Abstract

A country is not always in a conducive and controlled state. Several disturbances and threats often occur which can threaten the integrity and sovereignty of the country. One of the threats to the state is ideology which can change the order of society and its perspective. In this era of globalization, Pancasila as a state ideology is being tested again by many foreign ideologies trying to enter our country through information media and technology that can be reached by all groups, such as the ideologies of communism, liberalism, capitalism, religious extremism and others. This journal aims to determine the existence of Pancasila as the basis for national defense in facing foreign ideological threats. The method used in this legal research is normative juridical legal research which uses library materials as primary sources. The results of this research are that even though it is often faced with interference and threats from foreign ideologies that want to replace the existence of Pancasila, the Pancasila ideology is able to continue to exist and is able to fight with other major ideologies which also act as a filter for foreign ideologies in influencing the Indonesian nation.

Abstract

Ketahanan nasional adalah keadaan suatu negara yang selalu berubah dan melindungi semua aspek kehidupannya dari ancaman. Pertahanan dan keamanan negara, masyarakat, dan individu adalah bagian dari ketahanan nasional. Pada saat ini, para ilmuwan telah memberikan beberapa definisi yang berkaitan dengan konsep keamanan dan pertahanan. Sangat penting untuk memahami berbagai ancaman dan kesulitan yang ada di bidang keamanan dan pertahanan saat ini. Selain itu, penting juga untuk menjelaskan bagaimana penelitian tentang ketahanan nasional sebanding dengan penelitian tentang pembentukan sistem keamanan nasional di negara lain. Penelitian ini adalah penelitian deskriptif kualitatif. Metode ini bergantung pada penelusuran literatur dan wawancara. Selain itu, penelitian ini menyelidiki jenis masalah yang umum di Indonesia. Beberapa di antaranya adalah ketidaksetaraan terhadap perbedaan dan masalah perbatasan, agama, kebangsaan, ras, dan golongan (SARA), ketidakadilan dalam reformasi birokrasi, kekurangan polisi, dan tingginya tingkat kriminalitas dan kejahatan transnasional. Peraturan yang mengatur keamanan dan perlindungan, serta ide, lembaga, dan konstitusi yang digunakan, membedakannya. Kemampuannya dalam melindungi dan memelihara keamanan sangat penting bagi kedaulatan suatu negara, seperti yang ditunjukkan oleh pasal tersebut.

Abstract

This research aims to clarify the authority of the Indonesian National Army (TNI) in eradicating acts of terrorism and the role of the TNI in supporting government policies in eradicating acts of terrorism in Indonesia. The method used in this research is normative juridical legal research, especially regarding the limitations of the TNI's role in eradicating criminal acts of terrorism. The approach used in this research is a normative juridical approach and a conceptual approach. The research results show that in implementing the TNI's functions and duties in eradicating acts of terrorism, the government must formulate and establish legal standards in detail and not conflict with the provisions of applicable laws and regulations. In the criminal justice system and the TNI must obey the military justice system. Therefore, the Presidential Decree states that the principle of legal certainty must be prioritized in carrying out the TNI's role in eradicating acts of terrorism and especially legal ambiguity which can weaken criminal law and must be prioritized if violations occur. The promulgated Presidential Decree provides clear and detailed indications regarding threats to the state, parameters for escalating the level of terrorist threats, legal regulations regarding the professionalism and criminal responsibility of the TNI for participating in public or political life in the civilian domain of government.

Abstract

This research aims to discuss the chronology of criminal acts of environmental pollution of ditches by PT Kalimantan Ferro Industry regarding the impact of environmental damage and the corporate accountability mechanism of PT Kalimantan Ferro Industry to resolve cases of ditch pollution in the surrounding environment. This research uses a normative juridical method sourced from secondary data. The research compares Law No. 32 of 2009 concerning Environmental Protection and Management with Article 88 of the Job Creation Law in Corporations, which eliminates absolute responsibility for corporate violations to protect the environment. The author analyzed the environmental problems caused by PT KFI's waste water management installation and the accountability mechanism for this case based on the perspective of the Job Creation Law in Corporations, which is known to have changed the rules regarding absolute responsibility for corporations. The results of this research show that corporate responsibility for waste pollution is now limited to administrative-level responsibility after the abolition of absolute responsibility.

Abstract

Developments over time continue to occur and the constitution itself often evolves with the times, so it is necessary to draft a "living" constitution, namely one that can keep up with the times and adapt to the needs of society. In general, the constitution is a guideline that regulates the running of the government, limits power, and guarantees human rights so that the government does not act arbitrarily. With the rapid development of technology in this day and age, technology such as Artificial Intelligence (AI) is starting to emerge, and so new ideas are emerging to facilitate the process of changing the constitution, namely by implementing AI. From there, questions arise such as how AI can be implemented into the constitutional change process and its implication. This article uses normative juridical methods by studying documents or literature. This research is based on several approaches, namely the conceptual approach, the statutory approach and the historical approach. With the application of Machine Learning for AI, it will be possible to implement AI in constitutional changes. AI will provide ideas and recommendations for changes to regulations that are felt to be no longer in line with people's aspirations. AI can also provide an overview of the impact of the changes to be made. Apart from that, AI will supervise changes to the constitution. The implementation of AI in constitutional change has significant implications, one of which is making the constitutional change process more efficient.

Abstract

In 1945, Indonesia proclaimed its independence from colonial rule. In the following decades the Indonesian nation has experienced significant changes, especially in the government system. This article discusses the analysis of elections in Indonesia, which are influenced by the development of a democratic government system. The method used is normative juridical, where legal research is carried out by examining library materials or secondary data. This research uses a literature study as a data collection method. The research concludes that the implementation of a democratic system cannot be separated from the implementation of constitutional democracy. Democracy is chosen over other systems because it is considered the best. Making people aware of their rights and obligations, and democracy must be fully carried out by "Policy Makers" as the power to regulate and/or run the government in accordance with the law.

Abstract

Almost every country has aspirations to become a rule of law state. Indonesia is no exception, with its aspiration as a rule of law state enshrined in the 1945 Constitution of the Republic of Indonesia. The concept of a rule of law state places all activities of the state and its society under the law. It also governs the administration of the state through legislation and upholds the sovereignty or supremacy of the law based on principles and values of justice. This research employs a juridical normative approach by conducting document analysis and utilizing data and information obtained through literature review. The research findings suggest that the concept of a rule of law state should be upheld because it offers the advantage of enabling the state to control society and foster justice within the nation. Furthermore, to address the shortcomings of this legal concept, it is necessary to incorporate principles and values that have developed and become integral to society, such as those embodied in Pancasila, into prevailing legislation. This ensures that legislation serves not only as a tool for those in power to govern the state but also as a manifestation of justice within society.

Abstract

This research aims to highlight and classify differences in communication styles as an indication of the orderly and free functioning of democracy in accordance with the principles of democracy and the rule of law according to Constitutional Law experts. The research method used is a normative juridical method by linking the principles of the 1945 Constitution and the doctrines of experts that are in line with the topic of discussion. The research method used by the author is a normative juridical method. The normative juridical research method involves legal research carried out through library research, where the main material to be analyzed is collected by searching for regulations and literature related to the problem being studied. The normative juridical method is used by observing and processing the process of implementing ideal democracy in national and state life. As a country that upholds the principles of democracy, freedom to express opinions has been the right of the Indonesian people since the time we succeeded in winning national independence. Even though freedom of opinion is something that is an indicator of the functioning of democracy in a country, it is important to remember that freedom of opinion must also pay attention to ethics and morals in its delivery. The concept of freedom of opinion must comply with Pancasila democracy.

Abstract

Indonesia has great potential from marine resources that have not been managed to the fullest and require complete and accurate data for optimal utilisation. These resources can support national economic progress, but illegal practices such as fishing hinder this potential. Illegal fishing causes huge losses to the state, local fishermen, and consumers. Overlapping regulations and lack of institutional clarity complicate addressing this issue. Although legal reform efforts have been made, national and international co-operation is needed to address these challenges for the sustainability of marine resources and the welfare of coastal communities. This research uses a normative legal research method, which relies on the analysis of library materials, secondary data, legal principles, legal principles, and legal doctrines to resolve the legal issues formulated. Sustainable law enforcement is expected to provide a deterrent effect for foreign fishermen. The issue of illegal fishing is not only about the loss of fisheries resources, but also about the violation of state sovereignty which is very principled. Therefore, law enforcement and sovereignty must be strictly enforced.

Abstract

The relocation of the capital city is a strategic decision that can have significant impacts on the government's organizational structure and the management of national assets. This article aims to analyze the effects of capital relocation on the government's organizational structure and the management of national assets using a normative juridical approach and data collection through literature review. Through the analysis of various regulations, legal documents, and relevant theories, this article presents how capital relocation can affect the government's organizational structure. Additionally, the article also highlights aspects of national asset management related to capital relocation, such as the transfer of ownership and the management of infrastructure. Thus, this article contributes to the legal and administrative implications of capital relocation.
