, namely the preparation, evaluation and determination stages. Supporting factors in the preparation of the Revenue and Expenditure Budget are the existence of assistants in the preparation of the Revenue and Expenditure Budget from the District and Regency, the government facilitates with the training of Village Heads and Village Apparatus every 3 (three) months at the provincial level and at the district level, and inhibiting factors in the preparation of the Village Revenue and Expenditure Budget, namely because Law Number 6 of 2014 and its implementing regulations are still new so that the community is not used to it and results in difficulty socializing with the community in village meetings.
