Abstract

Fenomena masa iddah bagi istri yang ditinggal wafat suaminya telah mengalami pergeseran makna dan praktik dalam masyarakat modern. Dalam Islam, masa iddah merupakan bentuk penghormatan terhadap suami yang telah meninggal dan menjadi sarana menjaga kemuliaan serta kehormatan wanita. Namun, di era digital saat ini, muncul kebiasaan baru, seperti mengunggah video ke media sosial yang menunjukkan aktivitas pribadi selama masa iddah. Perilaku ini memunculkan persoalan fikih sosial karena dinilai dapat menyerupai aktivitas keluar rumah atau menunjukkan ekspresi yang tidak mencerminkan suasana berkabung. Penelitian ini bertujuan untuk meninjau praktik tersebut dengan pendekatan fikih sosial, dengan metode kualitatif berbasis penelitian pustaka. Hasil analisis menunjukkan bahwa mengunggah konten ke media sosial saat masa iddah dapat bertentangan dengan nilai-nilai iddah apabila isi unggahan menunjukkan kebahagiaan yang berlebihan, berdandan, atau memperlihatkan diri secara terbuka. Hal ini perlu menjadi perhatian serius dalam pembinaan sosial keagamaan di tengah perubahan zaman.

Abstract

This study examines the role of convert husbands in forming a peaceful family in Islam. The background of this study is related to the increasing number of individuals who embrace Islam, often because of the need to fulfill marriage requirements. The main objective of this study is to analyze how converted husbands adapt to Islamic values ​​in building a peaceful family, with a focus on the role of husbands as leaders, protectors, and educators in creating a harmonious family environment. This study was conducted through the Mualaf Center institution in Yogyakarta with a qualitative approach through interviews with three couples of convert families. The findings of the study indicate that despite facing challenges in adjusting to a new religious identity, the role of convert husbands in forming a family full of peace, love, and spirituality is very important. Husbands play an important role in educating children, maintaining household harmony, and strengthening the spiritual foundation of the family. This study provides valuable insights into the dynamics of convert families in Muslim society and the important role of convert husbands in forming a peaceful family.

Abstract

In Religious Court proceedings, some divorce by talak cases lapse due to failure to pronounce talak as required by law, raising concerns over legal certainty and the rights of wives. This study examines the causes of lapsed Divorce of talak cases, analyses judicial reasoning in determining spousal maintenance obligations, and assesses the implications of such lapses for the legal protection of wives. The research employs a descriptive qualitative method with a normative legal approach. Primary data are derived from Case Number 1193/Pdt.G/2024/PA.Pwr, while secondary data consists of statutory regulations and relevant legal literature. The findings show that the lapse of the Divorce of talak case resulted from the petitioner’s failure to pronounce talak within the six months stipulated in Article 70, paragraph (6) of the Religious Courts Act. Judges based the determination of maintenance obligations on Article 80 paragraph (4) and Article 149 letters (a) and (b) of the Compilation of Islamic Law, supported by legal facts concerning neglect of maintenance and the parties’ economic conditions. The lapse of the case causes uncertainty regarding outstanding maintenance and marital status, resulting in psychological and social burdens for the wife.
