Abstract

Penelitian ini bertujuan untuk mengetahui transformasi pelayanan publik dan bentuk inovasi digital dalam peningkatan kualitas pelayanan publik di Mal Pelayanan Publik Badung. Penelitian ini merupakan jenis penelitian deskriptif dengan pendekatan kualitatif. Teknik pengumpulan data menggunakan dokumentasi dari website, surat kabar, dan jurnal yang relevan dengan penelitian. Analisis data pada penelitian ini juga menggunakan fitur Concept Map pada NVIVO12 Plus. Temuan penelitian ini menunjukkan bahwa bentuk pelayanan publik di Kabupaten Badung lebih mengutamakan model birokrasi pemerintahan yang inovatif karena proses pelayanan kepada masyarakat yang semula menggunakan kertas telah berubah dengan memanfaatkan teknologi digital. Terbentuknya Mal Pelayanan Publik Badung yang dianalisis menggunakan teori tata kelola inovatif secara riil, meningkatkan kualitas dan kuantitas pelayanan publik. Hal ini terlihat dari 29 instansi yang bekerja dan berafiliasi dengan Pemerintah, swasta, BUMN/BUMD, serta memiliki 12 fasilitas yang memadai. Pendirian Mall Pelayanan Publik juga mempengaruhi jumlah pengunjung yang datang setiap harinya karena berbagai pelayanan dalam satu tempat dapat dilayani dengan mudah dan cepat.

Abstract

This study aims to examine the forms of criminal violations of the General Election that occurred in Jambi Province during the 2024 Election, and analyze them from the perspectives of positive law and Islamic criminal law. This study uses a qualitative method with an empirical juridical approach, combining literature studies and field data from the Elections Supervisory Agency (Bawaslu), the Law Enforcement Agency (Gakkumdu), and court decisions. The results indicate that the most prevalent violations are money politics, off-schedule campaigning, violations of the neutrality of civil servants (ASN), the Indonesian National Armed Forces (TNI), and the Indonesian National Police (Polri), the spread of hoaxes, vote rigging, and the destruction of campaign materials. Of the total findings and reports in Jambi Province, the majority are administrative violations. However, seven cases were processed as election crimes, some of which have reached the investigation stage and court decisions. From an Islamic criminal law perspective, these violations are categorized as ta'zir crimes, with discretionary sanctions intended to provide a deterrent effect and safeguard the public interest. This study emphasizes the synergy between positive law and Islamic values ​​in realizing honest, fair, and dignified elections.

Abstract

This study examines the role of the Election Supervisory Agency (Bawaslu) of Bungo Regency in handling criminal offenses in the 2024 Bungo Regent and Deputy Regent elections. This study uses an empirical juridical method with a case study approach to analyze the phenomena during the election process. The results show that Bawaslu maintains election integrity through prevention, supervision, and coordination with the Integrated Law Enforcement Center (Gakkumdu). However, Bawaslu faces various obstacles such as limited human resources, budget, infrastructure, geographical complexity, and low public legal awareness. Other obstacles also arise from multi-interpretable regulatory aspects and limited time to handle violations. The Revote (PSU) case at 21 polling stations (TPS) in Bungo Regency is clear evidence of the importance of adequate supervision so that the democratic process runs honestly, fairly, and transparently. This study emphasizes the need to optimize prevention strategies, utilize technology, strengthen human resource capacity, and increase public participation so that Bawaslu's role is more effective in creating quality and dignified elections.

Abstract

This research aims to analyze the causes of the phenomenon of abstention and the level of community participation in the election of the Governor of Jambi Province in 2020. The study adopts a qualitative approach with a literature review as the methodology. Data collection is conducted through various sources such as books, journals, magazines, newspapers, and others. The use of the Concept Map feature in NVIVO12 Plus is also part of the research methodology. The research findings indicate that the level of community participation in the election of the governor in 2020 in Jambi Province reached 1,658,525 eligible voters. Out of this number, 1,570,285 votes were considered valid, while 88,240 votes were deemed invalid. Non-participating voters (abstention) amounted to 820,779 out of a total of 2,480,612 registered voters. Kerinci Regency had the highest abstention rate, where out of a total of 198,729 registered voters in the Permanent Voter List, 88,637 individuals (44.60%) chose to abstain. Several factors, including differences in the ethnic backgrounds of the candidates, educational levels, inadequate quality of candidates, political practices, apathetic attitudes of the community, lack of information, technical constraints, and the inaccessibility of polling locations influenced the phenomenon of abstention in the 2020 Jambi gubernatorial election.

Abstract

This study aims to examine the status of adopted children and the polarization of inheritance distribution in Merangin Regency, Jambi Province. The research method used is social legal research, which aims to understand legal phenomena within the social and cultural context in which the law operates. The results indicate that in Merangin Regency, adoption is not conducted in accordance with Islamic law. Adopted children are treated equally with biological children, and this also applies to inheritance distribution, resulting in them receiving more than one-third of the estate. This clearly contradicts Islamic law, which states that adopted children do not inherit; however, they are provided with the option of obtaining inheritance rights through a will or gift. The granting of mandatory will rights to adoptive children/parents by the Islamic Law Compilation of Islamic Law (KHI) represents a local feature of Islamic inheritance law in Indonesia. This legal breakthrough allows the regulation of wills in Islamic law to adapt to prevailing traditions. This study contributes to understanding how local customary practices in Merangin Regency diverge from classical Islamic inheritance principles, highlighting the tension between traditional adoption practices and the adaptive legal framework provided by KHI's mandatory will provisions.
