Abstract

The government needs to ensure that the management of HGB in the IKN is carried out by paying attention to the rights of local communities and indigenous peoples. The application of the principle of social justice as taught by John Rawls by paying special attention to more vulnerable groups. In every policy related to the procurement of building use rights to accelerate the development of the IKN, the principle of social justice must be maintained. This means that policies must provide protection for vulnerable groups and ensure that this development benefits all levels of society. This study aims to provide an understanding of the Ratio legis regulation of Building Use Rights for investors in Law Number 5 of 1960 and in Law Number 6 of 2023 and to find out, understand and explain the perspective of John Rawls' Theory of Justice in the regulation of building use rights in order to accelerate the development of the IKN. This research is normative in nature using a statutory regulatory approach, an approach and a conceptual approach. Research data were collected by means of document/literature studies.
