Abstract

The main objective of this study is to determine the legal strength of the status of customary land rights in Papua and how to resolve conflicts that occur in Papua. This study uses normative legal research. The results of this study indicate that customary land in Papua has legal force recognized by various regulations, but in practice there is often confiscation without a legal mechanism due to weak law enforcement and overlapping claims. Conflict resolution is recommended through non-litigation channels such as mediation and customary consultation, with litigation as a last resort. The government needs to strengthen the protection of customary rights, map customary areas, and prioritize a deliberation approach in resolving disputes by forming a special team involving customary law experts, anthropologists, and community leaders to maintain justice for indigenous peoples.

Abstract

Within the structure of the Indonesian constitution, the House of Representatives (DPR) holds the Right of Inquiry as one of its key oversight mechanisms. This authority enables the DPR to examine government policies deemed detrimental to the public or inconsistent with prevailing regulations. In practice, the Right of Inquiry serves as a tool to uphold transparency, accountability, and the balance of power between the legislative and executive branches. However, its effectiveness is often hindered by various challenges, including politicization, political dominance within the parliament, and the limited implementation of investigation outcomes. To enhance its function, it is essential to reinforce legal frameworks, improve the integrity of DPR members, and foster synergy among governmental institutions. With proper management, the Right of Inquiry can significantly contribute to strengthening the democratic system and promoting a government that is more responsive to public needs.

Abstract

This study aims to determine the legal protection provided to victims of personal data theft in Indonesia. This study uses a normative juridical research method by examining laws and regulations related to legal protection for victims of personal data theft. The results indicate that legal protection for victims of personal data theft in Indonesia is regulated by Law No. 11 of 2008 concerning Electronic Information and Transactions (ITE) and Law No. 27 of 2022 concerning Personal Data Protection (PDP). However, more effective law enforcement efforts are still needed to protect victims' rights and prosecute perpetrators of personal data theft.
