Abstract

Legislation science plays a crucial role in forming fair and effective laws in Indonesia. The law-making process that is transparent and involves public participation will result in legal outcomes that are acceptable to all levels of society. This paper aims to explore how legislation science ensures that laws are aligned with the principles of justice, legal certainty, and effectiveness. The creation of fair laws requires the legislative process to consider not only formal legal aspects but also the existing social context. This research adopts a descriptive- analytical approach to explain the role and challenges of implementing legislation science in Indonesia.

Abstract

This study aims to examine telematics law in Indonesia, from regulatory, implementation, and challenges in the digital era. Telematics law, which covers laws regulating the use of information and communication technology (ICT), has become increasingly important as digital technology evolves. Using a qualitative approach, this paper explores how telematics law is applied in Indonesia and the challenges and solutions in its implementation. The study also analyzes relevant laws and practices in regulating the use of information technology in Indonesia. The findings show that although the regulations exist, the implementation and public understanding of telematics law need to be improved.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) are the backbone of Indonesia’s economy but continue to face structural challenges due to weak legal protection and complex regulations. This study examines the legal politics toward MSMEs and their impact on equitable economic development, focusing on a case study in Depok City and a comparison with Yogyakarta Special Region (DIY). The research applies juridical-normative and juridical-empirical approaches through regulatory analysis and interviews with MSME actors and local officials. The findings reveal that MSME policies in Depok remain partial, as no specific local regulation exists despite the issuance of Mayor Regulation No. 15/2021. Conversely, DIY has implemented a more comprehensive framework through Regional Regulation No. 6/2022 and Governor Regulation No. 58/2023, covering empowerment, fiscal incentives, and legal protection. At the national level, Government Regulation No. 47/2024 on MSME Bad Debt Write-Off serves as a breakthrough in improving credit access. The study recommends a distributive justice–based legal reform (Rawls) and stronger central–local policy synergy to build an inclusive and sustainable MSME ecosystem.
