Abstract

Abstract Background. Children, as creations of God and social beings, possess the right to life and autonomy from conception to birth, and are entitled to protection from parents, family, society, nation, and state. Aims. This study seeks to examine the execution of legal protection policies for victims of sexual abuse against women and children in Cirebon Regency. Methods. The employed research method is empirical legal research, integrating legislative, intellectual, and sociological approaches. Data were acquired via document analysis and field interviews. Result. The study's findings indicate that, despite substantial efforts to offer legal protection, encompassing legal, psychological, and medical support, along with the establishment of safe houses, numerous challenges persist. These impediments encompass inadequate facilities, societal stigma, insufficient inter-institutional coordination, and protracted legal procedures. The Sexual Violence Crime Law (TPKS Law), enacted in 2022, signifies a substantial advancement in the provision of enhanced protection. Nonetheless, its execution at the regional level continues to encounter obstacles, particularly regarding resources and public awareness. Conclusion. This study concludes that there is a need to improve inter-institutional coordination, public education, and strengthen infrastructure to create a safer environment for women and children. Implementation. The implementation of the law still faces several challenges, particularly at the regional level.

Abstract

Sexual violence against children remains a serious concern in Indonesia, with the number of cases continuing to increase each year. The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (Tindak Pidana Kekerasan Seksual, TPKS Law) marks a significant milestone in providing a more comprehensive legal framework for protecting victims and prosecuting perpetrators. This research aims to assess the implementation of legal protection for child victims of sexual violence at the Cirebon City Police Department and to identify the challenges faced in its application. Using a normative juridical research method with a legislative approach and a case approach, this study analyses primary legal materials — including the TPKS Law, the Child Protection Law, and the Kitab Undang-Undang Hukum Pidana (KUHP) — as well as secondary materials such as legal literature and field data obtained from the Cirebon City Police. The findings indicate that the TPKS Law provides a comprehensive legal basis for victim protection, rehabilitation, and the prosecution of perpetrators. However, its implementation faces a number of obstacles, including the psychological condition of victims, fear and shame within families, a tendency toward amicable settlement, the withdrawal of reports, and limited law enforcement authority. The study concludes that the effectiveness of legal protection is not solely determined by the regulatory framework, but is also shaped by social, cultural, and psychological factors. Accordingly, a collaborative approach among law enforcement, the government, and the community is essential to ensure optimal protection and justice for child victims. Strengthening public awareness, improving victim support services, and enhancing law enforcement capacity are crucial steps toward realising a child-friendly justice system.
