Abstract

This article aims to examine the implementation of penal mediation as a form of resolving minor criminal offenses committed by students at Al-Ishlah Putra Islamic Boarding School in Singosari, Malang, and to analyze its application from the perspective of maqashid sharia according to Ibnu Ashur. This article falls under qualitative library research with an empirical legal study approach. The findings show that penal mediation in this pesantren represents a legal resolution that emphasizes educational and restorative values, through mechanisms such as deliberation between the offender, the victim, and the student’s guardian, as well as religious and social sanctions aimed at fostering moral awareness. From the perspective of Ibnu Ashur’s maqashid sharia, this practice reflects efforts to protect the five essential aspects of life—religion, life, intellect, lineage, and property—while also demonstrating a legal approach that is rational, proportional, and oriented toward the public good (maslahah ‘ammah).

Abstract

Permasalahan tindak pidana zina dalam KUHP Indonesia terletak pada pengaturannya yang masih sebatas delik aduan, serta hanya berlaku bagi individu yang terikat perkawinan. Hal ini dinilai tidak sejalan dengan norma agama dan sosial yang berkembang di masyarakat. Penelitian ini bertujuan untuk merekonstruksi delik zina dalam KUHP dengan pendekatan maslahah dan menilai kesesuaiannya berdasarkan teori keadilan John Rawls. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui kajian pustaka terhadap sumber hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa pengaturan zina dalam KUHP belum mampu menjawab tantangan sosial karena tidak menjangkau praktik zina di luar pernikahan tanpa adanya laporan dari pihak tertentu. Dalam konteks hukum Islam, seluruh bentuk perzinaan dianggap pelanggaran berat yang memerlukan tindakan hukum preventif. Oleh karena itu, rekonstruksi yang ditawarkan adalah mengubah jenis delik menjadi delik biasa serta menyesuaikan sanksi yang lebih efisien secara sosial dan ekonomis. Berdasarkan teori Rawls, hukum pidana harus menjamin kebebasan setara dan perlindungan terhadap kelompok rentan. Kesimpulannya, reformulasi delik zina perlu diarahkan pada keadilan substantif yang responsif terhadap masyarakat pluralistik Indonesia.

Abstract

Criminal acts committed by children are increasingly frequent in Indonesia. The state is responsible for providing special protection for their rights. Law No. 11 of 2012 on the Juvenile Criminal Justice System was introduced as a state response to the need for a child-friendly justice system. This research aims to analyze the legal protection of children who commit criminal acts from the perspective of John Rawls' theory of justice. This study employs a normative legal method using statutory and conceptual approaches. Data sources were obtained through literature studies using primary and secondary legal materials such as legislation, academic literature, and journals. Law No. 11 of 2012 provides legal protection for child offenders through diversion mechanisms and the application of restorative justice. These measures are taken to avoid the imprisonment of children, protect their fundamental rights, and ensure a humane and educational judicial process. The government also emphasizes the involvement of the community and families in the child’s recovery process. The protection of children under Law No. 11 of 2012 aligns with the two main principles of John Rawls' theory of justice: the principle of equal liberty and the difference principle. Children, as a vulnerable group, are positioned as individuals whose rights must be guaranteed equally with other children and who must receive special treatment to ensure substantive justice. This law reflects a legal partiality toward children as the most disadvantaged group within the criminal justice system.

Abstract

Divorce among civil servants (PNS) has been increasingly prevalent in Bojonegoro Regency over the past four years. The majority of these cases are dominated by domestic violence (KDRT) and infidelity. There are specific regulations in Government Regulation No. 45 of 1990 concerning civil servants' benefits, which indicate that the status of civil servants is different from that of the general public. This study focuses on the dysfunction of Article 8, which governs the division of one-third of a civil servant’s salary after divorce. This research uses empirical legal research or field research with a qualitative approach. Primary data was obtained from semi-structured interviews with religious court judges in Bojonegoro. The findings of this study reveal that Article 8, which regulates the division of civil servant salaries, is not fully implemented in the Bojonegoro state court or experiences dysfunction. This is due to the potential harm that may arise after the divorce if it is applied in civil servant divorce cases, such as the continued use of alimony by the ex-wife from her former husband until she remarries. This also opens the possibility that if the ex-wife enters into a religious marriage, alimony from the ex-husband will continue to be paid to the ex-wife and her new husband.

Abstract

This study examines the resolution of minor criminal offenses committed by students at Pondok Pesantren Putra Al-Ishlah, Singosari, Malang, through penal mediation, analyzed within the framework of John Rawls’ theory of justice. Offenses such as petty theft, verbal insults, and minor vandalism are addressed internally through restorative measures rather than formal legal proceedings. Employing a qualitative field research approach, data were collected through interviews with pesantren administrators and teachers, along with the analysis of documented cases from 2020 to 2024. The pesantren applies restorative and educational sanctions, such as Qur’an recitation, performing the call to prayer, or repairing damaged property while engaging offenders, victims, and guardians in a deliberative mediation process. The findings demonstrate that this approach embodies Rawls’ two key principles of justice: the assurance of equal basic liberties and the application of the difference principle in promoting fairness. Penal mediation at the pesantren functions not only as a deterrent to future misconduct but also as a means of reconciliation and moral development, reinforcing community cohesion. This culturally grounded model of restorative justice offers an alternative framework for addressing juvenile misconduct in educational institutions, illustrating the practical integration of moral philosophy, disciplinary methods, and character education in a faith-based setting.
