Abstract

Krisis ekonomi tahun 1998 yang melanda kawasan asia membawa pelajaran yang sangat penting bagi manajer perusahaan multinasional, maupun akademisi di perguruan tinggi. Pengambil kebijakan keuangan di negara-negara Asia tidak menyangka bahwa jatuhnya satu mata uang akan berdampak pada mata uang Negara lain. Di dalam situasi yang sulit itu perdagangan berjangka lahir menjadi penyelamat dalam nilai tukar mata uang secara implicit dalam dunia investasi.Tapi dalam perkembangannya transaksi di bursa berjangka banyak terdapat masalah maupun sengketa hukum yang sangat kompleks dalam hal perumusan regulasi baru menyangkut perdagangan berjangka sebagai akibat dari masalah yang ada dalam transaksi dalam bursa berjangka. Metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis normatif, dimana peneliti menggunakan sumber bacaan serta sumbersumber hukum yang ada untuk menjawab permasalahan yang ada dalam penelitian ini. Kesimpulan dari penelitian ini ternyata perdagangan berjangka terdapat masalah hukum yang krusial menyangkut kewenangan pasar modal dan pasar berjangka karena pasar modal sendiri dapat ikut dalam transaksi yang sebenarnya merupakan kewenangan dari pasar berjangka, serta pada prakteknya banyak perusahaan pialang berjangka yang masih saja melakukan pelanggaran hukum kepada nasabah tapi tindakan tegas sangat sulit diambil disebabkan sulitnya pembuktian yang disebabkan karena mekanisme pasar yang begitu rumit dan flexibel

Abstract

This study aims to investigate the flexing phenomenon on social media, exploring its position between financial education and ostentatious displays of wealth, with a focus on its implications in criminal law aspects in Indonesia. The research employed a qualitative methodology, utilizing interviews with key stakeholders, focus group discussions, analysis of social media content, and a comprehensive literature review. Additionally, the study incorporated comparative analysis with other Southeast Asian countries to provide regional context. The results reveal a complex interplay of social, legal, and educational factors surrounding the flexing phenomenon. Key findings include: (1) a significant divergence in perceptions of flexing among different stakeholders, with influencers viewing it as inspirational while legal experts express concerns about potential legal scrutiny; (2) the effectiveness of flexing as an educational tool when balancing success stories with practical financial advice; (3) a notable knowledge gap among social media users regarding the legal implications of their online behavior; (4) growing concerns about the use of social media evidence in financial crime investigations; (5) the emergence of "aspirational flexing" among younger users, raising ethical and potential legal issues; and (6) a shift in public perceptions of wealth and success due to constant exposure to luxury displays on social media. The study concludes that while flexing can serve as a powerful educational tool, it also presents significant legal risks and societal challenges that require a balanced approach to address effectively

Abstract

Religious moderation is a component of character education, and religious moderation is a government strategy that is beneficial for reconciling religious differences. Religious moderation is used to mitigate disparities between religious groups. The aim of this research is to find out how the millennial generation religious moderation pusian youth organization based on the 1945 constitution post amendment to article 28E paragraph 1. This research uses qualitative research methods with data collection methods in the form of observation, interviews, and taking documentation. The data analysis used in this research is in the form of data reduction, then how the data is presented, until then the data is drawn to a conclusion. This research can be concluded as, collaboration between youth organizations of different religions, increasing internal and external social awareness of youth organization, increasing the worship activities of youth organization, and youth organization community service work with the surrounding community.

Abstract

Keputusan Tata Usaha Negara (KTUN) merupakan elemen utama dalam sistem hukum administrasi negara Indonesia yang memiliki pengaruh langsung terhadap hak dan kepentingan masyarakat. Dalam Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara, KTUN diatur sebagai objek sengketa yang dapat diajukan ke PTUN. Namun, dengan disahkannya Undang-Undang Administrasi Pemerintahan (UU AP), terdapat perbedaan dalam pengaturan sifat keputusan dan prosedurnya. Rumusan masalah dalam penelitian ini adalah bagaimana definisi, karakteristik, dan keabsahan KTUN serta tindakan hukum pejabat administrasi negara yang dapat menimbulkan sengketa. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, literatur hukum, dan doktrin hukum administrasi negara. Hasil penelitian menunjukkan bahwa untuk dapat dikategorikan sebagai KTUN yang sah, keputusan harus memenuhi unsur sebagaimana diatur dalam Pasal 1 angka 9 UU No. 5 Tahun 1986, yaitu bersifat tertulis, dikeluarkan oleh pejabat administrasi negara, bersifat konkret, individual, final, dan menimbulkan akibat hukum. Keputusan yang tidak memenuhi unsur tersebut dianggap tidak sah dan dapat digugat melalui PTUN. Penelitian ini juga menyoroti berbagai jenis keputusan tata usaha negara dan pentingnya kehati-hatian dalam tindakan hukum pejabat administrasi. Simpulan dari penelitian ini menegaskan pentingnya batasan hukum terhadap keputusan administratif demi menjaga perlindungan hak warga negara dari tindakan yang berpotensi sewenang-wenang.

Abstract

This study examines the protection of international humanitarian law for journalists working in armed conflict situations. Journalists, as key actors in providing information to the global public, often face serious dangers when covering armed conflicts. This raises questions about the effectiveness of existing international legal protections for them. This research employs a normative legal approach by reviewing international regulations such as the 1977 Additional Protocol I to the Geneva Conventions and Article 4A(4) of the 1949 Geneva Convention III, which provide protection for journalists in war zones. Although international humanitarian law regulates the protection of journalists, field practices show that violations of journalists’ rights still frequently occur. Based on these findings, this study recommends strengthening the implementation of international humanitarian law and increasing global awareness of the importance of protecting journalists in conflict areas. The results of this research are expected to contribute theoretically to the development of humanitarian law and provide practical benefits for journalists carrying out their duties in armed conflict zones.
