Abstract

This research aims to identify the limitations of Indonesia’s positive legal regulations in addressing cybercrimes and explore the potential integration of relevant Islamic criminal law principles to enhance law enforcement effectiveness. This research employs a normative legal approach by analyzing legislation, legal doctrines, and relevant literature. Cybercrimes, such as hacking, phishing, malware attacks, and cyberbullying, have severe material, psychological, and social impacts, affecting individuals, businesses, and national security. Indonesia’s positive legal framework, particularly the Electronic Information and Transactions (ITE) Law, prescribes penalties of up to 10 years in prison or fines reaching IDR 10 billion. However, enforcement is often hampered by challenges in proving digital evidence, the anonymity of perpetrators, and jurisdictional limitations. From the perspective of Islamic criminal law, cybercrimes are classified as ta’zir offenses, granting judges the flexibility to determine appropriate punishments based on the severity of the crime. Beyond punitive measures, Islamic law emphasizes restorative justice through sincere repentance (taubat nasuha), ethical awareness, and moral guidance to rehabilitate offenders and prevent recidivism. This study underscores the need for a more integrative approach that combines positive legal mechanisms with Islamic ethical principles. Strengthening cooperation between law enforcement, government institutions, and society is crucial to enhancing cybercrime prevention. By integrating positive law with Islamic criminal law principles, this research proposes a comprehensive strategy to address digital crimes more effectively in Indonesia.

Abstract

AbstrakRendahnya literasi dan pemahaman hukum di kalangan peserta didik dapat memperbesar risiko keterlibatan mereka dalam perundungan, kenakalan remaja, penyalahgunaan media sosial, narkotika, judi daring, serta berbagai perilaku berisiko lainnya. Artikel pengabdian ini bertujuan menggambarkan pelaksanaan program Jaksa Masuk Sekolah (JMS) oleh Kejaksaan Negeri Mandailing Natal sebagai salah satu upaya peningkatan kesadaran hukum di lingkungan pendidikan. Kegiatan dilakukan dengan pendekatan deskriptif-dokumenter melalui tahapan perencanaan, koordinasi, penyuluhan, diskusi, dan evaluasi administratif. Data dikumpulkan dari laporan kegiatan, materi presentasi, notulen, foto dokumentasi, serta wawancara singkat dengan tim pelaksana. Program JMS dilaksanakan di sebelas lembaga pendidikan di Kecamatan Panyabungan, yang meliputi SMP, SMA/MA, SMK, dan perguruan tinggi. Materi penyuluhan mencakup perundungan, kenakalan remaja, bahaya narkotika, etika bermedia sosial, judi daring, pertambangan ilegal, serta isu malpraktik dan aborsi dalam perspektif kesehatan. Hasil pengabdian menunjukkan bahwa program JMS berjalan secara sistematis, komunikatif, dan adaptif terhadap kebutuhan peserta, meskipun menghadapi sejumlah hambatan administratif, teknis, dan penyesuaian jadwal lapangan. Kegiatan ini juga menghasilkan dokumentasi operasional yang dapat dijadikan rujukan dalam pengembangan model penyuluhan hukum serupa di tingkat lokal. Kata kunci: generasi muda; jaksa masuk sekolah; litreasi hokum; penyuluhan hukum. AbstractLow levels of legal literacy and legal awareness among students may increase their vulnerability to bullying, juvenile delinquency, social media misuse, narcotics abuse, online gambling, and other at-risk behaviors. This community service article aims to describe the implementation of the Jaksa Masuk Sekolah (Prosecutor Goes to School, JMS) program by the Mandailing Natal District Prosecutor’s Office as an initiative to strengthen legal awareness in educational settings. The program was carried out using a descriptive documentary approach through the stages of planning, coordination, legal outreach, discussion, and administrative evaluation. Data were obtained from activity reports, presentation materials, minutes of meetings, photographic documentation, and brief interviews with the implementation team. The JMS program was conducted at eleven educational institutions in Panyabungan Subdistrict, comprising junior high schools, senior high schools/madrasahs, vocational schools, and a university. The outreach materials covered bullying, juvenile delinquency, the dangers of narcotics, ethics in social media use, online gambling, illegal mining, and issues related to medical malpractice and abortion within a health-law context. The results show that the JMS program was implemented in a systematic, communicative, and responsive manner, although several administrative, technical, and field scheduling constraints were encountered. The program also produced operational documentation that may serve as a reference for the development of similar legal outreach models at the local level. Keywords: young generation; prosecutors in schools; legal literacy; legal education.
