Abstract

Land is not only a valuable asset for individuals and community groups, but also a determining factor in national development. Along with increasing development and changes in land use, disputes over ownership, boundaries, and land use rights are increasingly common. In dealing with this problem, mediation as an alternative to resolving disputes outside the courts has been recognized as a faster, cheaper, and more efficient method compared to litigation which is often time-consuming and expensive. Mediation allows the parties to reach a win-win solution without having to go through a complicated legal process. However, the effectiveness of mediation is highly dependent on various factors. The success of mediation is largely determined by the extent to which the results of the agreement can be implemented properly, including support from land institutions and local governments in following up on the decisions that have been agreed upon. Based on the results of this study, it shows that mediation can be an effective tool in resolving land disputes, especially if carried out professionally by paying attention to the principles of justice and equality for the parties. Mediators who have a deep understanding of agrarian law, good communication skills, and experience in handling similar cases can increase the chances of mediation success. However, it also identifies a number of challenges that need to be overcome so that mediation can run more optimally. These challenges include an imbalance of power between the parties, with the more economically and politically powerful often having greater influence, a lack of public understanding of the process and benefits of mediation, and limitations in the implementation and monitoring of the outcomes of agreements that have been reached. [Tanah tidak hanya menjadi aset berharga bagi individu dan kelompok masyarakat, tetapi juga menjadi faktor penentu dalam pembangunan nasional. Seiring dengan meningkatnya pembangunan dan perubahan pemanfaatan tanah, sengketa kepemilikan, batas wilayah, dan hak guna tanah semakin sering terjadi. Dalam menghadapi permasalahan ini, mediasi sebagai alternatif penyelesaian sengketa di luar pengadilan telah diakui sebagai metode yang lebih cepat, murah, dan efisien dibandingkan dengan jalur litigasi yang sering kali memakan waktu lama dan biaya tinggi. Mediasi memungkinkan para pihak untuk mencapai kesepakatan yang bersifat win-win solution tanpa harus melalui proses hukum yang berbelit. Namun, efektivitas mediasi sangat bergantung pada berbagai faktor. Keberhasilan mediasi sangat ditentukan oleh sejauh mana hasil kesepakatan dapat diimplementasikan dengan baik, termasuk dukungan dari lembaga pertanahan dan pemerintah daerah dalam menindaklanjuti keputusan yang telah disepakati. Berdasarkan Hasil penelitian ini menunjukkan bahwa mediasi dapat menjadi alat yang efektif dalam menyelesaikan sengketa tanah, terutama jika dilaksanakan secara profesional dengan memperhatikan prinsip keadilan dan kesetaraan bagi para pihak. Mediator yang memiliki pemahaman mendalam tentang hukum agraria, kemampuan komunikasi yang baik, serta pengalaman dalam menangani kasus serupa dapat meningkatkan peluang keberhasilan mediasi. Namun, juga mengidentifikasi sejumlah tantangan yang perlu diatasi agar mediasi dapat berjalan lebih optimal. Tantangan tersebut mencakup ketidakseimbangan kekuatan antara para pihak di mana pihak yang lebih kuat secara ekonomi dan politik sering kali memiliki pengaruh lebih besar kurangnya pemahaman masyarakat tentang proses dan manfaat mediasi, serta keterbatasan dalam pelaksanaan dan pengawasan terhadap hasil kesepakatan yang telah dicapai].

Abstract

This study critically examines the effectiveness of the Indonesian National Police (Polri) in enforcing the law and protecting human rights (HAM), specifically within the framework of national legal instruments. Despite the established legal foundation, including Law No. 2 of 2002 on the Police and Regulation of the Chief of Police No. 8 of 2009, the persistent violations of human rights by police officers highlight significant implementation gaps. These violations have led to a notable decline in public trust, raising questions about the adequacy of current legal frameworks in ensuring the protection of human rights. The urgency of this research lies in identifying the systemic failures in Polri’s performance, particularly the lack of consistent application of human rights principles in policing practices. By analyzing legal documents, case law, and reports from institutions such as Komnas HAM, this study reveals that the ineffective implementation of existing regulations, coupled with weak internal oversight and a culture of impunity, significantly hampers Polri’s ability to uphold human rights. The findings contribute new insights into the disconnect between normative legal standards and their practical application, offering a nuanced understanding of the challenges in reforming law enforcement practices. To address these challenges, the study recommends strengthening legal training, enhancing monitoring mechanisms, and fostering a shift in organizational culture within Polri to ensure better compliance with human rights standards and restore public trust.
