Abstract

This study examines the tradition of uang hantaran in Riau Malay marriages from the perspective of Islamic law, addressing the limited analytical discussion on its legal status and socio-religious implications. Using a qualitative ethnographic approach, data were collected through fieldwork in Siak Regency, Pekanbaru City, and Dumai City, involving interviews with community members and religious figures. The findings show that uang hantaran is a deeply rooted customary practice determined through mutual agreement, functioning as both financial support for wedding expenses and a symbol of commitment. However, excessive demands may generate financial burdens, indebtedness, and delays in marriage. From the standpoint of Islamic jurisprudence, although not prescribed in the Qur’an or Sunnah, the practice may be accommodated under the concept of ”˜urf (custom) as long as it aligns with Islamic principles””permissible when it promotes maá¹£laḥah and invalid when it leads to mafsadah. This study contributes by offering an integrative ”˜urf-based analysis that bridges local cultural practices with Islamic legal theory, providing a more nuanced framework for evaluating customary marriage traditions in contemporary Muslim societies.

Abstract

Penelitian ini bertujuan untuk menganalisis kaidah-kaidah fikih yang dirumuskan oleh Ibn Daqiq al-‘Id dalam Ihkam al-Ahkam Syarh ‘Umdatu al-Ahkam serta penerapannya dalam bab munakahat. Penelitian ini merupakan penelitian kepustakaan (library research) dengan pendekatan kualitatif-deskriptif dan analitis, menggunakan metode ushul fikih dan kaidah fikih. Sumber data primer adalah teks Ihkam al-Ahkam pada pembahasan munakahat, sedangkan data sekunder berupa literatur fikih, ushul fikih, dan penelitian ilmiah yang relevan. Hasil penelitian menunjukkan bahwa Ibn Daqiq al-‘Id merumuskan sejumlah kaidah fikih yang bersifat kulli dan aplikatif, di antaranya: sighat amar menunjukkan kewajiban, sesuatu yang tergantung pada syarat tidak berlaku saat syarat tidak ada, syarat dalam akad wajib dipenuhi, dalil mutlak tidak menunjukkan salah satu pembatasnya secara spesifik, meninggalkan perincian menunjukkan keumuman hukum, serta pengkhususan tidak selalu menunjukkan perbedaan hukum. Penerapan kaidah-kaidah tersebut dalam masalah pernikahan, mahar, talak, ‘iddah, dan ihdad menunjukkan bahwa metodologi beliau bersifat sistematis, berbasis nash, serta selaras dengan maqāṣid al-syarī‘ah dalam mewujudkan kemaslahatan dan mencegah kemudaratan dalam kehidupan keluarga.

Abstract

Parental divorce not merely alters the legal relationship between spouses but also appreciably affects children's psychological well-being, possibly hindering their emotional, social, and developmental growth. In Islamic Family Law, the protection of children after divorce is part of the responsibility of parents to ensure the welfare of the child according to the goals of maqāṣid al-syarī'ah. This study intends to examine the psychological resilience of children affected by parental divorce and explore its relevance to child protection within the framework of maqāṣid al-syarī'ah. The research uses a qualitative approach with a field research design and will be conducted in January-April 2026 at four private Vocational High Schools in the city of Pekanbaru. The research informants comprised 10 people, including four students who were victims of divorce, four parents, and two guidance and counselling teachers, who were purposively selected. Data was collected through in-depth interviews, observations, and documentation, then analysed using thematic analysis. The results of the study show that parental divorce affects children's emotional conditions in the form of sadness, anxiety, decreased sense of security, and obstacles to social and academic adaptation. However, family support, the school environment, and self-reflection skills aid in the development of psychological resilience, which is characterised by increased self-awareness, emotional control, acceptance of family circumstances, and positive adaptability. From the perspective of maqāṣid al-syarī'ah, strengthening the psychological resilience of children constitutes an effort to protect the soul (ḥifẓ al-nafs) and the intellect (ḥifẓ al-'aql). The study supports Islamic Family Law scholarship by conceptualising psychic resilience as an essential dimension of child protection, thereby supporting the realisation of ḥifẓ al-nafs and ḥifẓ al-'aql within the maqāṣid al-syarī'ah framework. Therefore, child protection after divorce needs to be understood not only as the fulfilment of material rights, but also as protection for the psychological well-being of children in a sustainable manner.
