Abstract

Artikel ini membahas urgensi penegakan etika profesi hukum dalam merespons meningkatnya kasus pelanggaran kode etik oleh advokat, khususnya praktik penyuapan terhadap hakim di Indonesia pada periode 2020–2025. Penelitian ini bertujuan mengidentifikasi faktor-faktor penyebab degradasi moral profesi hukum dan merumuskan strategi penguatan etika profesi advokat secara sistemik. Metode yang digunakan adalah kajian literatur sistematis dengan pendekatan yuridis normatif dan studi kasus empirik terhadap sejumlah putusan pengadilan yang telah berkekuatan hukum tetap. Hasil penelitian menunjukkan bahwa degradasi etika terjadi karena kombinasi tekanan ekonomi, lemahnya pengawasan internal, budaya permisif terhadap praktik korupsi, dan tidak optimalnya penerapan sanksi. Praktik penyuapan ini telah merusak legitimasi sistem peradilan dan menurunkan kepercayaan publik terhadap supremasi hukum. Simpulan dari penelitian ini menekankan pentingnya pembaruan mendalam terhadap sistem pendidikan hukum, penguatan mekanisme pengawasan etis, dan perlunya reformasi kelembagaan profesi hukum. Rekomendasi mencakup peningkatan kesejahteraan advokat, pembentukan sistem pengawasan independen, dan kampanye kesadaran etik secara berkelanjutan untuk mencegah pelanggaran dan mengembalikan martabat profesi sebagai pilar keadilan.

Abstract

This study examines the role of the Administrative Court (Pengadilan Tata Usaha Negara - PTUN) in resolving administrative disputes in Indonesia through a systematic literature review approach. As a crucial pillar within the Indonesian judicial system, PTUN plays a strategic function in maintaining the balance of power between the government and its citizens through independent judicial control mechanisms. This research analyzes the effectiveness of PTUN in providing legal protection for citizens' rights against arbitrary administrative actions and evaluates the implementation of general principles of good governance in administrative judicial practice. The findings indicate that PTUN has significantly contributed to upholding the principles of the rule of law and promoting accountable governance, despite facing several challenges in its implementation. These challenges encompass structural aspects including limitations in human resources and infrastructure, procedural challenges related to the complexity of procedural law, and substantial challenges regarding consistency in legal interpretation and judgment execution. Comparative analysis with international administrative court systems provides valuable insights into best practices that can be adapted within the Indonesian context. This study recommends strengthening institutional capacity through human resource development and infrastructure modernization, simplifying procedural mechanisms, harmonizing legal interpretation, and enhancing public accessibility to administrative judicial services to optimize PTUN's role in strengthening the rule of law in Indonesia.

Abstract

This study aims to analyze the legal position of notaries as witnesses in the investigation process based on the applicable laws and regulations. This research uses a normative legal research method. Data collection is carried out through library research, by examining legal documents and literature from libraries, online legal databases, and reliable academic sources. The obtained data is analyzed using qualitative analysis, which includes data reduction, data classification, legal interpretation, and drawing conclusions. The analysis results indicate that a notary's position as a witness in an investigation process is legally recognized, but its implementation must go through the approval mechanism of the Notary Honorary Council to maintain a balance between the interests of law enforcement and the protection of the confidentiality of the office. From the perspective of professional ethics, notaries face a dilemma between the obligation to maintain confidentiality and the duty to provide truthful testimony. The Notary Code of Ethics provides clear guidelines but still requires consideration of proportionality in its application. Harmonization between legal obligations and professional ethics can be achieved through the application of the principle of proportionality, optimization of the role of the Notary Honorary Council, limitation of the scope of testimony, and provision of adequate legal protection for notaries.
