Abstract

This paper examines the effectiveness of legal frameworks and regulations in Indonesia’s fintech sector, focusing on consumer data protection, dispute resolution, and law enforcement. The study analyzes key regulations, including POJK No. 13/2018, SEOJK No. 14/SEOJK.07/2014, UU ITE No. 11/2008, and PBI No. 22/20/PBI/2020, to evaluate their role in safeguarding consumer data and managing digital transactions. Using a qualitative, descriptive analysis, the research highlights that these regulations establish strong foundations for data security, requiring fintech companies to implement robust security systems such as encryption and access control. However, the study also identifies gaps in enforcement, especially concerning the oversight of regulatory bodies like OJK and Bank Indonesia. Additionally, the research finds that while legal provisions are in place, there is a lack of accessible dispute resolution mechanisms for consumers, which could undermine trust in the fintech sector. The study concludes that improvements are needed in both the enforcement of these regulations and the accessibility of dispute resolution options. These findings emphasize the importance of ensuring effective legal frameworks and stronger regulatory oversight to foster a secure and trustworthy fintech environment.

Abstract

As an intermediary institution that functions to mobilise public funds, the bank has the potential to experience failure or fraud, which can cause ad decline in the bank's soundness (through CAMEL; Capital, Assets, Management, Earnings, and Liquidity). The Deposit Insurance Corporation was formed to guarantee limited deposit funds (limited guarantee) as a substitute for a blanket guarantee. LPS also has an active role in maintaining the stability of the banking system by its authority where after the OJK declares a failed bank, the banks are handed over to LPS, for non-systemic failed banks, a settlement is carried out by a rescue (at the expense of the shareholders) and not perform a rescue (liquidate the failed bank). If the bank failed to have a systemic impact, the IDIC (LPS) would take care of the Systemic Failed Bank, placing a temporary capital placement (PMS) to make it sound and resale it within 3 years. The issue is: How does failing bank restructuring meets the principle of benefit by the Indonesia Deposit Insurance Corporation? The type of this research is juridical-normative research and legal materials traceability technique using qualitative analytical. This research approach uses the statute approach, conceptual approach, and historical approach. The conclusion of this paper is Resolution Bank or restructuring of the failed bank by LPS that meets the beneficiary principle must carry out the following the four (4) categories of Commercial Banks based on Business Activities (BUKU), where for categories 3 and 4, a long period of restructuring is required because the bank has many derivative products.

Abstract

Fintech berupa pinjaman online memudahkan peminjaman dana dengan waktu yang singkat, namun sering memicu masalah kredit macet yang memerlukan penyelesaian melalui kerjasama dengan para debt collector terhadap debitur yang sulit ditagih dengan dinyatakan melakukan wanprestasi. Penelitian ini adalah penelitian yuridis normatif. Adapun sumber data yang digunakan adalah bahan hukum yakni Putusan No. 592/PDT.G/2019/PN. JKT UTR serta Aturan Perundang-Undangan yang berhubungan pada putusan itu ialah UU No. 4 Tahun 2023 terkait Pengembangan dan Penguatan Sektor Keuangan, Pasal 1 angka 6 Peraturan OjK No. 77/POJK. 01/2016, terkait pelayanan Pinjam Meminjam Uang Berbasis Teknologi Informasi serta Kitab UU Hukum Perdata, serta KUHAP, buku, jurnal, artikel dan bahan hukum lain yang berkaitan. Data yang terkumpul diuraikan melalui kalimat yang efektif, teratur dan logis, sehingga menjawab tiap rumusan masalah. Hasil penelitian ini menemukan bahwa, Negara memberikan perlindungan hukum melalui prosedur penyelesaian sengketa yang mana Junfeng Sheng (debt collector) digugat di pengadilan perdata berdasarkan Putusan 592/PDT.G. / 2019/PN. JKT UTR dan membayar ganti rugi kepada Junfeng Sheng sebesar Rp. 1.046.926.809,12. Kedua, negara memberikan kepastian terhadap aturan dan sanksi yang ditentukan di peraturan perundang-undangan terhadap perkara putusan No. 592/PDT.G/2019/PN. JKT UTR memutuskan PT Baraccuda Fintech Indonesia memberikan kompensasi kerugian sesuai peraturan.

Abstract

Hukum merupakan sumber acuan dari bagaimana manusia harus bertingkah laku dalam masyarakat, termasuk dalam penggunaan media sosial. Dewasa ini, media sosial digunakan sehari - hari oleh masyarakat bukan hanya untuk berinteraksi dengan sesama namun juga untuk melakukan kegiatan bisnis. Praktik fake engagement menjadi sesuatu yang sering dimanfaatkan oleh pemilik bisnis dan pengguna media sosial untuk mendongkrak popularitas mereka di media sosial. Penelitian ini bertujuan untuk mendapatkan pemahaman yang lebih baik mengenai praktik fake engagement ditinjau dari sisi hukum positif di Indonesia serta kerugian apa saja yang diakibatkan oleh praktik fake engagement. Penulis menggunakan metode perpustakaan, teknik penelitian deduktif, untuk menganalisis kasus dan masalah regulasi yang mengatur masalah penelitian ini. Informasi hukum diperoleh dari sumber primer, sekunder, dan tersier. Dalam tulisan ini, penulis menerapkan teori efektivitas hukum dan kepastian hukum. Kesimpulan yang didapat penulis dari penelitian ini adalah praktik fake engagement melanggar hukum positif yang berlaku di Indonesia serta membawa banyak dampak buruk bagi masyarakat khususnya sesama pengguna media sosial.
