Abstract

Abstract Branchless Banking is a service created by bank to make it easier for people who use the bank to reach the bank for other financial needs. This is based on Financial Services Authority Regulation Number 19/POJK. 03/2014 concerning Officeless Financial Services in the Context of Financial Inclusion. With this regulation, Bank BRI opened a Branchless Banking service under the name BRILink, however, as the implementation of Branchless Banking BRILink progressed, many unscrupulous agents took advantage of opportunities that harmed customers financially. Article explains the legal protection for customer losses and legal responsibility of BRILink agents who commit criminal acts of embezzling BRILink customer money using normative juridical research methods. Article was written with the aim that the organizing banks must provide special protection to customers using Branchless Banking and strive to strictly monitor the activities of Branchless Banking Agents so that criminal acts that are detrimental to customers don't occur. Abstrak Laku Pandai merupakan layanan yang dibuat bank penyelenggara demi mempermudah khalayak yang menggunakan bank dapat menjangkau bank melakukan kepentingan finansial lainnya. Hal ini didasari dengan Peraturan Otoritas Jasa Keuangan (POJK) Nomor 19/POJK. 03/2014 mengenai Layanan Keuangan Tanpa Kantor Dalam Rangka Keuangan Inklusif. Dengan adanya regulasi tersebut, Bank BRI membuka layanan Laku Pandai dengan nama BRILink, namun seiring berjalannya pelaksanaan Laku Pandai BRILink, banyak oknum Agen BRILink yang memanfaatkan peluang yang akhirnya merugikan nasabah dalam segi finansial. Artikel ini menjelaskan tentang perlindungan hukum atas kerugian nasabah dan tanggung jawab hukum Agen BRILink yang melakukan tindak pidana penggelapan uang nasabah BRILink dengan metode penelitian yuridis normatif. Artikel ini dibuat dengan tujuan agar pihak Bank penyelenggara harus memberikan perlindungan yang khusus terhadap nasabah pengguna Laku Pandai serta berupaya untuk mengawasi jalannya kegiatan Agen Laku Pandai dengan tegas agar tidak terjadinya tindak pidana yang merugikan nasabah. Kata Kunci: Laku Pandai; Bank; Nasabah; Agen.

Abstract

Abstract Apart from the many conveniences that are felt, of course there are also negative effects from the current rapid development of technology, the rise of hate comments that occur on social media is a form of the negative impact of current technological developments. This journal was created with the aim of studying the meaning of hate comments and researching the regulations in Indonesia that regulate hate comments, and to understand more about the impact of hate comments so that hate comments can be reduced. This study uses the literature study research method in which the author seeks data and information from various types of references such as documents, both written documents, documents in the form of photographs, documents in the form of images, and documents in electronic form that can be used as sources in research process. It can be concluded that hate speech is a word, deed, writing or action that can lead to acts of violence that demean the dignity of fellow human beings, resulting in stigma from those who commit or are called perpetrators or those who are victims of these actions. hate comments that are often carried out on social media are included in hate speech. Indonesia has several regulations governing hate comments including the ITE Law, the Criminal Code, and the Chief of Police Circular Number: SE/06/X/2015 concerning Handling Hate Speech. In addition, hate comments also have some bad effects for victims. as well as perpetrators. Keywords: Hate comment, Social Media, Hate Speech
