Abstract

Education is synonymous with schools (formal institutions), while non-formal institutions are still neglected as one of the sub-systems in the world of education. Meanwhile, one of the non-formal institutions PKBM Darul Arqam Nur-Ichsan School Sorong is a non-formal educational institution that intensely cultivates religious character values. This research aims to describe the cultivation of religious character education values in students by PKBM Darul Arqam Nur-Ichsan School Sorong This research uses a qualitative approach with a case study research type. The selection of informants was done by purposive sampling. The data obtained was analysed using the Miles and Huberman Interactive Analysis Model with steps namely reducing data, displaying data and drawing conclusions. The results of the study describe the model of cultivating religious character values at PKBM Darul Arqam Nur-Ichsan School Sorong, namely the existence of AIK (Al-Islam Kemuhammadiyahan) subjects that provide Muslim personality development, and leaders, teachers and staff become role models / role models at PKBM Darul Arqam Nur-Ichsan School Sorong and the norms and values of PKBM Darul Arqam Nur-Ichsan School Sorong institutions make all PKBM Darul Arqam Nur-Ichsan School Sorong residents strive to carry out God's commands and stay away from His prohibitions. The implications of this research can be utilised for education offices and related educational institutions regarding character cultivation models in non-formal institutions.

Abstract

The purpose of this study is to find out how the handling of criminal acts committed by minors based on the juvenile justice system. Using normative legal research methods, it is concluded: 1. In the Criminal Code, there are two kinds of elements, namely objective elements and subjective elements. The objective element is the element related to the situation, which is the state in which the actions of the perpetrator must be carried out, while the subjective element is the element inherent in the perpetrator or related to the perpetrator. The subjective element of a criminal act is intentional or accidental (dolus or culpa); purpose or intention on an experiment or poging as referred to in Article 53 paragraph 1 of the Criminal Code. The objective element of a criminal act is the unlawful nature or wederrechtelijkheid; the quality of the perpetrator, for example "the state of being a public servant" in a crime of office according to Article 415 of the Criminal Code or "the state of being an administrator or commissioner of a limited liability company" in a crime according to Article 398 of the Criminal Code; and causality, which is the relationship between an action as a cause and a reality as an effect. 2. Every minor who commits the crime of murder has different legal sanctions than adults who commit murder. Article 3 letter f of Law Number 11 of 2012 states that every child in the criminal justice process has the right not to be sentenced to death or life imprisonment, only subject to diversion efforts aimed at achieving peace between victims and children, resolving cases outside the judicial process, preventing children from being deprived of independence, encouraging the community to participate and instilling a sense of responsibility to children,  and job training in prisons for minors.

Abstract

Diversion aims to keep offenders away from the formal judicial system. The implementation of diversion in resolving juvenile criminal cases, particularly in Sorong Regency in 2023, involved at least two cases of juvenile theft. The purpose of this research is to examine the implementation of diversion in resolving juvenile criminal cases in the jurisdiction of Sorong Regency, to determine whether it complies with Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. Additionally, this research aims to analyze the factors influencing the implementation of diversion in resolving juvenile criminal cases in the jurisdiction of Sorong Regency. The research methodology used includes two approaches: a qualitative approach (both empirical and normative juridical) supported by a quantitative approach (content analysis and simple statistical data). Based on the research results, the factors influencing the effectiveness of the implementation of diversion in resolving juvenile criminal cases in the jurisdiction of Sorong Regency are: first, legal factors, specifically the brief time frame provided by the law for the diversion process, and the necessity to regulate the age of the child victim who can independently give consent in the Diversion Agreement; second, law enforcement factors, including judges and Bapas probation officers; third, facility factors, such as the availability of waiting rooms for children, juvenile courtrooms, diversion rooms, and juvenile detention facilities; fourth, community factors, wherein the presence of community elements can allow the victim to hear input from various parties, thereby facilitating successful diversion agreements; and fifth, cultural and traditional factors of the Sorong Regency community, particularly the Moi tribe as the indigenous group in Sorong Regency.

Abstract

This study critically examines the effectiveness of the Indonesian National Police (Polri) in enforcing the law and protecting human rights (HAM), specifically within the framework of national legal instruments. Despite the established legal foundation, including Law No. 2 of 2002 on the Police and Regulation of the Chief of Police No. 8 of 2009, the persistent violations of human rights by police officers highlight significant implementation gaps. These violations have led to a notable decline in public trust, raising questions about the adequacy of current legal frameworks in ensuring the protection of human rights. The urgency of this research lies in identifying the systemic failures in Polri’s performance, particularly the lack of consistent application of human rights principles in policing practices. By analyzing legal documents, case law, and reports from institutions such as Komnas HAM, this study reveals that the ineffective implementation of existing regulations, coupled with weak internal oversight and a culture of impunity, significantly hampers Polri’s ability to uphold human rights. The findings contribute new insights into the disconnect between normative legal standards and their practical application, offering a nuanced understanding of the challenges in reforming law enforcement practices. To address these challenges, the study recommends strengthening legal training, enhancing monitoring mechanisms, and fostering a shift in organizational culture within Polri to ensure better compliance with human rights standards and restore public trust.

Abstract

The purpose of this study is to analyze the application of the principles of unlawful acts and environmental justice to companies, obstacles to law enforcement, and the monitoring and enforcement system related to environmental damage in Indonesia. Environmental damage caused by corporate activities is a global issue. Companies often ignore ecological impacts, threaten biodiversity, and harm surrounding communities, requiring strict law enforcement. Law enforcement against companies that damage the environment in Indonesia faces major obstacles, such as a lack of effective supervision, corruption, and political influence, which hinder corporate responsibility for environmental damage. This study offers a novel perspective by focusing on the legal responsibility of perpetrators of land damage, moving beyond previous research that primarily discussed the government's right to sue for unlawful acts. This study uses a normative juridical approach with analysis of legal regulations, principles of corporate responsibility, and environmental justice, using secondary data analyzed qualitatively. The results indicate that corporate responsibility for environmental damage from the perspective of unlawful acts and environmental justice in Indonesia still faces obstacles. Although regulations govern corporate responsibility, applying the principles is ineffective due to political influence, corruption, and weak monitoring. Strengthening regulatory institutions, implementing transparent reporting systems, and imposing stricter sanctions on companies damaging the environment are important steps to ensure justice. Developed countries can serve as models for improving Indonesia’s law enforcement system.

Abstract

Amid the expansion of extractive industries that threaten ecosystems and marginalize indigenous communities, the Awyu Tribe in South Papua faces increasing pressure over the ownership and protection of their customary forests. This study aims to explore the ownership conflict of Awyu customary forests, assess the effectiveness of national and international legal frameworks, and evaluate the implementation of state policies in securing indigenous rights and ecological justice. The urgency of this issue lies in the persistent neglect of the Awyu people's legal standing, where regulations often fail to reflect their lived realities and cultural values. Using a normative legal method, the research applies statutory, conceptual, comparative, and case-based approaches, relying on secondary data sourced from literature and analyzed through qualitative-descriptive techniques. Findings indicate that although both national and international law recognize indigenous rights, implementation on the ground is obstructed by bureaucratic inefficiencies and competing economic interests. The principle of Free, Prior, and Informed Consent (FPIC) is frequently disregarded, resulting in systemic land dispossession and environmental degradation. This research offers a novel perspective by integrating fragmented legal mechanisms into a cohesive approach to indigenous forest protection. As a normative recommendation, the study calls for stronger enforcement of FPIC, institutional reform to reduce regulatory bias, and the meaningful inclusion of indigenous voices in policy formulation and implementation.

Abstract

The purpose of this research is to examine how the pretrial criminal system supervises and evaluates the legality of actions taken by law enforcement officials from a human rights perspective and to identify the factors influencing the pretrial system. The method used in this study is normative legal research with a legislative approach, analyzing laws and regulations related to the pretrial process. The novelty of this research lies in the pretrial system, which has not been extensively studied due to the arbitrariness of law enforcement officials, as well as an analysis of the implementation of regulations related to pretrial matters. The findings of this study indicate that the pretrial system has the authority to examine evidence and act proactively; in this case, the pretrial can identify abuses of process or violations of human rights at an early stage. This procedure aims to protect the human rights of innocent individuals. The pretrial system also serves to control actions by law enforcement officials that are contrary to human rights. However, there are factors that influence the pretrial criminal system in exercising its authority, which include aspects of substantive law, legal officials, and social society. These aspects are interconnected and cannot be separated. In conclusion, despite the factors influencing the pretrial criminal system, the presence of pretrial proceedings as a means to protect human rights can enhance oversight and accountability in the pretrial process to prevent abuse of power.

Abstract

This study aims to explore and understand how legal protection is provided to women victims of domestic violence (DV) and the forms of DV that affect women. The method used in this study is empirical legal analysis, which is descriptive and analytical in nature, with an interview approach involving five sources who have direct experience in cases of domestic violence. The novelty of this study lies in its focus on the factors that support and trigger domestic violence involving women, as well as an in-depth analysis of the legal protection provided to victims. The results of the study show that victims of domestic violence experience various forms of violence, including physical, sexual, psychological, economic, verbal, and spiritual abuse, which are influenced by factors such as patriarchal culture, misguided religious understanding, and personal problems within the household such as infidelity and economic difficulties. The conclusion of this study is that although legal protection for female victims of domestic violence already exists, there are still many factors that hinder its effective implementation, particularly those related to social stigma, legal ignorance, and limited access to legal and psychosocial services.

Abstract

Penelitian ini bertujuan untuk Mengetahui Penerapan sanksi dalam melaksanakan prosedur yang  telah ditetapkan dalam peraturan perundang-undangan yang korelasi yuridisnya berkaitan dengan  tugas  dan  fungsi  kinerja  BKSDA  sebagaimana  tertuang dalam Undang-Undang No  5  Tahun  1990, dengan kajian dan analisa mendalam terhadap penerapan  sanksi  pidana  dan  penghambat keberhasilan pelaksanaan BKSDA, serta  pandangan  masyarakat terhadap kinerja BKSDA kota Sorong.Penelitian  ini  di  laksanakan  di  BKSDA  Kota  sorong  dengan  mengambil  sampel  pegawai BKSDA  Kota sorong,  yang dilakukan dengan pengamatan secara mendalam mengenai gejala  yang  diteliti.  Di  samping  wawancara  terstruktur  dengan  responden,  dengan  lokasi  yang berbeda–beda, sehingga peneliti dapat menelaah rasionalitas dan akurasi implementasi atau pelaksanaan penerapan sanksi yang dilakukan oleh BKSDA Kota sorong, dan  rating  ekspektasi publik  terhadap  bobot  pelaksanaan penerapan sanksi terhadap eksploitasi pada kawasan  hutan konservasi di Kota sorong.Temuan yang diperoleh dalam penelitian diantara lain adalah: (1) Mengetahui penghambat penerapan sanksi pidana terhadap pelaku tindak pidana penambangan liar terbuka di dalam kawasan hutan konservasi. (2) BKSDA Kota sorong  mampu  untuk  menerapkan  sanksi  pidana  terhadap  penyelenggara eksploitasi di Kota  sorong  yang  pada  aspek  hukum  terhadap  tindak  pidana pelaku penambangan liar terbuka di dalam  kawasan  konservasi  hutan dan  mampu  untuk  bisa  terealisasi  dengan  baik  yang  telah ditetapkan  pada  peraturan perundang–undangan yang mengatur tentang  terkait  Balai Besar Konservasi Sumber Daya Alam pada kawasan Hutan.Sebagai bahan informasi  bagi masyarakat mengenai  potensi  sumber  daya  hutan  serta  cara  pengelolaannya di Kota sorong, sehingga mampu untuk dijadikan sebagai salah satu bahan pada bagian stakeholder, pemerintah, maupun swasta dalam pengambilan keputusan dan berkaitan dengan penggunaan dan pemanfaatan Sumber Daya Alam yang terdapat pada kawasan hutan konservasi Agraria kehutanan yang berada pada wilayah Kota sorong sebagai Zona yang memiliki kawasan hutan yang begitu besar dan sangat bermanfaatkan bagi masyarakat Kota Sorong.
