Abstract

Fenomena masa iddah bagi istri yang ditinggal wafat suaminya telah mengalami pergeseran makna dan praktik dalam masyarakat modern. Dalam Islam, masa iddah merupakan bentuk penghormatan terhadap suami yang telah meninggal dan menjadi sarana menjaga kemuliaan serta kehormatan wanita. Namun, di era digital saat ini, muncul kebiasaan baru, seperti mengunggah video ke media sosial yang menunjukkan aktivitas pribadi selama masa iddah. Perilaku ini memunculkan persoalan fikih sosial karena dinilai dapat menyerupai aktivitas keluar rumah atau menunjukkan ekspresi yang tidak mencerminkan suasana berkabung. Penelitian ini bertujuan untuk meninjau praktik tersebut dengan pendekatan fikih sosial, dengan metode kualitatif berbasis penelitian pustaka. Hasil analisis menunjukkan bahwa mengunggah konten ke media sosial saat masa iddah dapat bertentangan dengan nilai-nilai iddah apabila isi unggahan menunjukkan kebahagiaan yang berlebihan, berdandan, atau memperlihatkan diri secara terbuka. Hal ini perlu menjadi perhatian serius dalam pembinaan sosial keagamaan di tengah perubahan zaman.

Abstract

Social and economic changes in the modern era have led to shifts in household roles, including the phenomenon of wives becoming the primary breadwinners. This issue raises legal and social questions from an Islamic perspective, particularly under the Compilation of Islamic Law (KHI) and the concept of maslahah mursalah. This study aims to analyze the legal status of wives as primary breadwinners based on KHI provisions and the maslahah mursalah principle. The research employs a qualitative approach with normative analysis of Islamic legal regulations and concepts. The findings indicate that, under KHI, the husband is primarily responsible for providing for the family. However, under certain circumstances, the wife may assume this role while maintaining balance in the household. From the perspective of maslahah mursalah, this phenomenon is permissible as long as it brings benefits to the family and does not cause harm. Therefore, Islam provides flexibility in the division of financial responsibilities, ensuring justice and family welfare remain upheld.

Abstract

This study discusses how parental intervention affects children's household conditions and contributes to the occurrence of divorce in the Purworejo Religious Court. The main question in this study is the forms of intervention that emerge and their impact on marital stability. This research was conducted in the study of the sociology of law and family dynamics, emphasizing the role of intergenerational relationships. The method used is qualitatively descriptive, through interviews with judges and analysis of case documents. This study identified the patterns of intervention that occurred. The results show that parental intervention can be divided into two types: constructive, which helps to defuse conflict, and destructive, which exacerbates the problem. Destructive forms of intervention, such as bias, pressure, or excessive control, have been shown to be more dominant in having a direct impact on the collapse of the marital relationship. These findings provide an explanation of the limitations of the role of parents in the child's household as well as the importance of family education and mediation strategies to reduce intergenerational conflicts.

Abstract

This study examines the effectiveness of recommendations from psychologists and the Regional Child Protection Commission (KPAD) in marriage dispensation cases at the Wonosobo Religious Court from an Islamic law perspective. Marriage dispensation for children under the legal age remains a significant issue in Indonesia, requiring careful consideration of children's rights and best interests. This research aims to analyze the implementation of psychologist and KPAD recommendations in judges' decisions, evaluate their effectiveness in protecting children's interests, and examine their compatibility with Islamic law principles. Using a normative-empirical legal research method with a case study approach, data were collected through document analysis, interviews with judges, psychologists, KPAD officials, and direct observation at the Wonosobo Religious Court. The findings reveal that psychologist and KPAD recommendations are considered by judges but are not the sole determining factor in decisions. Effectiveness is constrained by limited resources, varying recommendation quality, and the dominance of urgent pregnancy considerations. From an Islamic law perspective, these recommendations align with the principles of maslahah (public interest) and protection of offspring (hifz al-nasl), though their implementation requires strengthening. The study recommends enhancing collaboration among institutions, improving the quality of psychological assessments, and developing more comprehensive guidelines that integrate Islamic law principles with child protection
