Abstract

This study examines the dynamics of Indonesia’s ratification of the Geneva Conventions in relation to the development of human rights (HAM). Since the national movement era, the spirit of human rights recognition had emerged, later reinforced through Indonesia's ratification of the 1949 Geneva Conventions and the Additional Protocols in 1958. However, implementation at the national level has encountered obstacles, including slow legal harmonization and limited understanding of humanitarian law principles among state actors. The study employs a normative juridical method through a literature-based approach, focusing on developments from pre-independence to the reform era. Findings reveal that Indonesia’s cautious stance toward international obligations, institutional disagreements, and political dynamics have significantly influenced both the ratification process and its execution. The research recommends strengthening national legal frameworks and enhancing institutional capacity through training to ensure effective implementation of the Geneva Conventions' principle

Abstract

The Israeli–Palestinian conflict is one of the longest and most complex conflicts in the world, which is not only backgrounded by political factors, but also aspects of trust and identity. This article discusses specifically aspects of Israel’s alleged violations of the 1949 Geneva Conventions in the context of this conflict. Although Israel has ratified all parts of the Geneva Convention and its additional protocols, various reports and studies indicate the existence of serious violations of the principles of humanitarian protection regulated in the convention. The most prominent violations include the forced displacement of the Palestinian civilian population, the mass killing of civilians, as well as the detention and inhumane treatment of Palestinian children. These actions violate a number of articles in the Geneva Conventions, such as Article 49 on the prohibition of forced transfers, Article 47 on the protection of civilians, and Article 31 which provides special protection for children. Although the international world, including the United Nations and human rights agencies, has denounced these violations, enforcement of international law against Israel still faces major challenges at the political and judicial levels. This article affirms the importance of the enforcement of international humanitarian law and the protection of human rights in armed conflict, as well as the need for a real commitment on all sides to halt violations and seek peaceful solutions that are just for both sides.

Abstract

Perkembangan teknologi informasi dan komunikasi telah membawa dampak besar terhadap transformasi global, termasuk dalam aspek keamanan siber. Negara berkembang seperti Indonesia menghadapi tantangan serius dalam membangun kapasitas pertahanan siber yang andal, akibat keterbatasan sumber daya, infrastruktur, serta regulasi yang belum harmonis. Dalam konteks ini, peran organisasi internasional menjadi sangat penting untuk membantu negara-negara berkembang dalam meningkatkan kesiapan dan ketahanan terhadap ancaman siber. Artikel ini membahas kontribusi organisasi internasional, khususnya International Telecommunication Union (ITU), dalam membangun kapasitas siber negara berkembang melalui kerja sama teknis, pelatihan sumber daya manusia, dan advokasi kebijakan keamanan siber. Melalui metode yuridis normatif dan studi pustaka, artikel ini menelusuri bagaimana ITU menjalankan perannya melalui berbagai inisiatif, seperti pengembangan broadband, pelatihan mitigasi kejahatan siber, serta kolaborasi dengan organisasi lain seperti IMPACT dan INTERPOL. Di sisi lain, Indonesia juga telah membentuk Badan Siber dan Sandi Negara (BSSN) sebagai langkah strategis untuk mengoordinasikan keamanan siber nasional. BSSN menerapkan strategi berdasarkan lima pilar Global Cybersecurity Index (GCI), yakni aspek hukum, teknis, organisasi, pengembangan kapasitas, dan kerja sama. Penelitian ini menyimpulkan bahwa kolaborasi internasional menjadi kunci dalam menciptakan ekosistem keamanan siber yang tangguh dan adaptif. Oleh karena itu, diperlukan sinergi berkelanjutan antara pemerintah, organisasi internasional, sektor swasta, akademisi, dan masyarakat guna meningkatkan daya saing digital negara berkembang di tengah tantangan dunia maya yang semakin kompleks.
